This MUSIC CONTRACT (“Contract”), is made between [SHUBH SONI] of [FIRST CLAP MOTION PICTURES PRIVATE LIMITED] (“Company”) and [ARNAB DEKA and JEET PRAKASH MAHANTA] the [“MUSIC PRODUCERS”] of this film, collectively referred to as “Parties.”
In consideration of the mutual agreements and conditions in this Contract, of which the receipt and sufficiency are hereby acknowledged, the Parties further agree to the terms and conditions as follows:
The MUSIC PRODUCERS agrees to oversee the Feature Film project for the Company’s full-length film currently titled “Me and You”.
Terms and Conditions
➤ MUSIC PRODUCERS job is to provide 4 music tracks currently titled []for the Feature Film “ME AND YOU”. The music producers agree to provide music tracks mixed,mastered and finalized for the feature film “ME AND YOU” ➤ MUSIC PRODUCERS agree to transfer the rights and ownership of all the 4 music tracks to FIRST CLAP MOTION PICTURES PRIVATE LIMITED ➤ The Company has the complete right to use the music tracks in whatever way they wish to use in there feature film, promotional events, or any activity related to “ME AND YOU” ➤ The Company agrees to give proper credit and attribution to the music producers in the feature film. ➤The MUSIC PRODUCERS agrees to remove the track from spotify/youtube or any other website previously uploaded after signing of this agreement. ➤ The Company shall upload the music tracks under its name on whichever platform it feels appropriate. The Company shall credit the MUSIC PRODUCERS on the platforms the tracks are uploaded. ➤ The Company has the right to further sell the song to any ott platform or music company or production house after the film releases. ➤ The MUSIC PRODUCERS have the right to perform stage shows of the 4 music tracks sold to FIRST CLAP MOTION PICTURES PRIVATE LIMITED after the film releases . 50 % of the earnings from all the stage shows shall be shared with the COMPANY. •REMUNERATION ➤ The Music Producers shall be remunerated ₹10,000/ per track for 4 tracks , which equals to ₹40,000/ (Rupees Forty Thousand Only) in total. The remuneration is one time and this shall transfer the MUSIC TRACK rights to the COMPANY.
•OWNERSHIP (INTELLECTUAL PROPERTY)
➤ The Company shall be the sole and exclusive owner of all the rights over the film production and related services.
•TERMINATION ➤ In case of the breach of this agreement or because of any unforeseen circumstances the agreement will be terminated by either side giving advance information to the other party. Termination shall not affect any rights or obligations that have been passed on to the company.
•SIGNATURES By signing below, the parties acknowledge and agree to the terms and conditions of this Music Rights Contract.
