“Call For Application” and following relevant engagement.

IV. Procession of Personal Information

Whereas the personal information submitted by the applicant will be collected and

processed by Vancy Culture (Beijing) Co., Ltd. (hereinafter referred to as VCB) and given

to Riccardo Muti Italian Opera Academy (hereinafter referred to as RMMUSIC) as the

world-wide exclusive owner of all rights pertaining to the Riccardo Muti Italian Opera

Academy for the selection of young conductors in Italy. The applicant

agrees to provide his/her personal information

(including name, address, telephone number, e-mail address, photo and other materials)

and sensitive personal information (including biometric information in the submitted video

materials, ect.) to Vancy Culture (Beijing) Co., Ltd. for lawful collecting and processing,

and to be transferred abroad (Italy) to be shared with RMMUSIC for the selection of young

conductors.

The applicant has read and agrees to the

following notification made in accordance with the art. 13 of Regulation (EU) 679/2016

(General Data Protection Regulation) and arts 5, 7, 17 of “Personal Information

Protection Law of the People's Republic of China ”(hereinafter referred to as Personal

Information Protection Law) and other relevant provisions.

The undersigned , read the art. 13 of

Regulation (EU) 679/2016 (General Data Protection Regulation) and arts 5, 7, 17, 44-50,

etc. of the “ Personal Information Protection Law of the People's Republic of China” as

follows - whereof in Article 7 of the competition announcement - authorizes the treatment

of personal data that will respect the principles of fairness, legality and transparency and

protection of the undersigned privacy and rights.

2. Purpose of Personal Information Processing:

Your personal Information will be processed for the following purposes related to the

Riccardo Muti Italian Opera Academy – China 2024:

（i）personal information processing for the fulfillment of specific obligations towards

partners, sponsors, governmental bodies cooperating with Riccardo Muti Italian Opera

Academy – China 2024 and VCB;

(ii) publication on RMMUSIC and VCB’s and/or RMMUSIC and VCB’s affiliate(s) and/or

RMMUSIC and VCB’s licensee(s) of biography, photographs and/or other material related

to Riccardo Muti Italian Opera Academy – China 2024, RMMUSIC and VCB;

(iii) forward newsletter and informative materials (i.e. biography, photographs and/or other

material) related to this Riccardo Muti Italian Opera Academy – China 20 24 to publishers,

record companies, publishing companies, promoters, producers, merchandising

producers, advertising agencies, movie and/or TV producers and /or distributors, press

offices and other related structures;

(iv) mandatory requirements for tax and account purposes;

3. Methods of Personal Information:

personal information could be processed as follows where authorised by personal

information controller:

(i) outsourcing processing personal information to third parties;

(ii) processing by way of electronic and IT tools;

(iii) manual processing and paper files.

Each and every processing will be made having regard as set out in art. 32 of GDPR and

art. 6 of “ Personal Information Protection Law” by adopting the required appropriate

security measures.

4. Legal Basis for the Processing of Personal Information：

the legal basis for the processing of personal information is the application for the

participation to Riccardo Muti Italian Opera Academy – China 2024 (art. 6. 1 lett. B of

GDPR, art 13 of “ Personal Information Protection Law”). Personal information supply is

necessary for the herein above-mentioned purposes. Failure or refusal to supply personal

information entails the impossibility to execute the activities herein mentioned.

Personal information could be processed also where a litigation may occur or in the

course of companies activities (merger and/or acquisitions) and/or in case of due

diligence. Said possible processing might be made in the legitimate interest of RMMUSIC

and VCB where required to defend its interests and/or right as recognised and

acknowledged by actual laws or in the course of business activities.

Always on the basis of its legitimate interest, RMMUSIC and VCB and/or authorised

persons will be allowed to contact personal information subjects for purposes related to

the Academy and/or purposes of evaluation of further possible cooperation.

5. the Processed Personal Information：

(i) given name and surname;

(ii) address；

(iii) tax code and VAT number;

(iv) telephone and e-mail, address;

(v) photographs, biography and other material.

