PAY ANOMALY

PROCEEDINGS:-

The Andhra Pradesh State Electricity Board after careful consideration hereby
orders that where a Board servant holding a post in a substantive officiating or
temporary capacity, is promoted or appointed in a substantive, officiating or temporary
capacity to another post carrying higher duties and responsibilities than those carried by
the post held by him,, ,his initial pay in the time scale of the higher post shall be fixed at
a the stage next above the pay notionally arrived at by increasing his pay in respect of
the lower post by one increment at the stage at which such pay has accrued. This benefit
shall be admissible to all the Board servants who are promoted or appointed to the post
carrying the scale of Rs.1800-2500 and below.

2. To give effect to the decision mentioned above and in order to remove certain
anomalies, that may arise in the implementation of the decision, the following
notification amending the Andhra Pradesh State Electricity Board Service Regulations
Part-I is also issued.

NOTIFICATION

In exercise of the powers conferred by clause (c) of Section 79 of the Electricity


(Supply) Act, 1948 (Central Act LIV of 1948), the APSEB hereby issues the following
amendment to the APSEB Service Regulations Part-I issued in B.P.Ms.No.548, dt.21-8-
67 published at pages 63-134 of supplement to Part-II of the Andhra Pradesh Gazette
dt.28-3-1968.

AMENDMENT

In the said Regulations, after Regulation 30 the following regulation shall be


inserted namely:-

30-A. Notwithstanding anything contained in these Regulations, where a Board


servant holding a post in a substantive, officiating or temporary capacity is promoted or
appointed in a substantive, officiating or temporary capacity to another post carrying
duties and responsibilities of greater importance than those attaching to the post held by
him, his initial pay in the time scale of the higher post shall be fixed at the stage next
above the pay notionally, arrived at, by increasing his pay in respect of the lower post by
one increment at the stage at which such pay has accrued.

Provided that the provisions of this regulation shall only be applicable to all the
Board servants who are promoted or appointed to the posts carrying the scale of
Rs.1800-2500 and below.

Provided further that the provisions of Sub-Regulation (2) of Regulation-39 of


APSEB SRs Part-I shall not be applicable in any case where the initial pay is fixed under
this Regulation.

Provided also that where a Board servant is immediately before his promotion or
appointment to a higher post, drawing pay at the maximum of the time scale of the lower
post, his initial pay in the time scale of the higher post shall be fixed at the stage next
above the pay notionally arrived at by increasing his pay in respect of the lower post by
an amount equal to the last increment in the time scale of the lower post.

Provided that if a Board servant either:-


i) has previously held substantively or officiated in the same post, or
ii) a permanent or temporary post on the same time scale; or
iii) a permanent post, or a temporary post on the identical time scale then proviso to
Regulatin-30 shall apply in the matter of initial fixation of pay and counting of
previous service for increment.

INSTRUCTIONS

i) To safeguard the interests of a senior promoted before the introduction of the


new regulation, in relation to a junior promoted after the new regulation came
into existence, the APSEB has decided that in such cases, the pay of a senior
person promoted to the higher post before the date of this order, should be
stepped upto a figure equal to the pay as fixed for the junior in that higher post,
as a result of applicant of the new regulation. This will, however, be subject to
the following conditions viz.,

a) The stepping up should be done, with effect from the date of promotion
of fixation of pay of the junior official under the new regulation 30A of
APSAEB SRs Part-I.
b) Both the Junior and Senior officer should belong to the same cadre and
the posts to which they are promoted should be identical and in the same
cadre.
c) The scales of pay of the lower cadre and the higher posts in which they
are entitled to draw pay should be identical.
d) The anomaly should be directly a result of fixation of pay of the junior
person under the new regulation consequent on his promotion after the
date of this order. For example even in the former post, the junior person
draws from time to time a higher rate of pay under normal rules, or any
advance increments are granted to him, the pay of the senior person
promoted before the date of this order should not be stepped up.
e) The orders refixing the pay or the senior person shall be issued under
Regulation-34 of APSEB SRs Part-I.
f) The next increment of the senior person will be drawn from the date on
which it would have fallen due but for the stepping up of his pay under
this order.

