WADILUBE Installation has two numbers of 6 Ton capacity each, fire tube boilers of Make M/s
Energy Pack. Both the boilers are operated alternatively as per requirement of blending section. It
is proposed to line up contract for Operation and daily maintenance of boilers as per Indian boiler
regulations. Intention of this tender is to invite competitive offer from the contractors for subject
job as per Scope of work / Supply and Terms and conditions mentioned herein. The contract period
will be tentatively from 01.10.2020 to 30.09.2021 (BPCL reserves right to foreclose tender at any
point of time with a notice of 30 days).
The scope of work for boiler operation is as follows. For this job, the contractor has to place
necessary manpower on daily basis to fulfill the requirement.
1. Boiler operation will be done by IBR certified boiler operator (First/Second class or as per
IBR Norms) with not less than 5 years of experience of operating high and medium
pressure ,oil fired boiler
2. Recording and maintaining of the safety and steam parameters in log book
3. Checking all safety and controls
4. Blow down daily or as per requirement
5. Soot cleaning from heating surfaces by soot blower
6. Soft water checking as per water treatment plant supplier's specifications
7. Checking of lubrication of all bearings and gear box assembly
8. Weekly checking of feed control valve
9. Weekly checking of water pump discharge line circulation line and pressure reducing
station
10. Weekly checking of operation of pressure switches
11. Weekly amperage checking of all motors
12. Monthly cleaning of gauge glasses
13. Monthly checking of all strainers
14. Monthly maintenance of feed water pumps
15. Cleaning of ID fan
16. Boiler needs to be operated in both the shift as per below timings
1. First shift – 0700 hours to 1500 hours and 2. Second shift – 1500 to 2100 hours
Safety gadgets such as Boiler suit, safety shoes, hard hats, helmets, uniforms, hand gloves etc. when
working in the plant premises need to be provided by the contractor. Party has to ensure that his
workmen follow all safety rules and regulations and wear PPEs like safety shoes, helmets, gloves
etc as applicable while working in the plant. The successful contractor shall issue proper identity
badges to their employees. Further the Contractor shall ensure to have carried out their Police
Verification before being placed for duties in the Plant.
SCOPE OF SUPPLY:
BY BPCL: Only material required for replacement, water and electricity for specified operation.
BY CONTRACTOR : All necessary tools, tackles required for electrical maintenance, electrical
equipment (like meggar, testers etc), Certified electrical hand gloves, cleaning equipment, cleaning
agents (such as MTO etc), cotton waste all types of tools for alignment etc. manpower (skilled and
unskilled), Supervisor etc. complete including safety shoes and helmets and safety clothing for
Contractor, Supervisor and Workmen.
1. CONTRACT PERIOD: ONE YEAR from date of LOI/PO. BPCL reserves the right to
foreclose contract at any point of time with a notice of 30 days.
2. ITC: BPCL is a manufacturing organization, hence enjoys input tax credit (ITC) benefit,
vendor if registered with excise shall give necessary documents to enable BPCL to avail full
credit of GST claimed by the Vendor.
3. Price escalation / de-escalation: Tenderer are requested to offer their firm price for throughout
the order period.
4. RISK PURCHASE: Whenever the vendor fails to complete the job as stipulated in the delivery
schedule and complete the site job as per schedule, BPCL reserves the right to cancel the order
in part or in full and procure such quantity from any other sources at his risk, responsibility and
cost of the supplier without prejudice to his rights and remedies under other clauses in this
contract. We may also withdraw his name from list of approved suppliers. BPCL also reserves
the right to procure same or similar materials equipment through other sources at your entire
risk, cost and consequences and you will forego the EMD amount.

6. LIQUIDATED DAMAGES CLAUSE:
Full quantity of the call off should be supplied within the stipulated period as mentioned in the
call off letter. The tenderer will have to pay to the Corporation by way of liquidated damages,
an amount equal to 0.5% of contracted price of the undelivered portion (if any) of the call off
subject to a maximum of 5% of the contracted price.
7. EMD:
a. Tenderer shall pay Rs. Forty Six Thousand (Rs 46,000 Only) as EMD per tender by D.D
drawn on any scheduled Bank payable at Mumbai in favor of BHARAT PETROLEUM
CORPORATION LTD. This should be submitted in a separate envelope along with the
Documents to be submitted in physical form.
b. EMD may be exempted if applicable as per Govt rules, however operator has to submit
the relevant documents (like NSIC/SSI/MSME etc) in support of EMD exemption.
Registration with BPCL does not exempt vendor from EMD. In case tenderer is
submitting MSME Certificate then CA certificate as per enclosed format has to be
submitted along with MSME certificate. CA Certificate is not required, in case tenderer
is submitting SSI /NSIC certificate.

