THIS AGREEMENT IS MADE ON BETWEEN M/S ANI CONSTRUCTION R/O B-14, MEA APARTMENTS, C-
58/29, SECTOR-62, NOIDA (HERE-IN AFTER TO BE KNOWN AS 1ST PARTY) AND MR. RAJAT R/O A-30,
SECTOR-40, NOIDA (HERE-IN AFTER TO BE KNOWN AS 2ND PARTY).
WHEREAS THE 1ST PARTY IS ENGAGED IN THE BUSINESS OF CONSTRUCTION AND HAS THE EXPERTISE
IN THE SAME.
AND WHEREAS THE 2ND PARTY HAS APPROACHED THE 1ST PARTY FOR CONSTRUCTION ONLY AT A-30,
SECTOR-40, NOIDA
AND WHEREAS THE 1ST PARTY HAS AGREED TO CARRY OUT THE CONSTRUCTION AT THE SAID SITE ON
THE FOLLOWING SPECIFICATIONS AND TERMS & CONDITIONS WHICH ARE SPELLED OUT AND AGREED
HERE UNDER BETWEEN THE 1ST AND THE 2ND PARTY.
1. THAT THE 2ND PARTY SHALL PROVIDE THE ARCHITECTURAL DRAWINGS INCLUDING
STRUCTURAL, PLUMBING, ELECTRICAL DRAWINGS.
2. THAT THE 2ND PARTY DONE THE SANCTIONS/PERMISSIONS FROM THE CONCERN AUTHORITY
FOR BUILDING PLAN APPROVAL AND COMPLETION CERTIFICATE, WATER & SEWER CONNECTION
AND APPROPRIATE KW FOR ELECTRICITY CONNECTION, PROVISION OF WATER & ELECTRICITY
EXPENSES INCLUDING BILL DURING CONSTRUCTION WILL BE PAID BY 2 ND PARTY.
3. THAT IT IS CLEARLY UNDERSTOOD BY THE 1ST PARTY TO COMPLETE THEIR SCOPE OF WORK
WITHIN 11 MONTHS FROM THE DATE OF THIS AGREEENT SIGNED. THE 2ND PARTY AGREED WITH
SCHEDULE AND THE PAYMENT SHALL BE MADE TO THE 1ST PARTY AS PER THE SCHEDULE. IN
CASE THE PAYMENTS ARE WITHHELD BY THE 2 ND PARTY AND ARE NOT PAID TO THE 1ST PARTY,
THEN IN THAT EVENTUALITY THE 1ST PARTY SHALL BE WITHIN ITS RIGHT TO WITHDRAW THE
LABOUR AND STOP THE WORK AT THE SAID SITE TILL THE PAYMENTS ARE NOT MADE HOWEVER,
THE 1ST PARTY SHALL COMPLETE THE WORK AS PER THE SCHEDULE AND COMPLETE THE
CONSTRUCTION WITHOUT ANY DELAY IN CASE THE PAYMENTS ARE MADE BY THE 2ND PARTY TO
THE 1ST PARTY.
5. THAT IS AGREED BY THE BOTH PARTIES THAT THE RATE OF CONSTRUCTION WILL REMAIN SAME
IF MATERIAL PRICES INCREASES OR DECREASES TILL 5% IF CHANGES ARE MORE THAN 5% THE
RESPONSIBLE PARTY WILL TAKE CHARGE TO PAY ANOTHER.
6. ANY EXTRA OR ADDITIONAL WORK THAT IS NOT CONTAINED IN THE STRUCTURE WORK IN
PRESENT AGREEMENT OR WHICH IS OUTSIDE THE PREVIEW OF THIS AGREEMENT MAY BE
CARRIED OUT AT THE SOLE DISCRETION OF THE 1ST PARTY ON THE ASKING OF THE 2 ND PARTY
AND THE 2ND PARTY AGREES TO PAY THE 1ST PARTY AS MUTUALLY DECIDED BY THE BOTH
PARTIES.