ii) In some cases the pay of a junior person promoted to a higher post after accrual
of his increments in the lower post will be higher than his senior promoted before
accrual of his increment. It is therefore ordered that in case of promotion, the
option may be given to Board servants for fixation of pay on promotion as
under:-

a) either his initial pay may be fixed in the higher post on the basis of
Regulation-30A of APSEB SRs Part-I straight away without any further
review on accrual of increment in the pay scale of the lower post, or

b) his pay on promotion may be fixed initially in the manner as provided


under Regulation 30 (a) (i) of APSEB SRs Part-I which may be refixed
on the basis of the provisions of Regulation 30A of APSEB SRs Part-I on
the date of accrual of the next increment in the scale of pay or the lower
post.
If the pay is fixed under (b) above, the next date of increment will fall due on
completion of 12 months qualifying service from the date, the pay is fixed on the
second occasion.

Option may be given within one month of the date of promotion. Option once
exercised shall be final.

3. Where an employee, holding a special grade / special promotion post is promoted


to higher promotion post under the service rules applicable to the post held by him, the
provisions of Regulation 30A of APSEB SRs Part-I shall be applicable for fixation of
pay in the higher post if the conditions for application of this regulation are satisfied.

4. In the case of appointment to Special Grade posts or Special Promotion posts


there is no change in the duties and responsibilities. Therefore, in these cases pay shall
be fixed in the scale of pay applicable to Special Grade / Special Promotion post at the
stage next above the pay drawn in the post held prior to appointment to Special Grade /
Special Promotion post duly (i.e.,) under the provisions of Regulation 30 (a) (i) of
APSEB SRs Part-I as already ordered in B.P.Ms.No.652, dt.24-8-1982. The above
provisions of Regulation 30A of APSEB SRs Part-I shall not apply for fixation of pay
of promotion post/special adhoc promotion post.

5. The benefits under the above orders will come into effect from the date of issue
of this order.

Amendment issued in B.P.Ms.No.414, dated 11-5-1988.

AMENDMENT

In the APSEB SRs Part-I, the first proviso to regulation “30-A” shall be substituted
by the following viz.,

“Provided that the provisions of this regulation shall be applicable to all the
Board servants who are promoted or appointed to the posts governed by the
APSEB Service Regulations”.

The amendment was effective from 1-7-1986 with monetary benefit from the
date of issue of this order.

PROCEEDINGS:-

Instances have come to the notice of the Board that a Junior who is promoted to a
higher post after getting the benefit of appointment to Special Grade Post and Special
Promotion Post scales after completion of the required service is getting more pay than
his senior in the same category who got promotion to the higher post without being first
appointed to the said scales. To rectify the said anomaly, Government issued orders in
the G.O. fourth cited to step up the pay of the senior in such cases on par with the pay of
the junior. Representations have been received from the senior employees in such cases
for rectification of the anomaly.

2. After careful consideration, the APSEB directs that in cases of the type referred
to above the pay of the senior should be stepped up with effect from the date of
promotion of the junior to a figure equal to the pay fixed for the junior in the higher post
to which he is promoted on or after 1-4-1981 subject to the following conditions.

a) Both the senior and junior should have been drawing pay in an identical
scale.
b) The senior as well as the junior should be promoted to the same category of
post carrying the same scale of pay.
c) The pay of the junior in the lower category should have been less than or
equal to that of the senior in the lower category prior to promotion of the
senior to the higher post.

d) Once the pay of the senior is re-fixed on par with that of the junior in the
identical post carrying an identical scale of pay the next increment of the
senior will be admissible only after completion of the required period of
service to earn an increment with effect from the date of refixation of pay.
e) The anomaly should be directly as a result of the application of the orders
issued in B.Ps. read above, if not, for example, if even in the lower post the
junior was drawing more pay in the lower post than the senior for any reason
such as grant of advance increments for merit or as a reward (or Family
Planning incentive increments) or under some such circumstances there is no
case to raise the pay of the senior in the higher post to be equal to that of his
junior under these orders and therefore these orders would not be applicable
in such cases; and
f) In all cases affected by this order the pay shall be fixed notionally from the
date the junior got a pay higher than that of the senior in the higher post with
monetary benefit from 25-20-83.

