NO.2024-002

SUBJECT: Adoption and revisions of association clearance fee, membership fee, and
monthly association and/or maintenance dues

WHEREAS, in the meeting between the Board of Directors and Officers held last
February 26, 2024, it was discussed and agreed upon that the move for financial and
administrative self-sufficiency should immediately be initiated in anticipation of the
upcoming turn-over of CHI of the management of the subdivision to the duly elected
Homeowners’ Association (HOA) Officers within this year end.

WHEREAS, in Article IV, Section 1, of El Paseo HOA, Inc. (EPHAI) by-laws, stipulates
that upon the organization of this association, or the admission of any person as member
hereof, every member of the association shall pay a One Time Membership Fee of five
thousand pesos only (Php 5,000.00) paid in a manner to be determined by the Board of
Directors or Trustees.

WHEREAS, in Section 2 of the same article provides that the monthly association
and/or maintenance dues of Four Hundred Pesos (Php 400.00) per household shall be
collected from every member to defray the administrative cost and operational expenses of
the association and subject to increase as the circumstances may warrant, upon approval of
the Board of Directors and based on a Board of Resolution issued thereon.

This abrogate/annul the previous Board Resolution of Article IV Section 2 (Board Resolution
No. 2018-001) of modifying the monthly association dues of seven hundred pesos only (Php
700.00). This resolution reverts/requites it back it to four hundred pesos only (Php 400.00)
WHEREAS, Article IV, Section 4, of El Paseo HOA, Inc. (EPHAI) by-laws, stipulates that
the Board of Directors or Trustees, may from time to time assess and collect from each
member, reasonable amounts as may be necessary to fund special community projects for
the common good and benefit of the association as approved by the majority of the
members of the Board.

Any member that will sell their house(s)/house and lot/lot(s) must pay a substantial
association clearance fee amount of five thousand pesos only (Php 5,000.00) per property
in addition to making restitution for unsettled monthly dues and penalties. Once all dues,
payments, and penalties have been cleared, they are entitled to receive the homeowners’
association clearance (HOAC).

NOW, THEREFORE, in consideration of the foregoing and in the spirit of community-
building, cooperation, and equity and fairness in enjoying the rights and privileges of
bonafide members of the Association, the Board of Directors resolves, as it does hereby
resolve, to adopt the herein provisions particularly the rates herein prescribed;

BE IT RESOLVED FURTHER THAT THIS RESOLUTION shall constitute sufficient


authority for the enforcement of the one-time membership fee of two thousand pesos only
(Php 2,000.00), monthly association and/or maintenance dues of four hundred pesos only
(Php 400.00) and five thousand pesos only (Php 5,000.00) association clearance fee per
property for homeowners deciding to sell their house(s)/house and lot(s)/lot(s) as well as
having cleared all their dues and penalties.

This resolution takes effect upon its approval.
