S.R.O No-345-Law/2018. Under the provisions of sub-section (1) of section 140 of Bangladesh Labor Act,
2006 (Act 42 of 2006), under the section 139 of the Act, the "garments" industry sector, hereinafter referred
to as the said sector, the lowest wage board of the following schedule recommended by the lowest wage
rate described in "A" and "B", subject to the following conditions, for all types of workers in that sector
hereby declares the lowest wage rate, such as : -

Conditions:

(1) The rates of this minimum wage mentioned in Schedule 'A' and 'B' shall apply to the "Garments"
industry sector of the whole country;

(2) If any additional post of the post mentioned in the schedule is added to that sector it shall be included in
the appropriate class or grade;

(3) In the grade in which the worker mentioned in the schedule is currently working in that grade, he will
have to adjust his wages by adjusting with this wage structure;

(4) With the wage of the worker received from any worker, the wages mentioned in this circular shall be
added to the new wage ;

(5) No worker shall be paid less wages or grade than the minimum wage or grade mentioned in the
schedule;

(6) Along with this notification, the owners of the said sectors will submit their wtige slips by registering
their respective wages in appropriate grade according to the posting and class department mentioned
in the schedule;

(7) If a worker of that sector is paid wages more than the minimum wages determined in accordance with
this notification, it shall not be reduced in any way;

(8) According to the agreement between the workers of the sector and the employer or the owner, a worker
can be determined and paid higher than the rate determined according to this notification;

(9) If a worker is employed in that sector through wages , he will also be considered as 'worker' under
section 2 (65) of Bangladesh Labor Act, 2006. No contractor can pay lesser wages than the minimum
wages determined by a contractor. If any worker of the sector encounters any problem with the wages
he receives from the contractor, his liability will be fully on the owner concerned ;

(10) Contractors engaged in the supply or recruitment of workers in that sector shall take similar measures
as per the provisions of section 121 , sectio 15 a d section 161 of Bangladesh Labor Act, 2006;

(11) If the owner of that sector has provided the labor-related wages to the worker, then with the notification
of this notification, the worker shall be given a fixed grade in the specified grade and pay the minimum
wage determined;

(12) In addition to the prescribed minimum wages and allowances, if any worker of that sector has continued
to have any rights, privileges and allowances, then it shall be consistently enforceable and continuous
according to the provisions of section 2 (10) , section 108 and section 336 of the Bangladesh Labor Act,
2006. ;

(13) The workers of that sector will get the benefit of increasing the annual wages of 5% (at the rate of five
per cent) of the basic wage per year, and the concerned owner will be obliged to provide it;

(14) Other allowances and benefits shall be payable in accordance with the relevant provisions of
Bangladesh Labor Act, 2006 and Bangladesh Labor Rules, 2015 in the said sector;

(15) If the owner of the sector has provided accommodation facility to a worker's family, then the house rent
allowance will not apply to the workers taking the accommodation facility;

(16) Work hours of the workers will be determined according to the relevant ru les and rules of Bangladesh
Labor Act, 2006 in Bangladesh ; And

(1 7) If any part of the above conditions is contrary to any existing law or rule, that part shall be deemed to be
canceled .

2. This notification will be effective from 17 Agrahayan 1425 BS according to 01 December 2018.
