The Parties
This contract of employment (“this Contract”) is entered into XXX (hereinafter referred to as
“XXX”) and ………………………………………. (hereinafter referred to as “you” or “your”) on
…………………………… under the terms and conditions of employment as set out herebelow:
1. Commencement of Employment
1.2 Your employment is for a fixed term contract, for a period of one (1) month, ending on
…………………………
1.3 This Contract will automatically renew at the end of each term for a further term of one
(1) month, upon XXX discretion, unless terminated under Clause 10.

3.1 You shall be paid before 7th of the following month and your salary will be calculated
based on a daily basic wage of RMXXX
3.2 Contributions to EPF, SOCSO and EIS will be made by XXX in accordance with
prevailing statutory requirements.
4.1 You shall work five (5) days a week, from Mondays to Fridays.
4.2 You shall work XXX (XXX) hours per day from XXXam to XXXpm.
4.3 You shall entitle to one rest day (Sunday) every week, if you work more than 20 hours in
a week.

5. Public Holidays
5.1 You are entitled to seven (7) paid public holidays as follows: the National Day, the
Birthday of the Yang Di-Pertuan Agong, Labour Day, Federal Territory Day, 1 st day of
Hari Raya Aidilfitri and 1st & 2nd days of Chinese New Year.
6.1 If you work for more than 5 hours of work per day, but no longer than normal hours of full
time XXX staff (8.30 am to 5.30 pm), you will be entitled to overtime pay calculated at
your hourly basic rate of RM8.50.
6.2 If you work beyond the normal hours of full time XXX staff (8.30 am to 5.30 pm), you will
be entitled to overtime pay calculated at 1.5 times your hourly basic rate of RM8.50.
7. Work on a Saturday
7.1 If you work on a Saturday, you will be paid at 1.5 times your hourly basic rate of RM8.50
for every complete hour worked for the first 8 hours, and 2 times your hourly rate of
RM8.50 for every complete hour worked in excess thereof.
8. Annual Leave
8.1.1 6 days – for every 12 months of continuous service if employed for a period less
than 2 years;
8.1.2 8 days – for every 12 months of continuous service if employed for a period more
than 2 years but less than 5 years;
8.1.3 11 days - for every 12 months of continuous service if employed for a period
more than 5 years.
8.2 Your annual leave will be pro-rated based on the number of completed months of
service where there is no 12 months of continuous service.
9. Sick Leave
9.1.1 10 days – for every 12 months of continuous service if employed for a period less
than 2 years;
9.1.2 13 days – for every 12 months of continuous service if employed for a period
more than 2 years but less than 5 years;
9.1.3 15 days - for every 12 months of continuous service if employed for a period
more than 5 years.

9.2 Sick leave is not granted on any non-working day. You are required to provide a
medical certificate by a recognized medical practitioner to support your application for
sick leave.
9.3 You should notify XXX of your need to take sick leave in advance where possible or
before the start of the working day or as soon as possible after you have consulted a medical
practitioner.
10.1 Either party may terminate this Contract with five (5) working days’ written notice given
or payment in lieu of notice thereof.
10.2 Notwithstanding any other provision in this Contract, XXX may terminate this Contract
summarily and without notice for misconduct on your part.
10.3 In the event that you have been absent from work for two (2) consecutive working days
without any notification to XXX, and XXX has made reasonable efforts to contact you,
this Contract shall automatically terminate on the expiry of the second day without the
need for any notice of termination of employment.
11.1 XXX’s business affairs are confidential and you must not disclose such business affairs
to any third party. You shall keep confidential and shall not (except as authorized or required by
your duties) use or disclose or attempt to use or disclose to any person, firm or company any
of the secrets or confidential information of XXX which come to your knowledge during your
employment.
11.2 The term "secret and confidential information" extends to all knowledge and information
relating to the trade, business activities, operations, organization, finances and dealings
of and concerning XXX and/or any of its associated companies.
11.3. All records, documents, drawings and other papers including private notes concerning
XXX and all copies and extracts of them made or acquired by you in the course of your
employment shall be used for the purposes of XXX only and shall be the property of
XXX and shall be returned to it on demand at any time and without demand on the
termination of your employment.

11.4 You agree to observe date privacy requirements as stipulated in the Personal Data
Protection Act 2010 which prohibits unauthorized data processing of personal data and
XXX’s privacy policy, as made available at XXX
12. General
12.1 You will be subject to and must observe and comply with all rules, policies, and
procedures of XXX. If you are not aware of the aforementioned, kindly request for a copy
of the same and familiarize yourself with them.
12.2 XXX is entitled from time to time to amend, cancel or introduce new policies and rules.
12.3 Any introduction, amendment, or cancellation of such policies and rules will be notified to
you.
12.4 If you breach any of these policies, rules, and/or procedures, you may be subject to
disciplinary action up to and including summary dismissal.
12.5 This Contract shall be governed by and construed in accordance with the laws of
Malaysia.
12.6 Upon your appointment, you shall provide your personal details for XXX’s processing,
including but not limited to, your full name, MyKad and bank account number.
