1. Pure Obligation
This is when an obligation is not liable to any circumstances and doesn’t have any
deadline of fulfillment. This kind of obligation said to be demandable any time.
Ito ay isang obligation kung saan walang kahit anong kondisyon at walang sinasabi kung
kailan pwedeng iperform ni obligor and kanyang duty kay obligee. As for obligee naman
ito yung obligation na kung saan pwede silang magdemand any time since nga walang
specific date ang papeperform ng obligation.
2. Example of Pure Obligation
For example, your mother promised you that she will give you a ₱10,000.
This example is a pure obligation kasi she just promised you to give ₱10,000 pero hindi
siya nagsabi kung kailan niya ibibigay yung money and wala ring kahit na anong
pinapagawa sayo to get that money. Even walang pinapagaya sayo ang mother mo
pwede mo siya tanung or pwede ka magdemand kung kailan mo makukuha yung pera
since nangako siya sayo.
3. Example of Pure Obligation
Another example, you promised to your little brother that you will give him a brand-new
phone.
Kung kanina ang situation is ikaw yung obligee, this time ikaw naman yung obligor. This
time ikaw ang nangako sa kapatid mo na bibilhan mo siya ng sarili niyang phone pero
hindi ka nagsabi kung kailan at bibigyan mo rin siya without any conditions or kapalit.
But your liable to give him a brand-new phone since you said it yourself. Pwede rin siya
sayo magdemand na hingin agad yung phone since wala ka ngang sinabi na time kung
kailan.
4. Conditional Obligation
The demandability or extinguishment of this obligation is depending on the existence of
a condition.
Ito yung obligation na kabaliktaran ng pure obligation dahil ito ay obligasyon na kung
saan mayroong conditions para ifulfill ni obligor ang kanyang duty kay obligee.
5. Example of Conditional Obligation
First example, when I said to my friend that I will give him a kpop album if he can guess
my favorite kpop group.
The obligor here is me and my friend is the obligee. Ang condition na ibinigay ko sa
kanya is he need to guess my favorite kpop group. My obligation here is giving him a
album if he giees it right.
6. Example of Conditional Obligation
Second example is when someone offer you to do something in exchange of money. My
uncle said to me that he will give me ₱21,000 if I will stay being in high honor.
This time around, I am the obligee, with my uncle acting as the obligor. This is where he
commits to an obligation in exchange for the condition, he agreed to with me that I
must stay to be in high honor.
7. 2 Kinds of Conditional Obligation
Suspensive Condition – ito yung condition kung saan suspended yung rights or
obligation until mangyare yung uncertain future events na sinabi ni obligor. Kapag
nangyare yung uncertain event na sinaad ni obligor tsaka lang mag eexist yung
obligation niya kay obligee.
Resolutory Condition – ito naman yung condition kung saan naman nag eexist na yung
obligation ni obligee to his obligor at kapag nagawa na ni obligee yung condition ni
obligor mawawala na yung obligation niya.
8. Example of Suspensive Condition
Mr. Eren promise to give iPhone X on December 18, 2021 to Mr. Levi if Mr. Levi will
throw a part on December 31, 2021. If Mr. Levi fulfill the condition of Mr. Eren, Mr. Eren
on December 31, 2021 onwards will have an obligation to Mr. Levi. While if Mr. Levi
didn’t fulfill the condition, the obligation of Mr. Eren will be void or null as if the promise
didn’t once exist.
9. Example of Resolutory Condition
For rental fee Mr. Kuroko bind himself to pay his friend ₱10,000 every year until he finds
a new apartment. His friend is the obligor while Mr. Kuroko is the obligee. Once Mr.
Kuroko find a new apartment, his obligation to his friend will terminated.
10. Potestative Condition and Example
Ito yung condition na kung saan isa sa mga parties ay nakadepende sa kung anong will
mayroon ang isa pang party.
Example dito is Lucian promise to give Senna ₱8,000 if Lucian will give a laptop to
someone. This is potestative kasi whether he give a laptop or not it’s his will.
11. Casual Condition and Example
Ito naman ang condition kung saan nakadepende sa third person yung obligation.
Example, Ms. Lux will pay Mr. Ezreal if Mr. Ezreal invite Ms. Zoe in a party and she will
join. The obligor here is si Ms. Lux while and obligee is Mr. Ezreal and the condition here
is kung mapapapayag ni Mr. Ezreal si Ms. Zoe na makaattend ng party with them. This is
valid kasi nakadepende sa decision ni Ms. Zoe kung magkakaroon ba ng chance.
12. Mixed Condition and Example
Ito naman yung pinagsamang potestative at casual. Nakadepende ito sa will ng isang
party at will ng third person.
Example naman dito is Blue will give ₱100,000 to Green if Blue’s research will win on a
Business Research Contest. Mixed condition siya kasi the first condition here is kung
isasali ba ni Blue yung reaserch niya sa contest and the other one naman is yung
decision ng judges sa Business Research Contest if magdecide si Blue na sumali.
13. Impossible Condition and Example
Ito naman yung condition na kung saan imposible at hindi magagawa.
Example dito is I will give you a car if the weather will not change within a year.
14. – 17. Kind of Impossible Obligation
Physically Impossible Condition - are the conditions na di mangyayare, cannot be done,
or hindi nag eexist. Example: I will give you a house and lot if you will can dive 1,000
meters dive in the ocean with any equipment.
Legally Impossible Condition – ito naman yung mga illegal conditions or against the
morals. Example: I will give you ₱100,000,000 if you kill my husband.
Pink must offer Cyan a book on June 30, 2020. The period is for Pink's benefit (the
obligor). Pink must pay Cyan ₱11,000 on June 30, 2020 no extention, with the provision
that Cyan may demand payment before that date.