6. Transferring Personal Information abroad：

Personal information could be transferred outside of Italy and China (U. S. A included). By

considering that in some countries ( as the U.S.A .) could not be granted the same level of

protection, VCB will make their best efforts in order to make that personal information will

be processed according to high level of confidentiality also through agreements which

warrant high level of protection adopting the standard clauses set out by the European

Commission. The e-mail and cloud management must be GDPR and “Personal

Information Protection Law” compliant.

7. Personal Information Storage

The applicant acknowledges receipt of information that having respect to the principles of

fairness, legality and transparency and protection privacy and rights, pursuant to art.5 of

GDPR and art. 19 of “ Personal Information Protection Law” , the personal information

storage term shall be:

(i) no longer than requested by the purposes for which said personal information is

supplied;

(ii) no longer than the term requested by RMMUSIC and VCB to fulfil its activities;

(iii) no longer than the terms required by the tax rules and regulations (art. 2220 of the

“ Italian Civil Code” and art. 29 of “ Rules for the Implementation of the Law of the People's

Republic of China on the Administration of Tax Collection”).

8. Personal information Subject’s Rights:

(i) right of access (art. 15 GDPR,art.45“ Personal Information Protection Law”);

(ii) right to rectification (art. 16 GDPR, art.46“ Personal Information Protection Law”);

(iii) right to erasure (“ right to be forgotten” ) (art. 17 GDPR, art.47“ Personal Information

Protection Law”);

(iv) right to restriction of processing (art. 18 GDPR, art.44“ Personal Information Protection

Law” );

(v) notification obligation regarding rectification or erasure of personal data or restriction of

processing unless this proves impossible or involves disproportionate efforts (art.19

GDPR);

(vi) right to receive the personal data concerning him or her, which he or she has provided

to a controller, in a structured, commonly used and machine-readable format and have the

right to transmit those data to another controller without hindrance from the controller to

which the personal data have been provided (art.20 GDPR); Where individuals request

the transfer of personal information to their designated personal information processors, if

the conditions specified by the national cyberspace administration are met, personal

information processors shall provide the channels for transfer(art.45“ Personal Information

Protection Law”).

(vii) right to object to data processing including profiling (artt.21-22GDPR, art.24 “ Personal

Information Protection Law”);

(viii) withdrawal of consent to data processing, without prejudice to allowed processing

based on the initial consent granted before its withdrawal (art. 7, par 3 GDPR, art.15

“ Personal Information Protection Law”);

(ix) lodge complaint to supervisory authorities (art.51 GDPR, art.65 “ Personal Information

Protection Law”).

鉴于申请人提交的个人信息将由凡晶文化（北京）有限公司（以下简称 VCB）收集和处理，

并将其转交给 RMMUSIC，RMMUSIC 是里卡尔多 ·穆蒂意大利歌剧学院的全球独家所有者，

用于青年指挥家的选拔。申请人 同意向凡晶文化（北京）有限公司提

供其个人信息（包括姓名、地址、电话号码、电子邮件地址、照片和其他材料）和敏感个人

信息（包括在提交的视频材料中的生物识别信息等），以便合法收集和处理，并将其转移到

国外（意大利）与 RMMUSIC 共享，用于青年指挥家的选拔。

申请人 已阅读并同意依据《欧盟法规(EU) 679/2016 条例》(通用数据

保护条例)第 13 条、《中华人民共和国个人信息保护法》(以下简称《个人信息保护法》)

