ﺗﻌﻤﻞ ﺍﳉﻬﺎﺕ ﺍﻟﺮﻗﺎﺑﻴﺔ ﻋﻠﻰ ﺍﻟﻐﺬﺍﺀ ﰲ ﺩﻭﻝ ﳎﻠﺲ ﺍﻟﺘﻌﺎﻭﻥ ﻋﻠﻰ ﺍﻟﺘﺄﻛﺪ ﻣﻦ ﺳﻼﻣﺔ ﻭﺻﻼﺣﻴﺔ ﻭﺟﻮﺩﺓ ﺍﻷﻏﺬﻳﺔ ﺍﻟﱵ ﺗﺼﻞ ﻟﻠﻤﺴﺘﻬﻠﻚ .ﻭﳑﺎ ﺗﻘﻮﻡ ﺑﻪ ﺍﳉﻬﺎﺕ ﺍﳌﺨﺘﺼﺔ ﰲ ﻫﺬﺍ ﺍﻹﻃﺎﺭ
ﻟﺘﺤﻘﻴﻖ ﺫﻟﻚ ﺍﳍﺪﻑ ﺍﻟﺘﺄﻛﺪ ﻣﻦ ﺃﻥ ﲨﻴﻊ ﺍﳌﻮﺍﺩ ﺍﻟﻐﺬﺍﺋﻴﺔ ﺍﻟﻮﺍﺭﺩﺓ ﻟﺪﻭﻝ ﺍﻠﺲ ﲢﻘﻖ ﻣﺘﻄﻠﺒﺎﺕ ﺍﳉﻮﺩﺓ ﻭﺍﻟﺴﻼﻣﺔ ﻭﻣﻄﺎﺑﻘﺘﻬﺎ ﻟﻠﻤﻮﺍﺻﻔﺎﺕ ﺍﻟﻘﻴﺎﺳﻴﺔ ﺍﳋﻠﻴﺠﻴﺔ ﺍﳌﻌﺘﻤﺪﺓ ﻭﻣﺼﺤﻮﺑﺔ ﺑﺎﻟﺸﻬﺎﺩﺍﺕ
ﺍﻟﺼﺤﻴﺔ ﺍﻟﻼﺯﻣﺔ .ﻭﺣﻴﺚ ﺃﻥ ﻫﻨﺎﻙ ﺗﻮﺟﻪ ﺟﺎﺩ ﳓﻮ ﺗﻮﺣﻴﺪ ﺍﳌﻮﺍﺻﻔﺎﺕ ﺍﻟﻐﺬﺍﺋﻴﺔ ﺑﺪﻭﻝ ﺍﻠﺲ ﺗﺄﰐ ﺍﳋﻄﻮﺓ ﺍﻟﺘﺎﻟﻴﺔ ﻭﻫﻲ ﺗﻮﺣﻴﺪ ﺇﺟﺮﺍﺀﺍﺕ ﺍﻟﺮﻗﺎﺑﺔ ﻋﻠﻰ ﻭﺍﺭﺩﺍﺕ ﺍﻟﺴﻠﻊ ﺍﻟﻐﺬﺍﺋﻴﺔ ﻟﺪﻭﻝ ﺍﻠﺲ.
