The Problem and Review of Related literature

BACKGOUND OF THE
STUDY

Women being, and to enhance the dignity of each other. For the

those of community that lack of knowledge to identify the use of Laws are

now easily manipulated. Because of that innocent people are the number

one victim of this modernization stage. In this study help us to understand

the use of rights and the levels of knowledge on the use of Republic 8353

“The Anti Rape Law of 1997”

The Anti Rape Law of 1997 redefines as:

1. A CRIME AGAINST PERSONS

Rape violates person’s well-being and just one’s virginity and

purity.

The la considers that any person, whether a prostituted person, non-virgin


or one who has an active sexual life be victimized by rape.

2. A PUBLIC OFFENSE

By declaring that rape is a crime against persons, the law no longer


considers it as a private crime.

Anyone who has knowledge of the crime many file a case on the victim’s

behalf. The prosecution continues even if the victim drops the case or
pardons the offender.

WHAT CONSTITUTES RAPE?

Rape is committed; By a man who shall have sexual intercourse

with a woman under any of the following circumstances.

A. Through force, threat, or intimidation;

B. When the victim deprived of reason or is unconscious.

C. Through fraudulent machination or grave abuse of author; and

D. When the victim under twelve (12) years of age or is demented, even

if one of the above circumstances are present.

By any person who, under any of the above circumstances, commits an

act of sexual assault by inserting his penis into another person’s mouth

or anal orifice, or any instrument or object, into genital or oral orifice of

another person.

WHO CAN BE RAPE?

Anyone can be a rape victim, but the incidence of rape is more

rampant in women and girls.

WHO CAN COMMIT RAPE?

Any man or woman may be held liable for rape. It is possible that a man

may rape his own wife, an act deemed as “marital rape”. The penalty for
rape in general may apply on the offender who commit marital rape.

HOW IS THE CRIME PUNISHED?

The penalty varies depending on the act itself and the

circumstances surrounding it.

Reclusion Perpetua

(Imprisonment from 20 to 40 years) is imposed on the offender if

rape is committed through sexual intercourse.

PRISON MAYOR

(Imprisonment from 6 to 12 years) is imposed on the offender if rape

was through oral or anal sex of through the use of any use of object

or instrument that was inserted into the mouth or anal orifice of the woman

or a man.

This may also be elevated to Reclusion Temporal (Imprisonment

from 12 to 20 years) or Reclusion Perpetua depending on the circumstances


surroundings the crime.
Historically, many studies have examined about "Anti Rape Law" or known as
Republic Act 8353: The Anti Rape Law of 1997 “AN ACT EXPANDING THE
DEFINITION OF THE CRIME OF RAPE, RECLASSIFYING THE SAME AS ACRIME
AGAINST PER- SONS, OTHERWISE KNOWN AS THE REVISED PENAL CODE,
AND FOR THE PURPOSE”

According to Republic of the Philippines: Philippine Commission


on Women
Section 1. Short Title. – This Act shall be known as” The Anti- Rape
Law of 1997.

Section 2. Rape as Crime Against Persons. The crime of rape shall


here after classified as a Crime Against under Title Eight of Act No. 3815,
as amended otherwise known as the Revised Penal Code. Accordingly,
there shall be incorporated into Title Eight of the same Code a new
chapter to be known as Chapter Three, on Rape, to read
As follows:
Chapter Three
“Rape”

Article 266-A. Rape: When and How Committed- Rape is committed.

1.) By a man who shall have carnal knowledge of a woman under Any
of the following circumstances:
a) Through force, threat, or intimidation; b.) When the offended party
is deprived of reason or otherwise unconscious.
c.) By means of fraudulent machination or grave abuse of authority;
and
d.) When the offended party is under twelve (12) years of age or is
demented, even though none of the circumstances mentioned above be
present.

2.) By any person who, under any of the circumstances mentioned in


paragraph 1 hereof, shall commit an act of sexual assault by inserting
His penis into another person’s mouth or anal orifice, or any instrument
or object, into the genital or anal orifice another person.
Article 266-B Penalty – Rape under paragraph 1 of the next preceding
Article shall be punished by reclusion Perpetua.

Whenever the rape is committed with the use of a deadly weapon


or by two or more persons, the penalty shall be reclusion Perpetua to
death.

