    ORDER ON AMENDED MOTION TO DISMISS

    Before the Court is Defendants' Amended Motion to Dismiss (Doc. 17). The Court has

    considered the pending motion and finds it should be granted, in part, and denied, in part. The

    Court finds Trey Baxter and Shelia Jones are necessary parties and should be joined to the action

    within 45 days of the date of this Order. Upon their Answer, an agreed amended scheduling

    order should be presented by the parties. The Court finds it has jurisdiction over this action and

    finds Plaintiffs' claims are not foreclosed by a failure to appeal under Miss. Code §11-51-75.