ﳎﺎﻝ ﺍﻟﺘﻄﺒﻴﻖ :
ﻳﻌﲎ ﻫﺬﺍ ﺍﻟﺪﻟﻴﻞ ﺑﻜﻞ ﺍﻹﺟﺮﺍﺀﺍﺕ ﻭﺍﳌﻌﻠﻮﻣﺎﺕ ﺍﻟﻼﺯﻣﺔ ﻟﻠﺮﻗﺎﺑﺔ ﻋﻠﻰ ﲨﻴﻊ ﺍﻷﻏﺬﻳﺔ ﻭﺍﳌﻀﺎﻓﺎﺕ ﺍﻟﻐﺬﺍﺋﻴﺔ ﻭﻣﻮﺍﺩ ﺗﻌﺒﺌﺔ ﻭﺗﻐﻠﻴﻒ ﺍﻷﻏﺬﻳﺔ ﻣﻦ ﻗﺒﻞ ﺍﻷﺟﻬﺰﺓ ﺍﳌﻌﻨﻴﺔ ﰲ ﻛﻞ ﺩﻭﻟﺔ ﻣﻦ ﺩﻭﻝ
ﺍﻠﺲ ﺧﻼﻝ ﻣﻨﺎﻓﺬﻫﺎ ﺍﳊﺪﻭﺩﻳﺔ ﲡﺎﻩ ﺍﻟﻌﺎﱂ ﺍﳋﺎﺭﺟﻲ )ﺑﺮﻳﺔ ،ﲝﺮﻳﺔ ،ﺟﻮﻳﺔ( ﻛﻤﺎ ﻭﺗﺸﻤﻞ ﺍﻷﻏﺬﻳﺔ ﺍﻟﱵ ﺗﺴﺘﻮﺭﺩ ﻷﻏﺮﺍﺽ ﺍﻻﺳﺘﺨﺪﺍﻡ ﺍﻟﺸﺨﺼﻲ ﺃﻭ ﻛﻌﻴﻨﺎﺕ ﲡﺎﺭﻳﺔ ﺣﺴﺐ ﺁﻟﻴﺘﻬﺎ ﺍﳋﺎﺻﺔ.
ﻭﻗﺪ ﻗﺎﻣﺖ ﳉﻨﺔ ﺳﻼﻣﺔ ﺍﻷﻏﺬﻳﺔ ﻟﺪﻭﻝ ﳎﻠﺲ ﺍﻟﺘﻌﺎﻭﻥ ﺑﺈﻋﺪﺍﺩ ﻫﺬﺍ ﺍﻟﺪﻟﻴﻞ ﺑﻨﺎ ًﺀ ﻋﻠﻰ ﻃﻠﺐ ﻣﻦ ﺍﻷﻣﺎﻧﺔ ﺍﻟﻌﺎﻣﺔ ﻟﻠﻤﺠﻠﺲ ،ﻭﺍﳌﺒﲏ ﻋﻠﻰ ﺗﻮﺻﻴﺔ ﻣﻦ ﳉﻨﺔ ﺍﻻﲢﺎﺩ ﺍﳉﻤﺮﻛﻲ ﻟﺪﻭﻝ ﺍﻠﺲ-
ﺍﻟﻘﺎﺿﻴﺔ ﺑﺘﻮﺣﻴﺪ ﺍﻹﺟﺮﺍﺀﺍﺕ ﻭﺍﻟﻘﻴﻮﺩ ﺍﻟﺼﺤﻴﺔ ﺍﳋﺎﺻﺔ ﺑﺎﻟﺴﻠﻊ ﺍﻟﻐﺬﺍﺋﻴﺔ ﺍﳌﺴﺘﻮﺭﺩﺓ ﻋﱪ ﻣﻨﺎﻓﺬ ﺩﻭﻝ ﺍﻠﺲ ﺁﺧﺬﻳﻦ ﺑﻌﲔ ﺍﻻﻋﺘﺒﺎﺭ ﻣﺒﺪﺃ ﺍﳌﻨﻔﺬ ﺍﻟﻮﺍﺣﺪ ﻟﺪﻭﻝ ﺍﻠﺲ.
ﻳﺘﻢ ﺗﻄﺒﻴﻖ ﻫﺬﺍ ﺍﻟﺪﻟﻴﻞ ﺑﻌﺪ ﻭﺿﻊ ﺍﻵﻟﻴﺔ ﺍﳌﻨﺎﺳﺒﺔ ﻟﻌﻤﻠﻴﺔ ﺍﻟﺘﻄﺒﻴﻖ ﻭﺍﻟﱵ ﺳﻮﻑ ﻳﺘﻔﻖ ﻋﻠﻴﻬﺎ ﺑﲔ ﺃﻋﻀﺎﺀ ﳉﻨﺔ ﺳﻼﻣﺔ ﺍﻷﻏﺬﻳﺔ ﺑﺪﻭﻝ ﳎﻠﺲ ﺍﻟﺘﻌﺎﻭﻥ.