第 5 条、 第 7 条、第 17 条等相关条款制定的此通知。

用数据保护条例）》第 13 条以及《中华人民共和国个人信息保护法》第 5 、7 、17 、44-50

条等相关条款，以及竞赛公告中第 7 条规定的内容，在此授权处理个人数据，处理过程将

( 1) 为履行与“里卡尔多·穆蒂意大利歌剧学院- 中国 2024”及凡晶文化(北京)有限公司合

作的合作伙伴、赞助商和政府机构的具体义务而进行的个人信息处理；

(2) 在 RMMUSIC 、凡晶文化(北京)有限公司及/或 RMMUSIC 、凡晶文化(北京) 有限公司

关联公司及/或 RMMUSIC 、凡晶文化(北京)有限公司许可方的平台上发布与“里卡尔

多·穆蒂意大利歌剧学院-中国 2024 ” 、 RMMUSIC 和凡晶文化(北京)有限公司相关

的传记、照片和/或其他材料；

(3) 将与本次“里卡尔多 ·穆蒂意大利歌剧学院— 中国 2024 ”活动相关的新闻简报和信息材

料(如传记、照片和/或其他材料)转发给出版商、唱片公司、出版公司、推广商、制片人、

商品制片人、广告公司、电影和/或电视制片人和/或分销商、新闻办公室和其他相关机

构；

(4) 税务和会计目的的强制性要求。

( 1) 将个人信息处理外包给第三方；

(2) 采用电子和信息技术工具进行处理；

(3) 进行人工处理和使用纸质文件。

每一种处理方式都将遵循欧盟《通用数据保护条例》第 32 条、《个人信息保护法》第 6 条

的规定，并采取必要的适当安全措施。

个人信息提供的性质以及拒绝提供个人信息的后果：个人信息处理的法律基础是申请参加

“里卡尔多·穆蒂意大利歌剧学院— 中国 2024 ”(《通用数据保护条例》第 6. 1 款第 B 项、

《个人信息保护法》第 13 条) 。为了上述目的，提供个人信息是必要的。未能或拒绝提供

个人信息将导致无法执行此处提到的活动。

个人信息还可能在可能发生诉讼、公司活动(合并和/或收购)和/或尽职调查过程中进行处理。

RMMUSIC 和凡晶文化(北京)有限公司可能会出于维护其利益和/或实际法律承认和确认的

权利或在业务过程中的合法权益，而对个人信息进行处理。

RMMUSIC 、凡晶文化(北京)有限公司和/或授权人员将始终基于其合法利益，出于与学院相

关的目的和/或评估进一步可能的合作的目的，与个人信息主体进行联系。

个人信息可能会被传输到中国和意大利外(包括美国)。鉴于在某些国家(例如美国) 可能

无法提供相同水平的保护，凡晶文化(北京)有限公司将尽最大努力确保个人信息按照高

度保密的标准进行处理，还将通过采用欧洲委员会规定的标准条款的协议来确保高水平

的保护。电子邮件和云管理必须符合《通用数据保护条例》和《个人信息保护法》要求。

7. :

申请者承认已收到关于遵循公平、合法和透明原则以及保护隐私和权利的信息。根据《通

用数据保护条例》第 5 条、《个人信息保护法》第 19 条的规定，个人信息存储期限

应为：

( 1) 不超过提供个人信息的目的所要求的时间；

(2) 不超过 RMMUSIC 和凡晶文化(北京)有限公司履行其业务活动所要求的期限；

(3) 不超过税务法规规定的期限(《意大利民法典》第 2220 条,《中华人民共和国税收征收

管理法实施细则》第 29 条)。

8. :

（1） 查阅权(GDPR 第 15 条，《个人信息保护法》第 45 条)；

（2） 更正权(GDPR 第 16 条、《个人信息保护法》第 46 条)；

（3） 删除权(“被遗忘权”)(GDPR 第 17 条、《个人信息保护法》第 47 条)；

（4）限制处理权(GDPR 第 18 条、《个人信息保护法》第 44 条)；

（5）通知义务，涉及个人数据的更正、删除或处理限制，除非这是不可能的或涉及不成比

例的尝试(GDPR 第 19 条)；

（6）可携带权。有权从数据控制者处获取结构化、通用且可机读的个人数据，并且有权将

这些数据传输给另一控制者，而不受原控制者的阻碍(GDPR 第 20 条) ；个人请求将个人

信息转移至其指定的个人信息处理者，符合国家网信部门规定条件的，个人信息处理者应

当提供转移的途径。(《个人信息保护法》第 45 条)；

（7） 反对数据处理，包括个人资料识别分析(GDPR 第 21-22 条，《个人信息保护法》 第

24 条)；

（8） 撤回对数据处理的同意权，但不影响在撤回同意之前基于最初同意进行的处理

(GDPR 第 7 条第 3 款，《个人信息保护法》第 15 条)；

（9） 向监管当局提出投诉的权利(GDPR 第 51 条、《个人信息保护法》第 65 条)。