7. THE BUILDING CONTRACTOR (1st PARTY) SHALL BE RESPONSIBLE SOLELY FOR THE COMPLIANT,
EXPENSE, LIABILITY, DAMAGES ETC. ON ACCOUNT OF THE FOLLOWING MATTERS UNDER THE
RELEVANT LAWS ENACTMENT AND THE OWNER SHALL NOT BE LIABLE FOR ANY SUCH
COMPLIANCE, EXPENSE, LIABILITY, DAMAGES UNDER ANY CIRCUMSTANCES:
a. WORKMEN'S COMPENSATION ACT, EMPLOYEES STATE INSURANCE ACT, PROVIDENT
FUND ACT, MINIMUM WAGES ACT AND PAYMENT OF WAGES ACT.
b. ANY OTHER LAW RELATING TO THE WORKERS EMPLOYED IN CONSTRUCTION
c. COMMON LAW IN RESPECT OF INJURIES, ETC. TO PERSON AND PROPERTY CAUSED DUE
TO AND ARISING OUT OF THE CARRYING OUT THE WORK UNDER THIS CONTRACT.
d. THE BUILDING CONTRACTOR SHALL INDEMNIFY AND KEEP INDEMNIFIED THE OWNER
AGAINST ALL LOSSES, DAMAGES, FINES, PROSECUTIONS, LIABILITIES THAT MAY ARISE
OR ACCRUE AGAINST THE OWNER FROM THE CONTRACTOR'S FAILURE TO ADHERE TO
ALL STATUTORY OBLIGATIONS
8. THE BUILDING CONTRACTOR SHALL NOT BE LIABLE FOR ANY ISSUE REGARDING NOIDA
AUTHORITY, U.P. POLICE, ELECTRICAL DEPARTMENT, WATER SUPPLY DEPARTMENT, SEWER
DEPARTMENT OR ANY CHARGES ARISE OR ACCRUE FROM THE STATE/CENTRAL GOVERNMENT.
FOUNDATION:
1. All excavation, column & their footing casting, brickwork at all depths and dimensions are as
per drawings and specifications in consent with Architect.
2. Foundation Depth should be maximum 5 Feet from the existing level in consent with
Architect Approval.
3. Excavation for column and their footing Casting as well as filling of earth (mud) shall be
included.
4. Anti-termite treatment injecting chemical emulsion for pre-constructional treatment and
creating a chemical barrier of CHARCOAL BELT under all around the column pits, wall
trenches, top surface of plinth filling, junction of wall and floor along with outer periphery at
plinth level.
5. PCC on footing will be in the ratio of 1:4:8 (1 cement: 4 sand: 8 aggregate)
6. Column and their footing will be casted as per drawings and specifications
7. Brickwork in footing as per drawings and specifications.
8. Brickwork will be done only on outer 4 walls
9. Plinth beam casting as per drawings and specifications
10. Curing shall be done for 15 days thrice a day.
STILT FLOOR:
7. 3” thick RCC slab in parking area ( 8mm steel bar with 12” x 12” spacing).
Shuttering:
✔ Column casting with MS plate or wooden ply with ½” thickness will be used for support
✔ Shuttering on beams & slabs will be of MS plate or wooden ply with ½” thickness will be
used for support
✔ Shuttering shall be opened after 15 Days
Electricals:
1. All MS (Heavy Duty Metal Modular – Powder Coated) box for switches
2. All 1” pipe for wall conducting with clamping AKG, Norpack, Setia, Polypack – Medium
Quality
3. MS (Heavy Duty Metal – Powder Coated) concealed box, fan box and 1” AKG Heavy pipe
will be provided in the Slab
4. 1-1/4” pipe AKG – Heavy Quality will be provided for TV cable, CCTV/Surveillance and
WIFI
5. MCB & MCB Boxes will be provided by Owner
6. All fixtures will be provided by Owner
7. All Earthing & Panels will be provided by Owner
Plumbing:
1. Sewerage line from 1st main hole to last main hole will be of 150mm diameter Brand
Supreme or Prakash ISI pipes and fitting 6 kg pressure.
