    APPLICATION SEEKING CONDONATION OF DELAY IN


    FILLING THE WRITTEN STATEMENT

    MOST RESPECTFULLY SHOWETH:

    1. An application preferred on behalf of the Plaintiff on the


    ground that the suit is at the initial stages and even the
    summons have not been issued. Additionally, it is
    pointed out that a similar suit being CS(OS) No.
    46/2023 against the same Defendants is pending before
    this Court and is next listed on 13.10.2023 and therefore
    this suit be also listed on the said date. For the reasons
    stated in the application, the same is allowed and the
    suit was registered as a plaint on 01.08.2023.
    2. As stated above summons were issued to the defendants,
    being a caveat the defendant got summons few days
    later of sanctioning the order of summons and the reply
    and written submission was filed in the stipulated time
    period according to the defendant.
    3. That it is submitted that the above application has been
    filed before this hon’ble court with delay of 17 days,
    which is neither willful nor wonton but due multiple
    unavoidable reasons beyond the control of this
    respondent.
    4. That no prejudice could be cause to the petitioner if the
    delay in Filling this written submission is condoned by
    this Hon’ble Court. On the other hand great prejudice
    would be caused to the Respondant if the prayer made
    herein below is not allowed by this Hon’ble Court.

    PRAYER
    In these circumstances the petitioner herein prays that this
    hon’ble court may graciously be pleased to:
    1) Pass an order to condone delay in filing of the above
    application in filling written submissions on behalf of the
    Respondents :or

    2) Pass any other order which this Hon’ble court may deem
    fit and proper in the facts and circumstances of the case
    in favour of the petitioner.

    AND FOR THS ACT OF KINDNESS, THE APPLICANTS AS


    IN DUTY, BOUND SHALL EVERY PRAY.

    l, Mohammed Rizwan, Son of Mohammed Khaleelullah, aged about 42 Years, by

    faith- Islam, by occupation Service, working for gain at Reverie Language

    Technologies Limited, do solemnly hereby declare and affirm as follows:

    That I am the defendant No. 3 in this instant suit and also the Authorized

    representative of Defendant No.5 in the above suit. I am aware of the facts and

    circumstances of the present case and I am authorized to swear and depose the

    contents of the present affidavit.

    2. I have read the contents of the accompanying Reply and I say that the contents therein

    are true to my knowledge and also based upon information / legal advice received by

    me and believed to be true and nothing material nor relevant has been concealed

    there from.
    3. I say that I adopt the contents of the accompanying Reply as part and parcel of my

    Affidavit. The same are not being reproduced herein for the sake of brevity.