13. PAYMENT:
Please note that payment will be made on monthly basis within 15 days from the submission
of bill and all relevant documents. (NO ADVANCE PAYMENT IN ANY SORT WOULD
BE MADE). Bills shall be submitted duly approved by Engineering Officer or Engineering I/C
(BPCL Wadilube certifying that the activities for which bills are produced are completed to the
satisfaction. Performance Bank Guarantee equivalent to 10% of contract value to be given for
the whole contract period.
14. The tenderer should study all the tender documents carefully and understand the conditions
before quoting. If there are any doubts, he should obtain clarification. But, this shall not be
justification for late submission or extension of opening date / time of the tenders.
15. The tenderer should quote for all items in the tender schedule, the rates should be expressed
both in figures and in words; where discrepancy exist between the two rates expressed in words
will prevail. Similarly, if there is any discrepancy between the unit rate and the amount, the
unit rate will prevail.
16. The rate should be quoted in the same units as mentioned in the tender schedule. All entries in
the Tender documents should be in Ink / typed. Corrections if any should be attested by full
signature of the Tenderer.

18. Every page of the tender documents shall be signed by the tenderer or his authorized
representative. Incomplete / conditional tender quotations or those received late and / or not
conforming to the terms and conditions in the Tender documents, will be rejected.
19. Special rights: BPCL reserves the right to :
i. Reject your offer without assigning any reasons thereof
ii. Not to accept the lowest rate quoted by the tenderer
iii. Cancel the tender or split the tendered quantities
iv. Order part quantities on vendor.
20. IMPORTANT: Follow all safety rules and regulation as per BPCL standard. All the Contractor
Workmen / Supervisor must wear safety belts, safety shoes and helmets (provided by the
Contractor) while working at site. If any dilution of using safety equipment is observed then
penalty would be charged and recovered from Contractors bill without assigning any reason or
excuse.
21. Provide all safety gadgets to your workmen such as safety shoes, helmets, gloves etc. Safety
PPE like helmets, safety shoes and safety belts (for working on height) are compulsory for all
Contractors staff. If any violation is observed, on the spot job will be stopped and person will
be driven out. Any delay in the job schedule on this account is Contractor’s responsibility.
22. The persons engaged by the Contractor shall use protective equipment i.e. Safety helmet, Safety
shoes etc.
23. The successful tenderer should ensure the safety of adjoining property and shall make good ay
loss to product/ property resulting from his negligence.
24. To work in company’s premises should be carried out, during the Company’s normal working
hours and without obstructing day to day work in the establishment. If any work is required to
be carried out beyond normal working hours, prior permission should be obtained before
undertaking such work.
25. The successful tenderer and his men shall abide all security / safety rules / regulations in force
at location and the laws, bye-laws and statues of Government and other local Authorities such
as requirements / liability under enactment like the Workmen’s Compensation Act, Contract
Labour Act etc. and the Company stand indemnified against any claims on these scores. The
successful tenderer strictly abide by “No Smoking” and other petroleum regulations on the
premises.
26. The successful tenderer is expected to co-operate / coordinate with other contractors carrying
out work allocated to them so as to avoid breaking up of work already done by them or causing
any hindrance in the progress of their work. In case brought to the notice of the site Engineer.
27. The contractor should be registered with PF/ESI authorities and payments necessary to be
deposited timely proof of which may be submitted along with bills if needed
28. To facilitate service providers to improve quality of manpower/services, BPCL has adopted the
principle of paying additional wages to the contract labour engaged by contractors in BPCL
Marketing Division, by value over & above the applicable central/state monthly minimum
wages rates, as per the chart below
Vendor has to ensure timely payment of wages and other statutory requirements like PF,ESIC,
bonus, gratuity etc to all its employees and has to submit proof of payment (mode of payments to
employee has to be electronic transfer only) to BPCL. After submission of such proof only monthly
bills will be cleared
General:
a) BPCL reserves the right to accept/ reject the whole or part of any tender without assigning any
reason.
b) Quote as per S O R attached herewith before quoting visit site to get the idea of the job and site
conditions.
c) Tenders not conforming to the terms and conditions prescribed in the tender documents will be
rejected.
d) BPCL enjoys CENVAT (on GST) benefits hence assessment of quotation will be done on net
landed cost of the job.
e) Any new terms and conditions included by the tenderer shall not be considered and will not be
binding on the corporation.
f) Details of tenderer’s relationship with BPCL’s directors should accompany the offer in the
format enclosed (refer attached Annexure).
g) BPCL shall evaluate the capability and quality systems at the professional at any time during
the contract and would take appropriate action including termination if it is found that the
process /systems are not as per our requirement.
h) In case of non-performance, Corporation retains the right to re-allocate the job in part or full to
meet the requirements.
i) The Corporation will have the right to reject any offer, which in our opinion is below the
estimated rate worked out for any type of package included in the tender.
j) Forming cartel and quoting rates in groups would disqualify the tenderer.
k) Performance of the supplier during the contract would be a criterion for issuing future tenders.
