REJOINDER-AFFIDAVIT
I, RIZALINDA LUMIBAO, Filipino, of legal age, married, with residence

and postal address at Lot 21, Blk. 16, Lakewood Subdivision, Sumacab Este,
Cabanatuan City, Nueva Ecija, after being sworn to in accordance with law, hereby
depose and state that:
1. We vehemently deny the allegations of the complainants that we have not

settled our debt yet with their late father. It is very clear from the electric
document—the text message—that we attached in our counter-affidavit
that the deceased acknowledged our payment. We do not have any
connection with the deceased other than creditor-debtor relation. We
were not friends, but mere acquaintances.
2. We strongly deny the concocted theory of the complainants that a

romantic or sexual relationship ensued from our purely transactional
dealings. This is a postscript. It more likely dawned on them that the
complaint they lodged before this Honorable Office failed to state a
compelling reason which would impel a person to take another man’s
life. We settled our debt in full. To kill a good man who entrusted us
P30,000.00 is purely out of the question.
3. On this day and age, it is a judicial notice that technically endowed

people could access an innocent person’s online account, and assume the
personality of the hapless victim. The compromised account may appear
to be that of its real owner, but the truth is, it is not so.
4. Paragraph 4 of the Complainant’s Reply is also denied for being a

misplaced conclusion. The complainants argue that we tampered with
their late father’s mobile phone since the structure of the message that we
received differ from how their father usually type and abbreviate some

words. This line of thought borders to incredulity. They are drawing a
picture of us, using their father’s phone which is always in the
possession of the latter, minutes after the real culprits heartlessly
extinguished the life of their father.
5. Paragraph 8 states that Jeffrey is not competent enough to claim that the
alleged dying declaration of the deceased is tainted with fraud. This
argument is again misplaced. Jeffrey can strongly say that the deceased
while on the verge of death cannot utter his name as “Bunag” since he
was not called as one in the area of Cabiao. He is always called as Jeff,
and not Bunag. The bereaved family, however, call him Bunag.
6. Brutally extinguishing the life of the person who granted your

P30,000.00 loan, after you have settled your obligation is not in
accordance with our human experience. We thank those who salvage us
from our monetary obligations. If the loan is accompanied with usurious
interest, the worst we do is stay away from the creditors’ web—we do not
gun them down to death.
7. It is the respondents’ strong view that the sexual relationship which the
complainants allege in their Reply is a postscript they schemed to draw a
picture of an angry respondent who felt betrayed by his partner, and
goaded the latter to kill. This is not the fact. Jeffrey Bunag is not
betrayed at all, and the couple maintains their cordial relationship despite

9. We are executing this affidavit based on our personal knowledge and

based on authentic records to attest to the truth of the foregoing.
