(The following proceedings were held on Wednesday,

THE COURT: We’ll go on the record in Case No.

6 2222—CR01 054, styled State of Missouri versus Daniel Riley.

7 This is Mr. Riley’s first appearance in this case number.

8 Mr. Riley is incarcerated. He is present by video.

9 The assistant circuit attorney is present here in 1 0

the courtroom with me. Mr. Riley’s attorney is on the

11 video slash audio so that we can hear him, although

we 1 2 can’t see him.

13 First of all, Mr. Diemer, can we waive any formal

14 reading of the charging document, enter a plea of not

15 guilty for Mr. Riley?

16 MR. DIEMER: Yes, we will do that, Your Honor.


17 Thank you.

8 THE COURT: All right. Mr. Riley was previously

19 charged with these crimes. The case was dismissed, and

20 it's been refiled. This is now the refile.

So what does the State propose we do with

22 Mr. Riley this time around?

23 MR. PHIPPS: Your Honor, I believe we actually

24 reached a consent with defense to have the defendant

25 released on his own recognizance, with the added conditions

1 of GPS and house arrest. If you’re not inclined to

accept that deal, we can enter a full argument on the

hearing,

3 Your Honor.

4 THE COURT: Mr. Diemer, is that agreeable?

MR. DIEMER: judge, I understand that was the case

MR. DIEMER: We will accept the conditions, Your

15 Honor. Can you hear me?


16 THE COURT: I can now.

17 MR. DIEMER: judge, could you hear me? I said we

18 would accept those conditions.

19 THE COURT: I can hear you now.


20 MR. DIEMER: Okay.

21 THE COURT: Are we looking for 24/ 7 GPS

22 monitoring?

23 MR. PHIPPS: Standard GPS is fine, judge.

24 THE COURT: Standard is fine. Okay. We will

25 waive costs.

THE COURT: All right. We’ve had some

3 off—the—record discussion, and I believe that we have

4 reached an agreement for Mr. Riley to releas e him on his

own recognizance, on the condition that he will be on house


6 arrest and he will have standard GPS electronic monitoring.

7 The Court will waive the costs for that.

8 Is there —— is that the agreement, Mr. Phipps?

9 MR. PHIPPS: Yes, Your Honor.

10 THE COURT: And, Mr. Diemer, is that your


11 understanding of the agreement?

12 MR. DIEMER: It is, Your Honor. Thank you.

13 THE COURT: And, Mr. Riley, are you in agreement

14 with that? We’ll release you on your own recognizance

15 under house arrest with GPS.

16 THE DEFENDANT: Yes, Your Honor.

17 THE COURT: All right. Mr. Riley, I’ll remind you

18 that if you violate the conditions of your bond, if the GPS


19 is constantly dis abled or you violate the house arrest, or

20 you pick up other crimes, for that matter, we can revoke


21 your bond, issue a warrant for your arrest and bring you

22 back here. So you need to behave in the meantime.

23 Do you understand that, sir?


24 THE DEFENDANT: Yes, Your Honor.

25 THE COURT: All right. We’re going to set this

matter for September the 19th at 9:00 a.m. in Division 26.

And I think that takes care of Mr. Riley. So that will be

3 the end of the hearing in that matter.