When by reason or on the occasion of the rape, the victim has


become Insane The penalty should become reclusion Perpetua to death.

When the rape is attempted and a homicide is a committed by


reason or on occasion thereof, the penalty shall be reclusion
Perpetua to death.

When by the reason or on the occasion of the rape,


homicide is Committed, the penalty shall be death. The death penalty
shall also be imposed the crime of rape is committed with any
of the following aggravating/qualifying circumstances:

1.) When the victim is under (18) years of age and the offender is a
Parent, Ascendant, step- parent, guardian relative by consanguinity or
Affinity within the third civil degree, or the common law spouse of the
Parent of the victim: 2.) When the victim is under custody of the police or
military authorities Or any law of enforcement or penal institution:

3.) When the rape is committed in full view of the spouse, parent,
any of the children or the other relatives within the third civil degree of
consanguinity.

When the victim is religious engaged in legitimate religious vocation

or calling and is personally known to be such by the offender before or

at the time of the commission of the crime; When the victim is a child

below seven (7) years old. When the offenders know that he is afflicted

with the Human Immuno-Deficiency Virus (HIV)/Acquired Immune

Deficiency Syndrome (AIDS) or any other sexually transmissible

disease and the virus or disease is transmitted to the victim;

When committed by any member of the Armed Forces of the

Philippines National Police or any law enforcement agency or

penal institution, when the offender took advantage of his position To

facilitate the commission of the crime;

When by the reason or on the occasion of the rape, the victim

suffered. Permanent physical mutilation or disability;

When the offender knew of the pregnancy of the offended party

at the time of the commission of the crime;


and When the offender knew of the mental disability, emotional

disorder and or physical handicap of the offended party at the time

of the commission of the crime Rape under paragraph 2 of the next

preceding article shall be punishing by. Prison Mayor

Whenever the rape is committed with the use of a deadly weapon

or by two or more persons, the penalty shall be prison mayor to

reclusion temporal.

When by the reason or on the occasion of the rape, the victim

has become insane, the penalty shall be reclusion temporal.

When the rape is attempted and a homicide is committed by

reason or on the occasion thereof, the penalty shall be reclusion

temporal to reclusion Perpetua.

When by reason or on the occasion of the rape, homicide is

committed, the penalty shall be reclusion Perpetua. Reclusion temporal

shall be imposed if the rape is committed with any of the ten

aggravating qualifying circumstances mentioned in this article.


Article 266-C. Effect of Pardon. - The subsequent valid marriage

between the offended party shall extinguish the criminal action or the

penalty imposed. In case it is the legal husband who is the offender,

the subsequent forgiveness by the wife as the offended party shall

extinguish the criminal Action or the penalty.

Provided, That the crime shall not be extinguished of the penalty

Shall not be abated if the marriage is void ab initio.

Article 266-D Presumptions. – Any physical overt act

manifesting resistance against the act of rape in any degree from

the offended party, or where the offended party is so situated as to

render her/him incapable of giving valid consent, may be

accepted as evidence in the prosecution of the acts punished under.

Article 266-A Sec.3.Separability Clause- If any part, Sec., or provision

of this Act is declared invalid or unconstitutional, the other parts thereof

Affected thereby shall remain valid.

Sec.4.Repealing Clause. – Article 336 of Act No. 3815, as amended,

And all laws, acts, presidential decrees, executive orders,


administrative Orders, rules and regulation inconsistent with or

contrary to provisions of this Act are deemed amended, modified or

repealed accordingly.

Sec. 5. Effectivity. - This Act shall take effect fifteen (15) days

After completion of its publication in two (2) newspaper of general

Circulation.

PROBLEM

The primary purpose of this study is to determine the Level of

knowledge on the use of the Anti-Rape Law of Grade 12-Female

HUMSS Students of Federico N. Ceralde Integrated School.

This seeks to answer the following questions.

1.What are the Student's profile in GRADES 12 students in Federico

N. Ceralde Integrated School?

A. Age
B. Knowledge

2.What are the Levels of Knowledge on the use of “The Anti Rape

Law “of Grade12 Female (HUMSS) students of Federico N.

Cerelade Integrated School?

A. Strong

B. Weak

3. How many Levels of knowledge on the use of Anti Rape Law” of

Grade 12 Female HUMSS in Federico N. Ceralde Integrated School?


