    MOST RESPECTFULLY SUBMITTED:

    I. That the above noted case is pending trial before this Hon 'ble
    court and fixed for 08.08.2024.

    2. That the defendants no. I to l.:f had received the summons


    th
    from this Hon'ble court on 3-4 week March 2024 near to
    Holi (exact date not known).

    3. That the defendants had engaged a counsel requested him to


    prepare the written statement. The counsel had taken 3-4
    months and did not prepare the written statement. The
    defendants taken the brief back from him and engaged the
    new counsel on 30 th June 2024.

    4. That the matter was listed before this Hon 'ble Court on
    01.07.2024 and the counsel appeared and sought time to
    prepare the written statement. The counsel had prepared the
    written statement; but one of the defendants namely Manoj
    Sehrawat was in Tihar Jail. It had taken time to get the
    documents signed from all the defendants.

    5. That even otherwise also the defendants have no objection to


    the suit of the pl a inti ff.

    6. That the delay in filing the WS is approx. 105 days after 30


    days is neither intentional nor deliberate but due to the facts
    above stated.

    It is, therefore, most humbly prayed that the application may


    kindly be allow in the interest of justice.

    well conversant with the facts of the case and competent to

    2. That the application for condonation of delay in filing the


    written statement has been drafted by my counsel and the
    averments made therein are true and correct to my
    knowledge.

    3. The contents of the same may be read as part and parcel of


    this affidavit, which are not being reproduced herein for the
    sake of brevity.