ﻧﺘﻤﲎ ﺃﻥ ﻳﺴﻬﻢ ﻫﺬﺍ ﺍﻟﺪﻟﻴﻞ ﰲ ﺗﻮﻓﲑ ﺍﻟﻐﺬﺍﺀ ﺍﻵﻣﻦ ﻟﺸﻌﻮﺏ ﺩﻭﻝ ﺍﻠﺲ ﻭﺃﻥ ﻳﺆﺩﻱ ﺇﱃ ﺗﺴﻬﻴﻞ ﺣﺮﻛﺔ ﺍﻷﻏﺬﻳﺔ ﺑﲔ ﺩﻭﻝ ﺍﻠﺲ ﻣﻊ ﺑﻌﻀﻬﺎ ﻭﺑﻴﻨﻬﺎ ﻭﺑﲔ ﺷﺮﻛﺎﺋﻬﺎ
ﺍﻟﺘﺠﺎﺭﻳﲔ.

ﻭﺑﺎﷲ ﺍﻟﺘﻮﻓﻴﻖ
ﺍﻟﺘﻌﺎﺭﻳﻒ:
ﻳﻜﻮﻥ ﻟﻸﻟﻔﺎﻅ ﻭﺍﻟﻌﺒﺎﺭﺍﺕ ﺍﻟﺘﺎﻟﻴﺔ ﺍﳌﻌﺎﱐ ﺍﳌﺒﻴﻨﺔ ﺃﻣﺎﻡ ﻛﻞ ﻣﻨﻬﺎ ﻣﺎ ﱂ ﻳﻘﺘﺾ ﺍﻟﺴﻴﺎﻕ ﻏﲑ ﺫﻟﻚ:
ﻛﻞ ﻣﺎ ﻫﻮ ﻣﻌﺪ ﻟﻼﺳﺘﻬﻼﻙ ﺍﻵﺩﻣﻲ ﻛﻄﻌﺎﻡ ﺃﻭ ﺷﺮﺍﺏ ﺳﻮﺍﺀً ﻛﺎﻥ ﻃﺎﺯﺟـﹰﺎ ﺍﻟﻐـــﺬﺍﺀ:
ﺃﻭ ﻣﺼﻨﻌﹰﺎ ﺃﻭ ﺷﺒﻪ ﻣﺼﻨﻊ ﺃﻭ ﺧﺎﻡ ،ﻛﻤﺎ ﻳﺸﻤﻞ ﺍﻟﻠﺒﺎﻥ ﻭﺃﻱ ﻣﺎﺩﺓ ﺗﺪﺧﻞ ﰲ
ﺗﺼﻨﻴﻊ ﺃﻭ ﲢﻀﲑ ﺃﻭ ﻣﻌﺎﳉﺔ ﺍﻟﻐﺬﺍﺀ.
ﺑﻴﺎﻥ ﺃﻭ ﺇﻳﻀﺎﺡ ﺃﻭ ﻋﻼﻣﺔ ﺃﻭ ﻣﺎﺩﺓ ﻭﺻﻔﻴﺔ ﺃﺧﺮﻯ ﺳﻮﺍﺀ ﻣﺼﻮﺭﺓ ﺃﻭ ﻣﻜﺘﻮﺑـﺔ ﺑﻄﺎﻗﺔ ﺍﳌﻮﺍﺩ ﺍﻟﻐﺬﺍﺋﻴﺔ:
ﺃﻭ ﻣﻄﺒﻮﻋﺔ ﺃﻭ ﻣﻠﺼﻘﺔ ﺃﻭ ﳏﻔﻮﺭﺓ ﺃﻭ ﺑﺎﺭﺯﺓ ﻭﻣﺘﺼﻠﺔ ﺍﺗﺼﺎﻻ ﺛﺎﺑﺘﹰﺎ ﺑﻌﺒﻮﺓ ﺍﳌﺎﺩﺓ
ﺍﻟﻐﺬﺍﺋﻴﺔ ﻭﺗﻀﻌﻬﺎ ﺍﳉﻬﺔ ﺍﳌﺼﻨﻌﺔ ﲝﻴﺚ ﻻ ﳝﻜﻦ ﻧﺰﻋﻬﺎ ﺃﻭ ﺗﻐﻴﲑﻫﺎ ،ﻭﺗﻜـﻮﻥ
ﻃﺒﻘﹰﺎ ﻟﻠﻤﻮﺍﺻﻔﺔ ﺍﻟﻘﻴﺎﺳﻴﺔ ﺍﳋﻠﻴﺠﻴﺔ ﺍﳌﻌﺘﻤﺪﺓ.