2. Sewer connection will be done by Owner itself.
3. Provision for tap in both Front area and in Rear area
4. RWP line of 110 mm of Supreme or Prakash ISI will be provided
5. Rainwater harvesting line pit and boring will be extra as per actual
6. Separate water line for each floor.
1. Brickwork in superstructure partition and main outer walls in 9” and 4.5” walls as per the
drawings and specifications
2. RCC work in column, beams and roof slab as per the drawings and specifications
3. RCC work in staircases & lifts of any shape and design as per drawings and specifications
4. Plaster shall be done in three ratios:
a. Cement plaster on ceiling will be in ratio of 1:1:2 (1 cement: 1 stone dust: 2 fine sand)
b. Cement plaster on internal walls will be in ratio of 1:2:3 (1 cement: 2 stone dust: 3
fine sand)
c. Cement plaster on external walls will be in ratio of 1:2:2 (1 cement: 2 stone dust: 2
fine sand)
5. Brick blast will be provided in all floor and balconies
6. PCC work will be provided only in all bathrooms.
7. Waterproofing in sunken area for kitchen and bathroom with Dr Fixit URP in two coating, After
that, ½” plaster with LW+
8. Khangar filling in bathroom, kitchen sunken area after completing PVC piping( only in sunken
area)
9. Brick wall in balconies will be provided as per drawing and specifications
10. Curing shall be done for 15 days thrice a day.
11. Maximum height between slab to slab will be either 10’-0” or 10’-6”.
Shuttering:
✔ Column casting with MS plate or wooden ply with ½” thickness will be used for support
✔ Shuttering on beams will be of wooden ply with ½” thickness will be used for support
✔ Shuttering on slab will be of wooden ply with ½” thickness will be used for support
✔ Shuttering shall be opened after 15 days.
✔ If wooden ply is used for shuttering of slab then plaster will not be provided on ceiling.
Electricals:
1. All MS (Heavy Duty Metal Modular – Powder Coated) box for switches

1. All bathroom line 20mm fittings CPVC pipe of Supreme or Prakash ISI water supply line will
be as per drawings and specification
2. All 110mm Supreme or Prakash ISI PVC pipe in bathrooms as per drawings and specification
3. Provision of Tap in both Front and Back Balcony as per drawing specifications
4. Plumbing Core cutting or Manual cutting will be used for all RCC floors
5. Pressure Testing should be done
TERRACE:
MUMTY:
Height of mumty will be 8'-0" or same as per the drawings and specifications attached.
OPEN AREA:
1. Electrical: -
a. All Fixtures, Earthing & panels will be provided by owner.
2. Plumbing: -
a. All fixtures, watertank & fittings will be provided by owner.
3. If any work regarding tile for terrace, mud phuska, brick coba & other treatment for heat-
proofing will be considered as extra.
4. Gate will be provided by the owner.
5. Any type of MS or SS railing or other item will be provided by the owner.
6. Parapet walls in balconies Elevation is included in Contractor part but any other
Fancy stuff and Material used will be taken care by Owner.
7. Any extra or additional work that is not contained in the structure work in the present
agreement or which is outside the preview of this agreement may be carried out at the sole
discretion of the 1st party as mutually decided by the both parties.
8. Project shall be completed within 11 months, official reasons like Covid-19, Delhi pollution etc
shall not be considered in project completion time.
9. UGT will be extra as per actual.
10. Any planter on boundary wall and terrace will be extra as per actual.
11. Any pergola, elevation pillar and beam will be extra as per actual.
12. Any work that is not mentioned will be extra as per actual.
a) RCC Work:
Grade M-20 RMC (as specified in structural drawings) – as per manual
b) Cement:
Jk Laxmi, Birla, Shree Ultra and Ultratech PPC 53 Grade Cement only
c) Reinforcement:
The reinforcement shall be TMT Steel of standard sizes and of RATHI make only.
d) Fine aggregate:
● Fine aggregate 1st Quality shall be coarse sand known as Dust of white & blue color.
● It shall be free from vegetable matter and waste material.
● Dust & Aggregate will be order from 19 No crusher from Pali
e) Coarse aggregate:
● Shall be crushed stone aggregate of bluish color and irregular shapes and sharp edges and
corners. The aggregate crushing value shall not exceed 45%.
● It shall not absorb water to gain weight more than 5% of the original sample weight after
immersion in water for 24 hours. The water content for concrete mix may be made equal to
30% of the weight of cement plus 5% of the weight of stone aggregate and stone dust.
