The Property Manager accepts this appointment and agrees to carry out the
responsibilities outlined in this Agreement.
2. Term
This Agreement shall commence on the Effective Date and continue for a period of
[Term Duration]. The Agreement may be terminated early as specified in Section 8.
3. Scope of Services
The Property Manager shall provide the following services:
a. Rent Collection:
The Property Manager shall collect all rental payments from tenants and promptly remit
the net rental proceeds to the Landlord as per agreed-upon terms.
b. Tenant Management:
The Property Manager shall screen and select tenants, execute lease agreements, and
handle all aspects of tenant relations, including rent renewals, inspections, and
addressing tenant concerns.
d. Financial Reporting:
The Property Manager shall maintain accurate records of all income and expenses
related to the property and provide regular financial reports to the Landlord.
e. Legal Compliance:
The Property Manager shall ensure compliance with all applicable local, state, and
federal laws and regulations related to the property, including but not limited to fair
housing laws, building codes, and safety requirements.
4. Compensation
In consideration for the services rendered by the Property Manager, the Landlord shall
pay the Property Manager a management fee of [Fee Amount or Percentage], payable
[Frequency of Payment]. Additional fees for specific services may be agreed upon in
writing.
5. Authority
The Landlord grants the Property Manager the authority to take all necessary actions to
manage and operate the property effectively. This includes but is not limited to
negotiating and executing leases, handling tenant disputes, engaging contractors, and
making decisions related to the day-to-day management of the property.
6. Insurance
The Property Manager shall maintain appropriate insurance coverage, including but not
limited to general liability insurance and professional liability insurance, to protect
against any claims arising from their management activities.
7. Indemnification
The Landlord agrees to indemnify and hold the Property Manager harmless from any
claims, damages, or liabilities arising out of the property, except for those caused by the
Property Manager's negligence or willful misconduct.
8. Termination
Either Party may terminate this Agreement upon one month’s written notice to the other
Party. Termination shall not relieve either Party of any obligations or liabilities accrued
prior to the termination date.
9. Governing Law and Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of
[State]. Any disputes arising out of or in connection with this Agreement shall be
resolved through negotiation in good faith. If the Parties fail to reach a resolution, the
dispute shall be referred to mediation or binding arbitration as agreed upon by the
Parties.