ﺃﻱ ﻣﻨﻔﺬ ﲨﺮﻛﻲ ﺑﺮﻱ ﺃﻭ ﲝﺮﻱ ﺃﻭ ﺟﻮﻱ ﻟﺪﻭﻝ ﺍﻠﺲ ﻟﻪ ﺍﺭﺗﺒﺎﻁ ﺑﺎﻟ ﻌﺎﱂ ﻣﻨﻔﺬ ﺍﻟﺪﺧﻮﻝ:
ﺍﳋﺎﺭﺟﻲ ﻭﻳﻌﺘﱪ ﻧﻘﻄﺔ ﺩﺧﻮﻝ ﻟﻠﺒﻀﺎﺋﻊ ﺍﳌﺴﺘﻮﺭﺩﺓ ﻷﻱ ﺩﻭﻟﺔ ﻋﻀﻮ ﻭﺍﻟـﺬﻱ
ﳚﺐ ﺃﻥ ﺗﺘﻮﺍﻓﺮ ﻓﻴﻪ ﻧﻘﻄﺔ ﳐﺘﺼﺔ ﻟﻠﺘﻔﺘﻴﺶ ﺍﻟﻐﺬﺍﺋﻲ.
ﺑﻴﺎﻥ ﺍﻟﺒﻀﺎﻋﺔ ﺃﻭ ﺍﻹﻗﺮﺍﺭ ﺍﻟﺬﻱ ﻳﻘﺪﻣﻪ ﺻﺎﺣﺒﻬﺎ ﺃﻭ ﻣﻦ ﻳﻘﻮﻡ ﻣﻘﺎﻣﻪ ،ﺍﳌﺘﻀﻤﻦ ﺑﻴﺎﻥ ﺍﻟﺪﺧﻮﻝ
ﲢﺪﻳﺪ ﺍﻟﻌﻨﺎﺻﺮ ﺍﳌﻤﻴﺰﺓ ﻟﺘﻠﻚ ﺍﻟﺒﻀﺎﻋﺔ ﺍﳌﺼﺮﺡ ﻋﻨﻬﺎ ﻭﻛﻤﻴﺎﺎ ﺑﺎﻟﺘﻔﺼﻴﻞ ﻭﻓﻖ )ﺍﻟﺒﻴﺎﻥ ﺍﳉﻤﺮﻛﻲ(:
ﺃﺣﻜﺎﻡ ﻫﺬﺍ ﺍﻟﻨﻈﺎﻡ “ ﺍﻟﻘﺎﻧﻮﻥ”.
ﺍﳌﺴﺘﻨﺪ ﺍﻟﺬﻱ ﳚﻴﺰ ﺍﺳﺘﲑﺍﺩ ﺍﳌﻮﺍﺩ ﺍﻟﻐﺬﺍﺋﻴﺔ ) ﺳﺠﻞ ﲡﺎﺭﻱ ﺃﻭ ﺗﺮﺧﻴﺺ( ﺇﱃ ﺇﺫﻥ ﺍﻻﺳﺘﲑﺍﺩ:
ﺩﻭﻝ ﺍﻠﺲ ﻭﻳﺼﺪﺭ ﻋﻦ ﺍﳉﻬﺔ ﺍﳌﺨﺘﺼﺔ.