PROCEEDINGS:-

In B.P.Ms.No.1032, dated 19-11-1984 SRs were amended based on certain


orders of Government laying down guidelines as to the fixation of pay of an employee
on promotion to a higher post. The amendment was made effective from the date of
issue of the said order, viz., 19-11-84. In the said amendment, the interests of a senior
promoted before the introduction of the new regulations, in relation to a junior promoted
after the new regulations came into existence, were protected. The said orders do not
provide for pay protection of these employees who were promoted on or after the
introduction of the new regulation as in the case of Government Orders. In order to
rectify this anomaly the Board has decided to amend the regulations suitably.

NOTIFICATION
In exercise of the powers conferred by clause (c) of Section 79 of the Electricity
(Supply) Act, 1948 (Central Act LIV of 1948), the APSEB hereby issues the following
amendment to the APSEB Service Regulations Part-I issued in B.P.Ms.No.548, dt.21-8-
67 published at pages 63-134 of supplement to Part-II of the Andhra Pradesh Gazette
dt.28-3-1968 and as subsequently amended.

AMEANDMENT

In Regulation 30A of the Said Regulating.

1) The existing instructions (i) and (ii) shall be renumbered as instructions (ii) and
(iii) and after they are so renumbered the following shall be inserted as instruction (i)
namely:-
i) “In order to remove the pay anomaly of a Board servant promoted or
appointed to a higher post on or after the date of instruction of new
regulations, namely 19th November, 1984 and drawing a lower rate of pay
in that post than another Board servant junior to him in the lower grade
and promoted or appointed subsequently to another identical post, the

APSEB has decided that in such cases, the pay of the senior Board
servant should be stepped up in the higher post to a figure equal to the
pay fixed for the junior Board servant in that higher post. The stepping
up should be done with effect from the date of promotion or appointment
of the junior and shall be subject to the conditions mentioned in
instruction (ii) below”.

2) In condition (f) of the renumbered instruction (ii) the following sentence shall be
added at the end:-

“In cases coming under instruction (i) the next increment of the senior officer
shall be drawn on completion of the requisite qualifying service with effect from the date
of refixation of pay”.

2. These orders shall be deemed to have come into effect from 19 th November,
1984, the date on which new regulation 30-A was issued.

In the B.Ps. first to third cited above, Board had introduced the Automatic
Advancement Scheme of S.G.P. of 10 years and S.P.P.I/S.A.P.P.-I of 15 years with
effect from 1-4-81 based on the Government Orders issued in G.O.Ms.No.117, F&P
(F.W.PC-I) Dept., dt.25-5-81.

2. After the issue of these orders, an anomaly of senior drawing less pay than his
junior arose in cases where the senior was promoted to the next higher category without
getting the benefit of 10/15 years while the junior was promoted after getting the benefit
of 10/15 years scales. In the B.P. fifth cited orders were issued based on
G.O.Ms.No.297 F&P Dept., dt.25-20-83sfor stepping up of pay of the senior on par
with the junior subject to certain conditions as laid down therein.

3. In the B.P. fourth cited, orders were issue dbased on orders of Govt. in
G.O.Ms.No.2 F&P, dt.4-1-88 revising the Automatic Advancement Scheme by allowing
second level promotion post scale to the Board employees on their completion of 22
years of service with effect from 1-7-86.

4. After issue of these above orders, the anomaly of junior drawing more pay than
the seniors that too on a higher scale arose again. In G.O.(P) No.75, F&P (F.W.PC-II)
Dept., dt.22-2-94 read with G.O.Ms.No.84, F&P(F.S.PC-II) Dept. dt.2-3-94 orders were
issued by the Government stepping up the pay of senior on par with the pay of the junior
subject to certain conditions as laid down therein.

5. After careful consideration the APSEB hereby directs that


i) Seniors who were on promotion to the next higher post in the regular line on
the date on which the juniors were appointed to the S.P.P.-II shall be entitled
to the SPP-II scale from the date on which the juniors were appointed to SPP
scale-II. They shall also be entitled to have their pay fixed from the date in
the SPP-II scale in terms of APSEB SRs 30(a)(i) read with SR 39(2).
ii) Even after fixing the pay as per para (i) above in the SPP scale-II if the pay of
the junior happens to be more than the pay of the senior, the pay of the senior

shall be stepped upto the pay of the junior from the date from which the pay
of the junior was more.

6. The orders in para-5 above are subject to the following conditions:-


a) The senior should have put in 22 years of incremental service (both
lower as well as officiating put together) by the date from which the
junior was appointed to SPP-II scale.
b) That both the junior and senior should belong to the same category in
the lower post, and that both should have drawn pay in the same time
scale, before the senior was promoted. These orders are not
applicable to the seniors who are appointed by direct recruitment to
higher post.
c) That the pay of the junior in the lower category should have been
equal or less than that of his senior prior to the promotion of senior to
that of first level promotion post.
d) The anomaly should have arisen directly as a result of the application
of the orders issued in B.P. 4th cited.

7. After stepping up of the pay as ordered above, the next increment of the senior
shall be admissible only after completion of the required period of service from the date
of fixation of pay ordered in para 5 & 6 above.

8. Provided that if the junior gets the benefit of refixation of pay under APSEB SRs
39(2) earlier, than the date of increment the pay of the senior shall again stepped up to
that of the junior.

9. These orders shall be applicable to the cases that arose with effect from 1-7-86.

10. These orders are issued with the concurrence of Member (Accounts)

ORDER:

The erstwhile APSEB has introduced Master Scale with effect from
1-4-1998 with monetary benefit from 1-7-1998, while revising the pay scales of
workmen and other than workmen in the B.Ps. first and second cited
respectively.

2. Instances have come to the notice of APTRANSCO that where some of


the seniors who got first promotion before introduction of master scale i.e., prior
to 1-4-1998 and got second promotion after introduction of master scale,
happened to draw less pay than the junior who got two promotions after
introduction of master scale. To safeguard the interest of senior promoted
before the introduction of Master Scale i.e., from 1-4-1998 and to remove the
pay anomaly of the above nature the following orders are issued;.

3. The pay of a senior employee promoted to the higher post/s before the
date of this order, should be stepped up to a figure equal to the pay as fixed for
the junior employee in that higher post/s as a result of introduction of master
scale. This will, however, be subject to the following conditions:-

(a) The stepping up should be done with effect from the date of
fixation of pay of the junior employee at a stage above the pay
drawn by the senior employee after introduction of master scale.
(b) Both the junior and senior should belong to the same cadre and
the posts to which they are promoted should be identical and in the
same cadre.
(c) The scale of pay of the lower and the higher post/s in which they
are appointed should be identical.
(d) The anomaly should be directly as a result of fixation of pay of the
junior employee consequent on his promotion after introduction of
Master Scale with effect from 1-4-1998. For example, if even in

the former post the junior employee draws, from time to time a
higher rate of pay under normal rules or any advance increments
are granted to him, the pay of the senior employee promoted
before the date of introduction of Master Scale should not be
stepped up.
(e) The promotions shall not have been ordered relaxing the
qualifications or under unqualified quota.
(f) The orders refixing the pay of the senior employee shall be issued
under Regulation 34 of APSEB Service Regulations Part-I as
adopted by APTRANSCO and Discoms.
(g) The next increment of the senior employee shall accrue only after
completion of one year qualifying service with effect from the date
of refixation of pay.

4. These orders shall be deemed to have come into effect from 1-4-1998
with monetary benefit from 1-7-1998 i.e., the date from which the Master Scale
was introduced.

5. These orders are issued with the concurrence of Director (Finance &
Revenue) vide U.O.No.1, dt.1-1-2004.

A Brief Note on Rectification of Pay Anomalies

Sometimes it so happens that the junior draws higher pay than that of senior.
This situation of drawing higher pay by the junior than that of the senior pay is called as
Pay Anomaly. There are normally Four types of pay anomaly cases.