● This shall be taken as a rule and necessary variation may be made for the required workability
of the concrete. For vibrated concrete the quantity of water obtained by this rule should be
reduced by 20%.
f) Concrete work:
All concrete work shall be mixed in a rotary mixer and shall be vibrated using 40mm and 25mm
nozzles as the specific requirement may be, however an exception may be made in the case of
very small quantities, say for columns, only for rotary mixture.
g) RCC walls:
● Shuttering used will be of waterproofing ply as specified in drawings.
● Vibrators will be used throughout with a 40mm nozzle.
● The sides of the shuttering shall be secured together with a screw fastener.
h) Columns:
● Shuttering used will be of MS plate or wooden ply with ½” thickness formwork.
● If wooden ply used capping will be done with the help of shikanja.
● Columns will not be picked more than 8-10 ft. in length in one casting as specified drawings.
i) RCC slabs:
● Good condition steel plates of size 2’x3’ would be used for the slab and MS plate or
waterproofing ply for the beam side and bottom.
● The side of beams deeper than 2 ft. shall be secured together with a screw fastener or
ghughoo.
j) Brickwork:
● Brick will be of 1st quality and should be free over-burn, cracks and vegetable matter. Can be
randomly checked by its sound.
● The brick must not absorb water and gain in weight more than 15% of the original weight
after the immersion water for 24 hours.
● All 9” and thicker brickwork shall be done with cement mortar mix of 1:6 (1 cement: 6 coarse
sand) the joints shall be cleared of excess mortar from both sides and pointing will be done
with masonry work itself.
● The brickwork shall be done in English bond with the frog facing upwards and shall not be
picked more than 12 courses in one session.
● All 4.5” thick brickwork shall be done in stretcher bond with the frog facing upwards with
cement mortar mix of 1:4 (1 cement: 4 coarse sand) with hoop 6-8mm reinforcement at every
third embedded in cement mortar.
● Brickwork with grooves on one one side only.
k) Plaster:
● Plaster on wall shall be done with a 1:4 & 1:5 ratios of cement and coarse sand
● Plaster thickness shall not be exceeding 15mm in any place in one layer
● All joints where RCC work is coming adjacent to brickwork shall be covered with
Chicken Wire mesh along the entire length of joint before plastering
● Grooves should be made in External Plaster (Vacant Plot side) between RCC and Brickwork
m) Anti-termite treatment:
- By spray
- Lintel/Trishul or any other equivalent brand will be used
n) Woodwork:
● Doors-
o Door frames with lintel height 8'-0" in good quality ivory teak wood section (6”x2.5”)
+ gola as per designed as mentioned in drawings (free from knots)
o UPVC to be provided by client
● Windows-
o Window frame in ivory teak wood section (6”x2.5”) as required + gola/galta as per
designed as mentioned in drawings (free from knots)
o (white/wood) finish UPVC/aluminums sliding windows make fenestra or decided by
the client/architect to be provided by the owner.
NOTE: 210/- per running foot will be deducted of Teak wood in case owner prefer UPVC
over wood
Contractor Scope: Only frames will be provided by contractor all internal door & window and external
doors will be extra.
BILLS: -
● All electrical and water bills as well as fines implied by Police, Authority & any other charges
by government to be paid by owner.
● Any unlawful activity done by contractor or Labor then the fine will be paid by contractor only.
WORK INSPECTION: -
Contractor accepts that he shall offer the works at any time for the inspection by the client, any
defect shall be rectified as per terms of contract and contractor will bear the cost of it.
NOTE: Any civil work done in structure apart from the given drawings will be given extra as
per item basis.
PAYMENT PLAN
Advance - 10% approx. of the Total Project Cost on signing of the Contract.
STILT FLOOR
Electrical, Plumbing Conducting and Door Frame and Inner Plaster: 15% of Respective Floor
2. Ground, First, Second floor and Mumty or any other construction on terrace - RS
1100 / SQFT
3. Stilt Floor -
a. Covered area: RS 1100 / SQFT
b. Parking area: RS 880 / SQFT (80% of covered)
c. Front & Rear setbacks: RS 550 / SQFT (50% of covered area)
Note – All area will be calculated based on final Drawings and Architect
Approval.