IV. HYPOTHESIS

Null Hypothesis

There is no correlation between level of knowledge and gender of


Grade 12 Female (HUMSS) students.

Alternative Hypothesis

There is a correlation between the level of knowledge and the


gender of Grade 12 Female (HUMSS) students.
V.SIGNIFICANCE OF THE STUDY

This study will increase understanding and awareness of knowledge of


Human rights. The results of this study would be great to help the Students,
Community, Teachers, and Future Researchers in the following ways:

Students

It will help them to be educated and able to protect them self of any
circumstances.

Community

The levels of their knowledge can’t easily manipulated, because they have
a background about the scenarios.

Teachers

The result of the study will provide them useful information in


understanding the levels of knowledge on the use of ‘The ANTI Rape law”,
and this will be able to give them a better approach in the community.

Future Research

This study is essential to those who wish to conduct further studies


subject on this study. Any vital information the study can provide and
help them to make further investigation in their knowledge
VI. SCOPE AND LIMITATION OF THE STUDY

The study was conducted in the Federico N. Ceralde Integrated

School and the Respondents of the study are the Grade 12 HUMSS

student. Determining The Levels of knowledge on the use of

“Anti-Rape Law”

VII.DEFINITION OF TERMS

For the better and more precise understanding of this study, the following terms
are defined;

 Protection – for them self to avoid unnecessary happening in their life.


 Levels of the knowledge- it can lead the community to become more firm of
their every action that they take.
 Understanding- to strengthen their capability to face any hard times
especially for those are not familiar of the study.
CHAPTER II
METHODOLOGY

Research Design

The study will make use of Descriptive Method utilizing both

Quantitative and Qualitative methods to investigate the learning

experiences of the (HUMSS) students in the clinical practice.

I. SAMPLING

Locale of the Study

The study will be conducted at the Senior High School

department of Federico N. Ceralde Integrated School in Bonuan

Binlo Dagupan City, Pangasinan

Respondents of the Study

The respondents of this study will be the Female students level

12 of HUMSS track/ strand on the 2nd semester of the

S.Y.2020-2021

RESEARCH INSTRUMENT

The Research Instruments that the researcher used was

Online Survey, due to the pandemic crisis the researcher decides

to create an efficient and effort less survey for everyone. And to

avoid any kinds of massive impact of virus.

VI. DATA GATHERRING PROCEDURES

Data Gathering Procedure:

A letter of request was sent to and approved by the Adviser

of the Researcher of the Senior High School Department, which

served as the researcher’s permission to research within the

School Campus.

The survey questionnaires were distributed to the research

respondents of Senior High School of Federico N. Ceralde

Integrated School. The questionnaires. were gathered one by

one after the student answer the test questionnaires and the

surveys were scrutinized by the researchers to see that all the

needed data were filled up.

The data that were collected and checked presented,

analyzed and interpreted with the application of the following

statistical tools.
Statistical Treatment of Data

The researchers will use the more efficient and effective methods of
analyzing data in correlation with the research objectives. The use of
appropriate statistical instrument provided a Pearson’s Product

Correlation for the organization, analysis and interpretation of research

data.

the strength and the direction of a linear relationship between two

variables. The linear correlation coefficient is sometimes referred to

as the Pearson Product-Moment Correlation coefficient in honor

of its developer Karl Pearson The mathematical formula for computing

where n = the number of pairs of data x and y = the variables The value

of r is such that −1 < r < +1. The + and – signs are used for the positive

linear correlation and negative linear correlations, respectively.


Positive correlation. If x and y have a strong positive linear

correlation, r is close to the +1 An r value of exactly +1 indicates a

perfect positive fit. Positive values indicate a relationship between

x and y variables such that at values for x increases values for

y also increases. Negative correlation. If x and y have a strong

linear correlation, r is close to −1. An r value of exactly −1 indicates

a perfect negative fit. Negative values indicate a relationship between

x and y such that as the values of x increases, values for y decreases

. No correlation: If there is no linear correlation or a weak linear

correlation, r is close to 0. A value near zero means that there is a

random, non-linear relationship between the two variables.

