    Notes:
    • All prices shown are Vat- Exclusive
    • Monthly Charges: 5% YoY Escalation Rate starting
    on the 4th year of operations
    TERMS AND CONDITIONS
    a. Prices/rates are exclusive of 12% VAT.
    b. Commercial Offer is applicable on proposed 15- year contract duration.
    c. Monthly Charges: 5% YoY Escalation Rate starting on the 4th year of operations
    d. Any charges that may arise during the operations (customs inspection, customs fines, storage demurrage, etc.) shall
    be charged accordingly.
    e. Payment must be made to Airspeed within 30 calendar days from receipt of Airspeed Invoice/Bill
    f. Warehouse operating schedule: Monday to Saturday 0800H to 1700H
    g. Order cut-off time is 1500H for next day dispatch.
    h. For overtime work beyond the agreed operating schedule, falling on a night shift, holiday, rest day, the premiums
    below will apply on top of regular ad-hoc rates, subject to prior approval of Prime BMD before it is incurred. All
    premium based on DOLE requirements and Airspeed HR Policies.
    i. No liabilities shall be attached to Airspeed for delays in delivery, no-performance of service due but not limited to the
    following causes:
    i. Act of God or of competent government authorities
    ii. Fortuitous events
    iii.Strikes
    iv.Lock outs
    v. Force Majeure
    vi.Civil Disturbances and other similar causes
    j. Charges for out-of-scope service requirements (such as crating, kitting, promo-packing, etc.) and in excess of volume
    indications above shall be discussed and agreed separately.
    k. Contractor may request and Prime BMD shall, in good faith, consider any request for upward price adjustment due to
    increase of mandatory/regulatory wage and fuel.
    l. Rates can be reviewed after 3 months from go-live date
