All that piece and parcel of land measuring an extent of 1206 sq.ft together
with terraced building and premises measuring an extent of 969 sq.ft situated
at bearing Door No.262, Thiruvalluvar Nagar, koththamangalam village &
panchayath, sakkottai union, karaikudi (Tk), Sivagangai District comprised in
Survey No.157/1 Part, New Survey No.351/18 within the limit of
koththamangalam Village and the land being bounded by
North by Ulaganathan manaiyidam
South by 7 feet way
East by Vellaichami s/o adaikkan manaiyidam
West by Padiyan ramaye manaiyidam

Brief History of the property and how the owner/ mortgagor has derived title.
It can be seen from above document that the said Naththam property as in new
Naththam S.no 351/2018 (old s.no.157/1part) , having an extent of 1206 sq ft in
koththamangalam villagr & group& panchayath limit, sakkottai union ,karaikudi
taluk and sivagangai district, was held by one Mr. Sevuhan under anupantham patta
in his favor and has enjoying the said property.
Thus while so , the said Mr. Sevuhan, reported as died early as on 18/09/1996
leaving behind his heirs Mrs Arayee and Mr Subramaniyan. The relevant death and
legal heirship certificate is perused.
The said deceased Mr. Sevuhan’s heirs Mrs Arayee and Subramaniyan, were jointly
claimed under inheritance from the said Mr sevuhan and they were jointy settled to in
favour of applicant Mr Ulagu for the subject property measuring an extent of 1206 sq
ft as in New Naththam S.no 351/2018 (old s.no.157/1part) by way of registered
settlement deed at karaikudi joint 1 sub register office , vide Doc No: 2001/2018, Dt
27/9/2018. This said settlement deed is perused.
As the absolute owner of the said property, Mr.S.Ulagu had borrowed loan from
Equitas small finance Bank Ltd.,by executing a Deed of Mortgage dated 29.11.2018
registered as Doc.No. 2408/2018 l…..pages …., in the Office of the Sub-Registrar,
Joint 1 karaikudi. The said mortgage had been subsequently discharged by a Receipt
dated 27.10.2023 registered as Doc.No. 3324/2023 of Book I in the Office of the
Sub-Registrar, joint 1 karaikudi.
The revenue record of Anupantham patta and naththam Patta @ Adankal are stand in
the name of applicant’s grandfather Mr. Sevuhan.
In respect of the said property the EB card, the receipts issued by the Tamil Nadu
Electricity Board and property House Tax receipts issued by the panchayath of
koththamangalam stands in the name of Mr.S.Ulagu.
All the Encumbrance Certificates have been perused and no encumbrance is found.
OPINION
On perusal of the documents produced, I am of the opinion that Mr.S.Ulagu S/o late
Mr.S.Subramaniyan is the absolute owner of the property under scrutiny and he has
got a good, valid and marketable title over the same.