A perfect correlation of ±1 occurs only when the data points all lie

exactly on a straight line. If r = +1, the slope is positive. If r = −1, the

slope of this line is negative

Correlation named after Charles Spearman and often denoted by the Greek letter ρ
(rho), or as r s is a non-parametric measure of statistical dependence between two
variables. It assesses how well the relationship between two variables can be
described using a monotonic function. A perfect Spearman correlation of +1 or −1
occurs when each of the variables is a perfect monotone function of the other.

I. Plan for Data Analysis

This chapter presents analysis and interprets the data gathered on the

Levels of knowledge on the use of “The Anti Rape Law” Grade 12 Female

(HUMSS) of Federico N. Ceralde Integrated School. The presentation is

SUMMARY OF FINDINGS, CONCLUSION AND
RECOMMENDATION

This chapter presents the summary of the major findings, as well

as conclusion drawn from the findings. The recommendations of the

study based from the findings and conclusions of the study.

Summary

The primary purpose of this study is to is determine the Levels of


Knowledge on the use (HUMSS) of Federico N. Ceralde Integrated

School. This seeks to answer the following question

1.What are the Student's profile in GRADES 12 student’s in

Federico N. Ceralde Integrated School?

A. Age
B. Knowledge

2.What are the Levels of Knowledge on the use of “The Anti Rape

Law “of Grade12 Female (HUMSS) students of Federico N. Cerelade


Integrated School?

A. Strong

B. Weak

3.How many Levels of knowledge on the use of Anti Rape Law of


Grade 12 Female (HUMSS) in Federico N. Ceralde Integrated School?
The Correlational method of research was used I this study.
Correlational Research is a type of non-experimental research method
, in which a researcher measures two variables, understands and asses
the statistical relationship between them with no influence from any
extraneous variable.

Findings:

Base on the study conducted by the researchers, the following

findings were drawn:

1. On the Age Profile of the Students

There is a correlation between level of knowledge and the Age of


the student.

There 16 Female student’s respondents that answered the online


survey about the study. And most of them are 18 years old and above so
the survey that we float are have a correlation between of the study.

2. On the Knowledge of the Respondents

There is a correlation between level of knowledge and the Age of the

student. Base on the solution by using the formula of Pearson’s Product


Correlation (r= -1) Perfect correlation /negative correlation that means they
have a slight knowledge about the study.
3. On the Rating of knowledge of the Respondents

There is a correlation between level of knowledge and the

Age of the student. To get the answer the researcher’s used the
Spearman’s Rank Order Correlation. In the second question the
researcher’s used the rating or label in Very high and Vey low.

According from the solution that the researcher calculated the final

was p (rho)=-0.9 Very High n/negative correlation that means that they
have a high knowledge about the study.

Conclusion:

Based on the findings of the study, the researchers have concluded


that majority of the respondents belongs to 18- 20 years and of them are
female. The researchers also concluded that:

There is a correlation between level of knowledge and the Age of the


student. On the use of knowledge, we can protect, understand and a
achieve the truth and we deserve that word.
Recommendation

Based in the conclusions derived from the findings of this study,

the following recommendations are made.

Promoting women’s rights and gender equality

Rape is a crime involving power relations between crime involving


power relations between the and male STRENGTHENING THE
PROVISIONS OF R.A. 8353: AMENDING THE ANTI-RAPE LAW 2 the
offender and the victim, and rooted in male dominance and female
subordination. It is no doubt, the result of disparities in the status and
situations of women and men - between the more powerful and the
oppressed. The Anti-Rape Law should be viewed from a perspective that
promotes the right of the more vulnerable groups and ensures their freedom
from violence

Responding to International Commitments

Article 2 of the Convention on the Elimination of All Forms


of Discrimination Against Women (CEDAW) calls on the States Parties
to condemn discrimination against women in all its forms, and agree to
pursue by all appropriate means and without delay a policy of
eliminating discrimination against women. While the Philippines has
made considerable progress and milestones in keeping up with
this commitment, the 2016 CEDAW Committee Concluding Observations
on the Philippines’ Combined 7th and 8th Periodic Reports raised
concerns over the fact that statutory rape under the Anti-Rape Law of
1997 (Republic Act No. 8353) remains limited to cases wherein the
victim is under the age of 12. Thus, the CEDAW Committee
recommends expediting the amendment of the Anti-Rape Law of 1997
putting lack of consent as primary element of the definition of rape and
raising the minimum age of sexual consent which is presently set too
low at 12 years to at least 16 years.

