TO THE HONORABLE THEODOR C. ALBERT, UNITED STATES BANKRUPTCY JUDGE AND ALL INTERESTED PARTIES: The Post-Confirmation Committee has reviewed and considered the motion filed by the Estate Representative on August 15, 2012 to make an interim distribution to creditors pursuant to the confirmed plan of reorganization and to increase the amount of professional fee reserve [Docket #936] (the Motion). Based upon that review, the Post-Confirmation Committee joins in and supports, as if fully set forth herein, the arguments and statements set forth in the Motion. The Post-Confirmation Committee joins in the Estate Representatives requests for an order: (1) authorizing the Estate Representative to increase the amount of the Administrative Reserve Fund by $150,000; (2) authorizing the Estate Representative to distribute up to $6.0 million of the approximately $6.7 million of Remaining Estate Funds at this time to holders of class 4 allowed claims and to the Senior Lenders on account of their class 5 allowed claim as set forth in the Motion; and (3) granting such other and further relief as the Court deems just and proper.