ﺍﻟﻜﻤﻴﺔ ﺍﳌﺸﺤﻮﻧﺔ ﻣﻦ ﺍﻟﻐﺬﺍﺀ ﳌﺴﺘﻮﺭﺩ ﻭﺍﺣﺪ ﻭ ﺗﻀﻢ ﺇﺭﺳﺎﻟﻴﺔ ﺃﻭ ﺃﻛﺜﺮ ﻣﻦ ﺍﻟﺸﺤﻨﺔ:
ﻏﺬﺍﺀ ﻣﻌﲔ ﻭﻣﺴﺘﻮﺭﺩﺓ ﰲ ﻧﻔﺲ ﺍﻟﻮﻗﺖ ﻭﻣﻮﺻﻮﻓﺔ ﻛﻠﻬﺎ ﺑﻨﻔﺲ ﺍﻟﻌﺒـﺎﺭﺓ ﰲ
ﺑﻴﺎﻥ ﻭﺍﺣﺪ.
ﻛﻤﻴﺔ ﻣﻦ ﻏﺬﺍﺀ ﻣﻌﲔ ﺗﻀﻢ ﺩﻓﻌﺔ ﻭﺍﺣﺪﺓ ﺃﻭ ﺃﻛﺜﺮ ﻣﻦ ﻏﺬﺍﺀ ﻣﻌﲔ ﳌﺴـﺘﻮﺭﺩ ﺍﻹﺭﺳﺎﻟﻴﺔ:
ﻭﺍﺣﺪ ﺗﺼﻞ ﰲ ﻧﻔﺲ ﺍﻟﻮﻗﺖ ﻭﻣﻮﺻﻮﻓﺔ ﻛﻠﻬﺎ ﺑﻨﻔﺲ ﺍﻟﻮﺻـﻒ ﻭﰲ ﺑﻴـﺎﻥ
ﻭﺍﺣﺪ.
ﻛﻤﻴﺔ ﻣﻦ ﻏﺬﺍﺀ ﻣﻌﲔ ﻣﺼﻨﻊ ﺃﻭ ﳏﻀﺮ ﺃﻭ ﻣﻌﺒﺄ ﻭﻓﻖ ﻃﺮﻳﻘﺔ ﳏﺪﺩﺓ ﻭﳝﻜﻦ ﺃﻥ ﺍﻟﺪﻓﻌﺔ:
ﻳﺸﺘﻤﻞ ﻋﻠﻰ ﺗﺸﻐﻴﻠﻪ ﺃﻭ ﺃﻛﺜﺮ.
ﻛﻤﻴﺔ ﻣﻦ ﻏﺬﺍﺀ ﻣﻌﲔ ﺣﻀﺮ ﺃﻭ ﻋﺒﺊ ﲢﺖ ﻧﻔﺲ ﺍﻟﻈﺮﻭﻑ ﲤﺎﻣﺎ ﺧﻼﻝ ﻓﺘﺮﺓ ﺍﻟﺘﺸﻐﻴﻠﻪ:
ﺯﻣﻨﻴﺔ ﻻ ﺗﺰﻳﺪ ﻋﻦ 24ﺳﺎﻋﺔ.
ﻣﺴﺘﻨﺪ ﳚﻴﺰ ﻧﻘﻞ ﺍﻟﺒﻀﺎﺋﻊ ﻣﻦ ﻣﻨﻔﺬ ﺍﻟﺪﺧﻮﻝ ﺇﱃ ﻣﻨﻄﻘﺔ ﺍﻟﺘﻔﺘﻴـﺶ ﺍﻟﻐﺬﺍ ﺋﻲ ﺇﺫﻥ ﺍﻟﺘﺴﻠﻴﻢ:

ﺇﺟﺮﺍﺀ ﳚﻴﺰ ﻟﻠﻤﺴﺘﻮﺭﺩ ﻧﻘﻞ ﺍﻟﺒﻀﺎﺋﻊ ﻣﻦ ﻣﻨﻔﺬ ﺍﻟﺪﺧﻮﻝ ﺇﱃ ﻣﺴﺘﻮﺩﻋﻪ ﺍﳋﺎﺹ، ﺍﻟﻔﺴﺢ )ﺍﻹﻓﺮﺍﺝ( ﺍﳌﺆﻗﺖ:
