Dear Mr. Clark:

The enclosed copy of the Hearing Committee Report in the above-referenced


matter is forwarded to you in accordance with § 9(a) of Rule XI of the Rules Governing
the Bar of the District of Columbia.

If you wish to file an objection to the findings or recommendation of the


Hearing Committee, please notify this office within ten days of receipt of this letter. In
your notice please specify whether your objection will be to the findings or the
recommended sanction or both.

If either party notes any objections, the Board will set dates for the submission
of briefs and oral argument before the Board. If neither the Respondent nor
Disciplinary Counsel objects to the findings or recommendations of the Hearing
Committee, the right to submit briefs and be heard in oral argument before the Board
will be deemed waived by both parties.

The Board may affirm or modify the recommendation of the Hearing


Committee. In the absence of an objection by Respondent or Disciplinary Counsel, the
Board will base its decision on the Hearing Committee Report and the available record.

The Board wishes to emphasize that it is not unusual for it to modify the
recommendation of the Hearing Committee and to recommend to the Court a more
severe discipline than that which was recommended by the Hearing Committee or
Disciplinary Counsel.
