AFFIDAVIT
I, MARLON A. MALIG, of legal age, married, Filipino citizen and a resident of
Barangay Santiago, Concepcion, Tarlac, after having been sworn to in accordance with
law, hereby depose and state that:

1. I am presently employed at the Concepcion Water District with office address


at Barangay San Jose, Concepcion, Tarlac, occupying the position of Senior
Water Maintenance A;

2. On June 14, 2023, I drove an Isuzu Elf with Plate No. SGZ 591, one of the
service vehicles of the Concepcion Water District to conduct field work with
my co-employees Dennis B. David and Carlo C. Manalo;

3. On the same date at around 3:20 o’clock in the afternoon after our field work,
my co-employees and I arrived at the vicinity of the Concepcion Water District
and I parked the aforesaid vehicle at the designated parking area;

4. My co-employees stayed inside the vehicle to log the maintenance order


reports.

5. However, while inside the truck, my co-employees heard a spark and a


burning smell occurred. Thus, they hurriedly got off the truck and informed me
about the incident;

6. We immediately reported the said incident to our office and also called the
Bureau of Fire Protection (BFP);

7. Unfortunately, due to the said fire, the above-mentioned vehicle sustained


serious damage and is no longer useable;

8. I am executing this affidavit to attest to the truth of the foregoing facts and for
such other legal purposes it may serve.

AFFIDAVIT OF TWO DISINTERESTED PERSONS

We, DENNIS B. DAVID and CARLO C. MANALO, both of legal age, Filipino
citizens and residents of Barangays Bantog, La Paz, Tarlac and Talimundoc San
Miguel, Concepcion, Tarlac, respectively, after having been sworn to in accordance with
law, hereby depose and state that:

1. We are both presently employed at the Concepcion Water District with office
address at Barangay San Jose, Concepcion, Tarlac occupying the position
of Plumbers C;

2. On June 14, 2023, we conducted field work with the use of an Isuzu Elf with
Plate No. SGZ 591, one of the service vehicles of the Concepcion Water
District, which was driven by our co-employee Marlon A. Malig with the
position of Senior Water Maintenance A;

3. On the same date at around 3:20 o’clock in the afternoon after our field

MEMORANDUM OF AGREEMENT
Know All Men By These Presents:

This Contract, made by and between:

SPOUSES ORLANDO G. CAGUIAT and MERLINDA D. ESTRADA, both of legal age,


Filipinos and residents of Barangay San Francisco, Concepcion, Tarlac, hereinafter referred to
as First Party;
-and-

CONCEPCION WATER DISTRICT (CWD), a government-owned and controlled


corporation established under Presidential Decree (PD) 198, as amended with principal office at
San Jose, Concepcion, Tarlac, represented by its General Manager, MR. ROLANDO T.
ESTACIO, duly authorized for this purpose under Board Resolution __________, Series of
2023, herein after referred to as Second Party;

Witnesseth:

1. That the First Party are the registered owners of a parcel of land located in the
Municipality of Concepcion, Province of Tarlac, containing an area of Fifteen Thousand
Three Hundred (15,300) square meters, more or less, and more particularly described
as follows:

TRANSFER CERTIFICATE OF TITLE NO. 043-2021006204

“A parcel of land (Lot 1-A of the subdivision plan Psd-03-


086528, being a portion of Lot 1 Pcs-4462, L.R.C. Rec.
No.), containing an area of Fifteen Thousand Three
Hundred (15,300) square meters, more or less, situated in
the Municipality of Concepcion, Province of Tarlac,.”

2. That the First Party are desirous of selling a portion or Three Hundred (300) square
meters only of the afore-described lot and the Second Party is likewise desirous of
purchasing the same;

3. That the VENDEE binds itself to pay to the VENDORS the purchase price of NINE
HUNDRED TWENTY THOUSAND PESOS (Php920,000.00) Philippine Currency,
payable in the manner described as follows:

a. The amount of FOUR HUNDRED SIXTY THOUSAND PESOS


(Php460,000.00) Philippine Currency as down payment upon the signing of
this Agreement;
b. That the balance in the amount of FOUR HUNDRED SIXTY THOUSAND
PESOS (Php460,000.00) Philippine Currency shall be paid upon releasing of
DAR Clearance of Transfer Certificate of Title No. 043-2021006204.

4. That all the expenses for the DAR Clearance of Transfer Certificate of Title No. 043-
2021006204, shall be for the account of the First Party;

5. That the payment of the real property tax, Capital Gains Tax Documentary Stamps,
Transfer Tax, survey fee up to the actual execution of the Deed of Absolute Sale and all
the other expenses for the registration of the Deed of Sale and issuance of new title shall
be for the account of the First Party;

6. That the First Party shall not offer the same for sale to other persons within the given
time for payment of the balance;

7. That the First Party agree that the possession of the subject parcel of land and all the
improvements erected thereon shall be transferred to the Second Party upon the
execution of this instrument and that they will not encumber or mortgage the subject
parcel of land or any of the improvements erected thereon to any person or judicial entity
pending the payment of the balance of the consideration;

8. That the Fisrt Party warrant that the above-described parcel of land is not tenanted and
that if any one shall claim tenancy rights over any portion of the subject parcel of land or
the whole parcel of land, the they shall be liable for all the expenses and damages that
shall be sustained and incurred by the Second Party in defending itself;

9. That if any of the Contracting parties shall violate any of the terms and conditions of this
contract, and the aggrieved party shall be compelled to file a case in court of law, then
the erring party shall be liable to pay the aggrieved party the sum of FIVE HUNDRED
THOUSAND PESOS (Php500, 000.00) as liquidated damages and/or Attorney’s fees.

there is no passage (way) going to the public highway;

4. That the said isolation of the portion of land sold unto the Second Party was not
caused by them and was the result of the subdivision made and prepared by the
First Party;

5. That herein First Party hereby recognize the need for a right of way of the Second
Party, its employees and all those acting under its orders and interest, to the
extent of five (5) meters;

6. That the First Party hereby allows the creation of a perpetual right of way which shall
be annotated at the back of their newly issued title, after segregation of the 300
square meter portion.

said parcel of land such as Barangay, Registry of Deeds (ROD), Land Bank of the Philippines,
Assessor’s Office, Philippine Statistics Authority (PSA), Department of Agrarian Reform and
Bureau of Internal Revenue (BIR);

5. To sign any paper or document to consummate the purpose for which this SPA was given.
