    CONTRACT DRT 32 J1 /03/20016 – MANAGEMENT & EXECUTION OF ROUTINE ROAD MAINTENANCE


    CONTRACT- VEREENIGING REGION OF GAUTENG PROVINCE

    Subject: Commencement of Works at Moshoeshoe Road

    1. The Engineer’s email sent on 4 May, 2019 with the subject line “Commencement of Works on
    Moshoeshoe Road, Sebokeng” has reference.
    2. The Contractor hereby confirms the Engineers instruction in terms of Sub-Clause 3.3 to remobilize
    and continue with the works at Moshoeshoe Road.
    3. Furthermore, since receiving the Engineer’s instruction, the Contractor has been preparing for the
    remobilization of resources to Moshoeshoe Road as fast as is practicable.
    4. As the works are of a specialized nature, the Contractor intends to continue the works with
    specialized BSM Subcontractor, Kwamhlanga.
    5. Due to many and various factors relating to both the project and the general state of the
    construction industry, the aforementioned Subcontractor’s remobilization would be greatly
    expedited by entering into a cessionary agreement with the Contractor and the Employer.
    6. The Contractor therefore requests that payment of certified works due to the Subcontractor be
    ceded to the Subcontractor through the Employer.

    7. As time is of the essence and the process of finalizing a cessionary agreement does take time, the
    Contractor requests the Employer’s formal confirmation of agreement to cede payments in the
    interim. The details of the cession agreement shall thereafter be finalized during the execution of
    the Moshoeshoe Road works.
    8. We await the Engineer and the Employer’s response in this regard and shall continue to make the
    arrangements for remobilization to Moshoeshoe Road.
