    Subject: Interim Financial Claim No-1 due to project suspension

    Dear Sirs,

    Enclosed herewith please find our document entitled interim submission of


    financial compensation claim no-1 of the project under caption.
    This submission comprises claims on delays and associated financial losses
    incurred upon the Contractor from commencement of the contract until 31 st
    January 2014 while executing the project under caption.
    As you are quite aware, around 75% of the project is still suspended due to
    ROW and design changes. Consequently, we have already requested fixing
    of a new applicable rate for the already suspended section as the old rates
    are no more applicable at this stage and such suspension of major works
    are tantamount to abandonment of the contract by default of the Employer
    pursuant to clause 40(2) of the General Conditions.
    Our intents of claim were already served in a series of correspondences.
    In light of the foregoing and the power vested upon the Engineer under the
    contract therefore, we would like the Engineer to:-
    1. Carry out the analysis of our financial compensation independently
    and impartially; and
    2. Determine the amount of compensation and notify both parties
    accordingly.
    Finally, without prejudice to our right for additional compensation in
    accordance with this interim submission following your advice however, we
    kindly request the Employer once again by a copy of this letter to settle
    existing ROW problems, finalize the design and provide us work order for
    further price negotiation or otherwise let us know any final decision so as to
    enable us fully close the project and assign our resource to other projects.
