WELCOME TO GANGOH
The town [Gangoh] consists of an old and new quarter, the former founded by a
legendary hero. Raja Gang, from whom its name is derived, and the late by the famous saint
Shaikh Abdul Kuddus, who gaves his title to the western suburb, where his mausoleum stands,
built by Humayun in 1537 and Molana Rasheed Ahmad Gangoh which was co-founder of
madrasa darul- aloom Deoband and participated in war against East India Company under
the flag of Haji Imdadullah Muhajir Makki. During the Mutiny Gangoh was frequently
threatened by the rebel Gurjars (Gujjars) under the self-styled Raja Fathua; but Mr. H. D.
Robertson and Lieutenant Boisragon attacked and utterly defeated them towards the end of June,
1857. There are three old mosques, two of which were built by Akbar and Jahangir, besides a
school and a dispensary. The town is liable to be flooded from a large swamp south of the site,
but a scheme has been prepared to drain this. The streets are paved and most of them have
brickwork drains. Gangoh is administered under Act XX of 1856, the income raised being about
Rs. 3,000 a year. It is the cleanest and best kept of all the towns under Act XX in the District.

Vishwavidhaylaya, Uttar Pradesh Adhiniyam, 2011 (U.P. Act No. 3 of 2012) passed by Uttar
Pradesh Legislature and assured by the H.E. Governor of Uttar Pradesh. The university is
established U/S 2(f) of the University Grant Commission (UGC) Act, 1956.
School of Law & Constitutional Studies is approved by Bar Council of India and is
imparting top class legal education since2013. It offers courses of BA.LL.B. (5 yrs. integrated
Course), LL.B. (3 yrs. course), L.L.M (2years course) and Ph.D. It aims to nurture finest Law

EVENTS SCHEDULE
REGISTRATION
In order to confirm participation, teams of every Institution should register themselves. The
registration process consists of the following:-

ELIGIBILITY
The competition is open for students pursuing 5years integrated law course and 3years LL.B. Course.
LANGUAGE
The competition shall be conducted in English language only.
TEAMS COMPOSITION
Each team shall consist of three members (two speakers and one researcher).
The researcher will be allowed to argue instead of a speaker with prior permission of the Dean
(SLCS).
CRITERIAFORMEMORIALEVALUATION

c) List of Abbreviations
d) Index of Authorities
e) Statement of Jurisdiction
f) Statement of Facts
i) Compendium, if any Note: Identity of the Institution should be revealed any wherein the
memorial as well as in any Annexure. Violation of this provision will result in penalty
including disqualification. The Organizer’s decision shall be final in this regard.
The font of the body of the memorial should be in Times New Roman, size 12, line
spacing 1.5 & heading should be 14. The font of the footnotes should be in Times New
Roman, size 10.
a) Memorials should have one inch margin on all sides of each page.
c) The memorial should not contain any photographs/ sketches/ exhibits/ affidavits
etc.
1. All memorials received within time schedule will be evaluated by the Memorial
Evaluation Committee (MEC) to be constituted by the Convener of the Moot Court
Competition and Dean, SLCS.
RESEARCHER’S TEST
I. In a team consisting of three members, the member designated as Researcher shall take part in
the test.
II. Participants are requested to write only the Team Code on the question paper.
III. The researcher’s Tests hall be objective as well as subjective with the questions based on the
applicable law, precedents and facts pertaining to the Moot Problem.
V. The use of mobile phones, laptops or any other electronic gadgets/ written material is strictly
prohibited during the Researcher Test.
VI. The Winner of the Tests hall is determined on the basis of highest core attained.
NOTE: The Speakers of any team will not be allowed to satin the Researcher test in any
case.
1. The Researcher needs to be present with the speakers during all rounds.
2. The Researcher shall not be permitted to address the Court during the Ora
Rounds.
3. The Researcher may however, be permitted to pass notes to the Speakers at the discretion of
the Judges. Such notes shall be passed through the court clerks presenting the court room.
4. The use of mobile phone, laptops or any other electronic gadgets is strictly prohibited during
the Oral Rounds, subject to the discretion of the judges.
5. Participants may use their own bare acts, print outs and commentaries provided that anonymity
is not violated during the Rounds.
6. The decision of Judges as to the marks allotted to each team shall be final and binding.
i. Preliminary Rounds(Two);
ii. Quarter-finals;
iii. Semi-finals;
iv. Final.
GENERAL PROCEDURE
Preliminary Round:
A. Registration, Orientation and Draw of Lots will be held on Wednesday 17th May, 2023.
B. Preliminary will be held on Wednesday 17 th May, 2023. Every team shall argue twice in
the Preliminary Rounds, once for Appellant/ Petitioner and once for the Respondent/
Defense.
C. No two teams shall face each other more than once in the Preliminary Rounds. However,
such team may face each other in the quarter Finals/ Semi Finals/ Finals Rounds,
subject to their qualification.
D. Speaker 1and the Speaker 2 to remain the same throughout the competition.
E. Top eight teams shall qualify to the quarter final rounds. The qualification to the
Quarter finals will be based on:
1. On the basis of Total Aggregate Score in the preliminary rounds (Both Round).
a. The top eight teams with higher aggregate score in both preliminary
rounds will qualify for the quarter finals rounds.
b. The aggregate score of a team shall be computed as the total of – Oral Score of
Speaker 1 and Oral Score of Speaker 2 of the Preliminary Rounds.
5. The Best Speaker (male) and the Best Speaker (female) Award will be awarded on
the basis of the scores awarded to their dividable speakers in the Preliminary Rounds.
6. Teams will be provided with their opponent team’s memorials after the conclusion
of draw of lots.
The Quarter Final Rounds would also take place on 14th May, 2024.
A. The teams will be provided their opponent’s memorial after the declaration of
preliminary results and the draw of lots for the Quarter Final Rounds
Final Round
a. Each side shall get a maximum time of 30minute stop resent their arguments of
which no Speaker shall be permitted to address the Court for more
than18minutes.
b. The time limits in collusive of the time for Rebuttal or Sur-rebuttal respectively.
c. The maximum time for Rebuttal is 2minutes and the maximum time for Sur-
rebuttal is 1 minute.
a. Eachsideshallgetamaximumtimeof45minutestopresenttheirarguments of
whichnoSpeakershallbepermittedtoaddresstheCourtformorethan25 minutes.
b. ThetimelimitisinclusiveofthetimeforRebuttalorSur-rebuttalrespectively.
c. The maximum time for Rebuttals 5 minutes and the maximum time for Sub-rebuttal Is
2minutes.
C. Final Round
a. The Maximum time for arguments presides all be the same as in the Semi- finals.
b. The winner of the Final Round shall be declared the Winner of the Competition.
1. Each team will get a total of 30 minutes to present its case. This includes the time for
rebuttal and sub-rebuttal.
2. The division of time per speaker is left to the discretion of the team.
3. The arguments should be confined to the issues presented in the memorial.
4. There searcher needs to be present with the speakers during all the rounds.
5. The researcher is allowed to pass chits to the speaker during the rounds.
7. Maximum scores for the court rounds will be100 marks per speaker. The court
rounds will be Judged on the following parameters:

DRESS CODE
1. Female(s): White Salwar and Kurta/White Shirt, Black Trouser and Black Tie
along with Black Blazer and Black Shoes.
2. Male(s): White Shirt and Black Trouser along with Black Tie, Black Blazer and
Black Shoe.
ANONYMITY
No coach or participant of any team at any time after the commencement of the competition, including
during registration, during the continuation of the competition and before its completion disclose the
identity of his/her college or institution under any circumstance in any manner including, but not limited
to, bearing any identifying items like clothing, ties, patches, pins etc.
Containing the name or logo of the college or Institution that he team is representing or disclosing the name of
the team members to the Judges during the competition. In the event, any such disclosure is made and this rule
is violated, the team shall be severely penalized and this may involve disqualification. The penalty to be
imposed shall be at the discretion of the organizing committee.
SCOUTING
No member of any participating team shall witness the arguments in any other court room in which the team
is not participating. In the event this rule is violated, the team shall be severely penalized and this may involve
disqualification. The penalty to be imposed shall be at the discretion of the organizing committee.

MOOT PROBLEM
Mr. Darsh, an Indian Resident, working as an employee with Swastika Bank, was happily living
with his family members in Punjab. In 2010, he moved to Canada and started working as a
consultant with Shine Consultancy Company. In April 2018, after obtaining a Permanent
Residency, he returned to India with the purpose of his marriage. In the same year, he made a
profile on a matrimonial site. After a month, he came across a profile of a girl named Aarushi,
with whom he had worked in Swastika Bank in 2009 for almost a year. He sent her a request, and
it was accepted by Aarushi on the other end. As they were already acquainted with each other. So,
they decided to get married in August 2018.
After their marriage, they went on their honeymoon to Maldives, where Mr. Darsh expressed his
sexual desires by hearing which Mrs. Aarushi felt uncomfortable. She said nothing at that point of
time by thinking that her husband might be joking. They both were living happily until one fine
day when one friend of Mr. Darsh i.e., Mr. Nakul visited their house to meet them and Mr. Darsh
asked her wife to spend some alone time with his friend. In the meanwhile, Mr. Nakulstarted
touching Mrs. Aarushi inappropriately. She kept silent and did not utter a word. After the said
incident dated 5th October 2018, Mr. Darsh and Mrs. Aarushi went outside to watch a movie and
have dinner. While having dinner Mr. Nakul also joined them and he accompanied them home.
On 5th October 2018, at 10:30 pm they entered the house along with Mr. Nakul, and both Mr.
Darsh and Mr. Nakul started touching Mrs. Aarushi without her consent. Mrs. Aarushi resisted at
first but due to the force of Mr. Daksh and Mr. Nakul, she felt helpless and could not do anything
except for lying on the bed.
Meanwhile, Mr. Darsh did not let Mrs. Aarushi meet her parents and siblings and he even asked
Mrs. Aarushi to put the phone on speaker mode whenever she tries to talk to her familymembers.
After few days again on 15th October 2018, Mr. Nakul visited the house in thepresence of Mr.
Darsh and had sex with Mrs. Aarushi. Mrs. Aarushi was mentally and physicallyassaulted and
devastated.
On 16th October 2018, Mrs. Aarushi without informing Mr. Darsh went to visit her parents and
did not return to her husband for two days. On 18th October 2018, Mrs. Aarushi went to meetMr.
Nakul at his place of residence. When she entered his house, she saw her husband andMr. Nakul
enjoying and drinking together. She stood still for 5 minutes. After that, there was a verbal
confrontation between them. She argued with her husband, she wanted all of this to stop, and
while they were arguing Mr. Nakul interfered. The atmosphere gets tensed and suddenly Mrs.
Aarushi grabbed a sharp knife and stabbed Mr. Nakul. Mr. Nakul died on the spot. An FIR was
filed against Mrs. Aarushi under Section 302 of IPC for murder and Mr. Darsh was charged under
Section 114 of IPC.
The High Court held Mrs. Aarushi guilty of murder under Section 302 of IPC. Now the case
lies before the Supreme Court of India.
Prepare memorials/ arguments for both Appellant and Respondent to present them before
the Moot Court.