Moreover, the United Nations Sustainable Development


Goals, particularly Goal No. 5 pertaining to Gender Equality, targets,
among others, the elimination of all forms of violence against all women
and girls in the public and private spheres including trafficking and
sexual and other types of exploitation.
Alignment with National Priorities Amending the Anti-Rape
Law is consistent with the new administration’s agenda on women’s
rights. More importantly, it responds to the mandate of Congress
under the Magna Carta of Women to amend or repeal laws
that are discriminatory to women.

POLICY RECOMMENDATION

1. PCW proposes the following salient features of the new


Anti-Rape Law:

A. Specify that rape is “a sexual assault that violates a person’s


right to personal security and bodily integrity with the essential element
of lack of consent”;
B. The crime is committed by

a. a man who has carnal knowledge of a woman without her consent,


whether or not the woman suffers injuries;

b. a man who touches or inserts his penis into the female’s inner or
outer vaginal labia, without her consent, whether or not the woman
suffers injuries;

c. a man who touches or inserts his penis into another person’s mouth
or anal orifice, without the person’s consent, whether or not the person
suffers injuries;

d. a person who inserts any instrument or object, including a finger,


into the genital or anal orifice of another person, without the latter’s
consent.

C. The crime is committed under any of the following circumstances:

a. Through lack of victim’s consent, force, threat or intimidation;

b. Through fraudulent machination or abuse of authority;

c. In coercive or other similar circumstances rendering


the complainant incapable of giving consent,
including forcing another individual to sexually assault the victim;
d. When the offended person is deprived of reason or otherwise
unconscious, or is demented even though none of the
circumstances mentioned above be present, provided that he/she is
not in his/her lucid interval during the sexual act.

e. Age of Statutory Rape: When the offended party is under sixteen


(16) years of age even though none of the circumstances mentioned
above be present;

D. Define “consent” as the voluntary agreement to engage in the sexual


activity in question, provided:
a. the person consenting fully understands what is being proposed;

b. the person consenting is aware of the societal standards of


what is proposed;

c. agreements or disagreements will be respected equally;

d. both parties enter into the relationship or proposal voluntarily;


and

e. both parties are mentally competent.

E. Specify that the use of weapon, or other external


force causing physical injuries maiming, disfigurement, or endangerment
of the life of the victim be considered as one of the aggravating
circumstances of the crime.
2. PCW also calls for the repeal of Article 266-C of the Anti-Rape Law
of 1997, pertaining to the forgiveness clause which states that:

"Article 266-C. Effect of Pardon. - The subsequent valid marriage between


the offended party shall extinguish the criminal action or the penalty
imposed. In case it is the legal husband who is the offender, the
subsequent forgiveness by the wife as the offended party shall extinguish
the criminal action or the penalty: Provided, that the crime shall
not be extinguished or the penalty shall not be abated if the marriage
is “void ab initio.”

3. An amendment to Article 266-D is also proposed to


avoid misinterpretation, to read as:

"Article 266-D. Presumptions. - Any physical overt act manifesting


resistance against the act of rape in any degree from the offended
party, or where the offended party is so situated as to render her/him
incapable of giving valid consent, may be accepted as evidence
in the prosecution of the acts punished under Article 266-A. However,
the absence of physical resistance must not be taken as consent on the
part of the complainant. "

4. PCW also calls on the Supreme Court to consider issuing a “Rule on


Trial of Rape Cases” which may include the following:

A. Application of the “rape shield rule” as provided for in Section 6 of


Republic Act 8505.
B. Guiding principles on the appreciation of evidence in rape cases.
C. Child and gender-sensitive decorum for lawyers, prosecutors,
judges and other court personnel during trial of rape cases into a more
gender-responsive one as it addresses gaps and lapses
which its original crafters failed to consider. It is hoped that our
legislators will prioritize and favor the immediate enactment of a law to
amend the existing Anti-Rape Law provisions, in the interest of fulfilling them
mandate under the Constitution and the Magna Carta of Women, as
well as ensuring the best interest of the child.

Advocacy

The Researcher will tie up with the selected Public school under the
Schools Division Office of Dagupan City, where the informants are

enrolled. The researcher will also have to associate with the officials of

the selected school to be able to delve deeper into knowledge of

these agencies with regards to their permission.
