11 I, Matthew T. Powers, hereby declare and state as follows:


12 1. I am counsel of the law firm of Sidley Austin LLP, counsel of record for plaintiff
13 Rambus, Inc. (“Rambus”) in the above-entitled matter. I make this declaration of my own personal
14 knowledge and, if called and sworn as a witness, I could and would testify competently to the
15 matters set forth herein.
16 2. Attached hereto as Exhibit 1 is a true copy of the parties’ Stipulation & Proposed
17 Order Extending Time for Certain Discovery, as filed on September 16, 2008. Pursuant to Ex. 1, the
18 parties stipulated that “the 30(b)(6) deposition of Nanya Technology Corporation may be taken on
19 September 8 and 9, 2008.” Ex. 1, at p. 1:9-10. Additionally, the parties stipulated that each party
20 “shall have seven (7) court days from the date on which a deposition conducted pursuant to [the]
21 stipulation is conducted to file a motion to compel on testimony objections and documents
22 discovered in that deposition.” Ex. 1, at p. 2:26-28. The proposed Order was signed by the Court on
23 September 29, 2008.
24 3. Attached hereto as Exhibit 2 is a true copy of the Order Granting In Part and Denying
25 In Part Nanya’s Motion to Compel Further Responses to Certain Licensing-Related Discovery
26 Requests, entered on August 12, 1008. Pursuant to the Court’s Order at p. 10:18-23 of Exhibit 2,
27 “Rambus shall provide Nanya with any amendments to each license agreement entered into by
28 Rambus and any other party at any time from January 1, 1999 to the present.” Additionally at p.

1 10:24-11:3 of Exhibit 2, “Rambus shall produce to Nanya documents sufficient to show, on a per

2 quarter basis, the number of units of each licensed product for which Rambus received, or was

3 entitled to receive, royalties or other payments pursuant to each of the SDRAM, DDR SDRAM,

4 RDRAM and/or XDR licenses entered into by Rambus and any other party at any time from January

5 1, 1999 to the present.”

6 4. Attached hereto as Exhibit 3, and submitted under seal, is a true copy of the Rebuttal

7 Damages Report of Robert E. Hall on Behalf of Nanya Technology Corporation and Nanya

8 Technology Corporation USA.