ANNEXURE – C
ARBITRATION CLAUSE
Any dispute or difference whatsoever arising out of or in connection with this Agreement
including any question regarding its existence, validity, construction, interpretation, application,
meaning, scope, operation or effect of this contract or termination thereof shall be referred to and
finally resolved through arbitration as per the procedure mentioned herein below :
(a) The dispute or difference shall, in any event, be referred only to a Sole Arbitrator
(b) The appointment and arbitration proceedings shall be conducted in accordance with SCOPE
forum of Arbitration Rules for the time being in force or as amended from time to time
(c) The Seat of arbitration shall be at Mumbai
(d) The proceedings shall be conducted in English language
(e) The cost of the proceedings shall be equally borne by the parties, unless otherwise directed by
the Sole Arbitrator
TERMINATION CLAUSE
Notwithstanding anything to the contrary herein contained, BPCL shall also be at liberty at its entire
discretion to terminate this agreement forthwith upon or at any time after the happening of any of
the following events namely:
a) If you commit a delay, breach or default of any of the terms, conditions, covenants and
stipulations contained herein.
b) Upon death or adjudication as insolvent if you are individual (this clause is to be suitably
modified if business is carried on by partnership or by limited company or by a co-operative
society).
c) If any attachment is levied and continued to be levied for a period of seven days upon your
effects.
d) If you are involved in any criminal offence relating to Moral Turpitude.
e) If a receiver is appointed of any of your property or assets.
f) If the License issued to you by the relevant statutory authorities is cancelled or revoked.
g) If you have made default in payment of any money of the BPCL without formal approval
of the BPCL in writing.
h) If you fail to adhere to the instructions issued to you by the BPCL from time to time in
respect of the business condition herein.
i) If you contaminate or tamper with the quality of BPCL’s product given in you.
j) If the ownership / tenancy of the premises from which you are carrying on the business if
transferred / terminated for any reason whatsoever.
k) If you, yourself or to your servant or agents commit or suffer to committed any act which
in the opinion of the Executive Director (Lubes) of the BPCL is prejudicial to the interest
or good name of BPCL or its products. Executive Director (Lubes) shall not be bound to
give reasons to such decisions.
l) The BPCL’s right to terminate the contractual obligations under this clause shall be without
prejudice to and without affecting any of its rights and remedies against you.
In the event of BPCL terminating this agreement under the provisions of this clause it shall not be
liable to pay for any loss or compensation in respect of such termination.
Without prejudice to the foregoing provisions or anything to the contrary herein contained either
or the parties hereto namely you and BPCL shall be entitled to terminate this agreement on giving
90 days written notice to the other parties without assigning any reasons for such termination
CONTRACTORS PARTY : The contractor’s party should not consist of any one below the age of
eighteen years.
Copy of the recent registration certificate issued by the municipality, Labour Commissioner, ESI,
EPF & Service Tax etc. as the case may be.
A declaration to the effect that, not dues to be paid to Law Enforcement Authorities, like EPF/ESI
and no violation was noted by Labour Enforcement Authorities and will above by the provisions of
Contract Labour Regulation and Abolition Act and as amended from time to time.
A copy of the Service Tax Registration certificate is also to be submitted.
Successful Tenderer shall register themselves with the Assistant Labour Commissioner (Central) as
Per The Contract Labour (R&A) Act,1970 and Contract Labour Central Rules, 1971 as applicable
within 10 Days (TEN DAYS) after the receipt of letter of acceptance of tender.
SUB CONTRACTOR:
The contractor shall not assign, sub contract or subject the whole or any part of the works covered by
the contract or any benefit thereof.
OTHERS :
a) The contractor shall arrange sufficient work force/manpower to carry out the job entrusted to him.
Failure to arrange the requisite work force / manpower can be construed as breach of contract which
may entail BPCL to terminate the contract or take any other action as may deem fit.
b) The contractor should agree that the personnel so deployed on a contract basis and for all practical
purposes are employees of the contractor and they will not be entitled for any of the privileges and
benefits enjoyed by the employees of BPCL. The work force so deployed, will have no claim, directly
or indirectly for regular employment or service conditions and any other benefit available to the
employees of BPCL Wadilube.
c) The contractor shall be fully responsible in all respect in case of injuries / accidents to this work
force while on duty
d) The contractor shall equip the work force with proper uniforms, identity cards and other
accessories as deem fit for effective working.
e) The work force posted shall be of good health, good character, amenable to discipline and should
have necessary intelligence for carrying out the work.

1. I am not related to any of the Directors of BPCL.
3. I am not a partner of a firm in which any other partner is related to BPCL Director.
I also certify that M/s. ______________ (name of the firm which is being considered for the
contract) does not have a partner, who is a Director of BPCL or his relative.