CASE-I

Where a junior draws a higher pay that the senior consequent to fixation of his
pay in the promoted cadre under Regulation 30(A) of APSEB Service Regulations
Part –I. (Under which, pay of a promotee is fixed at the stage next above the pay
notionally arrived at, by increasing his pay in respect of the lower post by one increment
at the stage at which such pay has accrued).
Such cases are resolved in terms of orders issued in B.P.Ms.No.197, dt.09-07-1992
read with B.P. Ms. No 1032 Dt 09-11-1984.
CASE –II

(a) Where a junior, who is promoted to higher post after getting the benefit of
appointment to Special Grades scale and Special Promotion post scale, is getting
more pay than his senior in the same category who got promotion to the higher
post without being first appointed to the said scales under Automatic
Advancement Scheme.
Such cases are resolved in terms of orders issued in B.P. Ms. No 426, dt.15-01-1991.

(b) Where the anomaly arises as result of promotion to the 1 st level of promotion by
the junior who has already availed SPP-II Scales benefit under the Automatic
Advancement Scheme and the senior draws lesser pay in the 1 st level promotion
without being able to enjoy the benefit of SPP-II Scales.
Such cases are resolved in terms of orders issued in B.P. Ms. No 117, dt. 09-07-92.

CASE –III

Where the junior happens to draw a higher rate of Pay than the Senior earlier
than the senior as result of an earlier date of increment than that of the senior; this
situation arises when the pay of both the Junior and the Senior is fixed at the same
stage by virtue of application of principles of Fixation of Pay in the Revised Scale of
Pay and the date of accrual of Annual Grade Increment of the Junior happens to be
earlier than the date of accrual of AGI of the senior.

Such cases are resolved in the light of clarifications issued to the orders of the
Revised Pay Scales or further clarifications issued in continuation to those
orders.

Case-IV

The erstwhile APSEB has introduced Master Scale with effect from 1-4-1998
with monetary benefit from 1-7-1998. After introduction of Master Scales,
some of the seniors who got first promotion before introduction of master
scale i.e., prior to 1-4-1998 and got second promotion after introduction of
master scale, happened to draw less pay than the junior who got two
promotions after introduction of master scale.

To safeguard the interest of senior promoted before the introduction of


Master Scale i.e., from 1-4-1998 and to remove the pay anomaly of the
above nature, the anomaly was resolved by issuing in T.O.O.(CGM-
HRD&TRG) Per.Ms.No.235, dt.17-1-2004.

Stepping up of pay of the senior on par with the pay of the junior from the date
from which the junior’s pay exceeds the pay of the senior is done subject to the
following conditions.
Case-I

a) The stepping up should be done with effect from the date of promotion , or
fixation of pay of the junior official under the new regulation 30-A of APSEB
Service Regulations part –I
b) Both the junior and senior officer should belong to the same cadre and the post to
which they are promoted should be identical and in the same cadre.
c) The scale of pay of the lower and the higher posts in which they are entitled draw
pay should be identical.
d) The anomaly should be directly a result of fixation of pay of the junior person
under the new regulation consequent on his promotion after 19-11-1984 for
example if even in the former post, the junior person draws, from time to time a
higher rate of pay under normal rules, or any advance increments are granted to
him, the pay of the senior person promoted before 19-11-1984, should not be
stepped up.
e) The next increment of the senior officer shall be drawn on completion of
requisite qualifying service with effect from the date of re-fixing of pay.

CASE-II
(A)

a) Both the senior as well as the junior should be promoted to the same category of
post carrying the same scale of pay ;
b) The senior as well as the junior should be promoted to the same category of post
carrying the same scale of pay

c) The pay of the junior in the lower category should have been less than or equal to
senior in the lower category prior to promotion of the senior to the higher post.
d) Once the pay of the senior is re-fixed on par with that of the junior in the
identical post carrying identical scale of pay, the next increment of the senior will
be admissible only after completion of the required period of service to earn an
increment with effect from the date of re-fixation of pay.
e) The anomaly should be directly as a result of the application of the orders issued
in the B.P .Ms. No. 652 Dt 24-08-1982.if not for example if even in the lower
post, the junior was drawing more pay than the senior for any reason, such as
grant of advance increment for merit or as a reward (or Family Planning
INCENTIVE Increments ) or under some such circumstances, there is no
case to raise the pay of the senior in the higher post to be equal to that of his
junior under these orders ; and therefore these orders would not be
applicable in such cases; and
f) In all cases effected by the said orders, the pay shall be fixed notionally from the
date the junior got a pay higher than the senior in the higher post with monetary
benefit from the 25-10-1983.
CASE –II
(B)

i.. Seniors who were on promotion to the next line of the date on which the juniors
were appointed to SPP-II shall be entitled to the SPP-II scale from the date on
which the juniors were appointed to SPP-II scale they shall also be entitled to have
their pay fixed from the date in the SPP-II scale in the terms of APSEB Service
Regulations 30(a)(i) read with Service Regulations 39(2) of the APSEB
Regulations part I.

