Narrator: The Cybercrime Prevention Act of 2012, officially recorded as Republic Act No.

10175
aims to address legal issues concerning online interactions and the Internet in the Philippines. Among
the cybercrime offenses included in the bill are cybersquatting, cybersex, child pornography, identity
theft, illegal access to data and libel.

The Act, divided into 31 sections split across eight chapters, criminalizes several types of offense,
including illegal access (hacking), data interference, device misuse, cybersquatting, computer-related
offenses such as computer fraud, content-related offenses such as cybersex and spam, and other
offenses. Finally, the Act includes a "catch-all" clause, making all offenses currently punishable under
the Revised Penal Code also punishable under the Act when committed using a computer, with severer
penalties than provided by the Revised Penal Code alone.

The new Act received mixed reactions from several sectors upon its enactment, particularly with how
its provisions could potentially affect freedom of expression, freedom of speech and data security in
the Philippines.

Now, we are going to present to you some scenarios for the sake of your further understanding towards
the Cybercrime law.

Scenario ONE:

Dua: Let’s go babe.

Dua: Wait beee…Let me explain!

Dua: So what now?! Are you breaking up with me?
Taro: YES! Isn’t it obvious?! Bobo!
Dua: Bobo?! Maghinay hinay ka sa mga sasabihin mo, hindi mo magugustuhan yung magagawa ko
pag ginalit moko.
Taro: Go! Do what you want. I don’t care. (Walkout)
Dua: I will post your nude pics in facebook. Pag hiniwalayan mo ko, ipopost ko lahat.
Taro: Do you think I’m afraid? NOPE. Wag mokong takutin. Kung sino ang dapat matakot sa ating
dalawa, ikaw yun.! Matakot ka sa batas dahil pag ginawa mo yan, pwede kitang kasuhan ng
Cybercrime. For your information, napirmahan na ng dating pangulong Noynoy Aquino ang
Cybercrime Prevention Act of 2012 known also as Republic Act 10175, pag nagpopost ka ng mga
media content na maaaring makasira ng reputation ng isang tao, pwes, may lugar ka na sa kulungan for
six to twelve years.
Dua: I’m sorry. Please forgive me.
Taro: Tama na. Let me go. Kung may batas lang sana sa mga manloloko, pinakulong na kita.
(Walkout)
Scenario TWO:

Dua: Hey bro! Can I borrow your phone?


Tac an: Why?
Dua: I’ll just log in my fb account, in case my mom got a message for me. I forgot to bring my phone.
Tac an: Ahh. Okay. Here. (Gives the phone)
(phone of Dua rings)
Dua: Hello. What? As in now? Okay okay. I’m on my way. I’ll be quick. Here bro. Thanks. I better
go. It’s an emergency.
Tac an: Okay.
(Dua walkouts)
Tac an: OHHH. He forgets to log out his account. Hmmm.
(after a day)
Dua: Hello ma. Yes what’s the problem? Money? 20k? What money? I never ask for money from you
yesterday.
This is nonsense mom. I think someone uses my fb account just to message you. Ahh! Yes.
Yesterday I forgot to log out my account. OH NO. Wait ma. (walkouts)
Taro: Good afternoon sir. 20 thousand pesos right? Here you go.
Tac an: Thank you miss.
Dua: That’s him sir.
Tac an: What’s the meaning of this?
Bacarro: You are under arrest on suspicion of illegal access with Mr. Dua’s fb account. You do not
have to say anything, but it may harm your defence if you do not mention when questioned something
which you later rely on in court. Anything you do say may be given in evidence.
Dua: Do you think I’ll let you do your crime for using my account just to gain money from my mom?
A law is made for your style of fraud. You just created an offense with the Republic Act 10175 with
your unauthorized use of someone’s data like facebook just to do your crime. The law punishes those
who aids in the commission of cybercrime with penalties to be imposed include imprisonment of 12
years plus a fine ranging from 200 000 to 1 million. Now, the jail has a space for you!