ii. Even after fixing the pay as per Para (i) above in the SPP-II scale, if the pay of the
junior happens to be more than the pay of the senior, the pay of the senior hall be
stepped up to the pay of the junior from the date from which the pay of the junior
was more.

The above orders are subject to the following conditions.

a) The senior should have put in 22 years of incremental service (both lower as well
as officiating put together) by the date from which junior was appointed to
SPP-II.
b) That both the junior and senior should belong to the same category in the lower
post, and that both should have drawn pay in the same time scale, before the
senior was promoted. These orders are not applicable to the seniors who are
appointed by direct recruitment to higher post.
c) That the pay of the junior in the lower category should have been equal or less
than that of his senior prior to the promotion of senior to that of 1 st level
promotion post.
d) The anomaly should have arisen directly as a result of the application of the
orders issued in B.P. Ms. No. 927, dated 27-9-1988. (which deals with the
extension of Automatic Advancement Scheme to the Revised pay scales of
1-7-1986, which were originally issued in B.P. Ms. No. 652,
dated 24-08-1982)
e) After stepping up of the pay as ordered above, the next increment of the senior
shall be admissible only after completion of the required period of service from
the date of fixation of pay ordered above.
f) Provided that if the junior gets the benefit of re-fixation of pay under Regulation
39(2) of APSEB Service Regulations Part –I earlier than the date of increment
the pay of the senior shall again be stepped up to that of the junior.

The above orders have come into force from 01-07-1986.

Case –III

Guidelines will be issued for rectification of pay Anomaly after each Revised Pay
Scales introduction in order to pre-pone (Advance) the increment subject to
following;

“Provided that in case of an employee whose pay in revised pay scales is fixed for
another employee junior to him in the same cadre and drawing pay at a lower stage
than his senior in the existing scale of pay or drawing pay at a lower stage as that of
his junior in existing scale of pay prior to the date, the next increment shall be
deemed to have accrued on the same date as admissible to his junior, if the date of
increment of the junior is earlier

Case-IV

To safeguard the interest of senior promoted before the introduction of


Master Scale i.e., from 1-4-1998 and to remove the pay anomaly of the
above nature, the anomaly was resolved by issuing in T.O.O.(CGM-
HRD&TRG) Per.Ms.No.235, dt.17-1-2004.

The pay of a senior employee promoted to the higher post/s before the
date of this order, should be stepped up to a figure equal to the pay as
fixed for the junior employee in that higher post/s as a result of
introduction of master scale. This will, however, be subject to the
following conditions:-

(h) The stepping up should be done with effect from the date of
fixation of pay of the junior employee at a stage above the pay
drawn by the senior employee after introduction of master scale.
(i) Both the junior and senior should belong to the same cadre and
the posts to which they are promoted should be identical and in the
same cadre.
(j) The scale of pay of the lower and the higher post/s in which they
are appointed should be identical.
(k) The anomaly should be directly as a result of fixation of pay of the
junior employee consequent on his promotion after introduction of
Master Scale with effect from 1-4-1998. For example, if even in
the former post the junior employee draws, from time to time a
higher rate of pay under normal rules or any advance increments
are granted to him, the pay of the senior employee promoted
before the date of introduction of Master Scale should not be
stepped up.
(l) The promotions shall not have been ordered relaxing the
qualifications or under unqualified quota.
(m) The orders refixing the pay of the senior employee shall be issued
under Regulation 34 of APSEB Service Regulations Part-I as
adopted by APTRANSCO and Discoms.
(n) The next increment of the senior employee shall accrue only after
completion of one year qualifying service with effect from the date
of refixation of pay.
