Hereinafter called the ‘PURCHASER’ (which terms wherever the context so
admits shall mean and include her legal heirs, legal representatives, executors, and
assigns) of the other Part, WITNESSETH AS FOLLOWS:-
WITNESSETH AS FOLLOWS:
WHEREAS all that piece and parcel of land bearing Sy. No. 71/2 and
Sy.No.101/2B, situated at VALAGERAHALLI VILLAGE, Kengeri Hobli,
Bangalore South Taluk, Bangalore, in all measuring 17949.12 square meters
(Seventeen thousand Nine hundred and forty nine point one two square meters),
consisting of 415 units of 3BHK apartments constructed in conglomerate blocks
B1, B2, B3, B4 and B5 is more fully and particularly described in Schedule 'A'
hereunder written and hereinafter referred to as the 'SCHEDULE 'A'
PROPERTY;
WHEREAS, the Vendor is the absolute owner of a 3BHK
APARTMENT bearing No. B5-1205, situated on the 12th (Twelve) Floor of
Block B-5, consisting of a super built up area of 132.90 (one hundred and
thirty two point nine zero) square meters, which is inclusive of proportionate
share in the common areas, staircase, lifts, and passages etc., along with one
reserved car park bearing No.B5-158 in the basement of the multistoried
building constructed on the schedule 'A' property situated at
VALAGERAHALLI BADAVANE, Stage 5, Kengeri Hobli, Bangalore-

- together with an undivided 43.25 (forty three point two five) square
meters of share, right, title and interest in the land comprised in the
schedule 'A' property, which is more fully described the schedule "B" and
Schedule "C" hereunder, hereinafter referred to as SCHEDULE "B"
PROPERTY and SCHEDULE "C" PROPERTY.

Whereas the Bangalore Development Authority has considered the


request of the said Mr. S.SRINIVASA @ SRINIVAS SANJEEVA and as per
the board Resolution No.110/13, dated: 24.08.2013, of BDA, the board has
taken decision to allot an aforesaid site to the said Vendor. Whereas the
Bangalore Development Authority represented by its Deputy Secretary has
issued letter of allotment, in favour of Vendor, vide No.
¨ÉA.C.¥Áæ/DqÀ½vÀ «¨sÁUÀ/ªÀ®UÉÃgÀºÀ½î/B5-1205/2017-18,
dated: 30-08-2017.

WHEREAS, the SCHEDULE "B" PROPERTY and SCHEDULE "C"


PROPERTY is Vendor's self acquired property, and whereas the manner in
which the Vendor has acquired the SCHEDULE "B" PROPERTY

- and SCHEDULE "C" PROPERTY is described in detail in the registered
sale deed dated 17-06-2019, registered as document No.BDA-1-
01349/2019- 20 of Book-l, stored in CD No. BDAD359 in the office of the
Additional Sub-registrar, Bangalore Urban District, Bangalore, having
acquired the same from Bangalore Development Authority, Bangalore,
represented by Assistant Commissioner (Flat Allotment Division). Since a
clear copy of the said Sale Deed is provided to the Purchaser, the details
contained in the Sale Deed are not repeated in this Deed.

Whereas the Bangalore Development Authority, Flat Allotment Division,


represented by its Deputy Secretary has signed and issued a Possession
Certificate of Flat, vide Application No.BD801S190000548, in favour of
Vendor, dated: 25-10-2019.

Whereas the schedule property based on the seniority of the parking area
allotted by the Bangalore Development authority Allotment, in favour of

Mr.S.SRINIVASA @ SRINIVAS SANJEEVA, through Allotment Letter, vide

No.©rJ/EE/ºÉZï.¦.r.-1/48/2019-2020, dated: 18-11-2019.

Whereas the BDA represented by its Deputy Secretary executed, in favour
of Mr. S. SRINIVASA @ SRINIVAS SANJEEVA (Vendor herein) through an
Based on the Seniority of the parking area Absolute Sale Deed, vide
Registered as document No.BDA-1-01015/2024-25 of Book-I, dated:
05-07-2004, registered in the office of the Additional District Registrar, BDA,
Bangalore District.

Whereas the VENDOR herein has obtained the Digital Katha Certificate
of the schedule property, vide its Application No.BD007S240003355, dated:
06-07-2024, PID No.6000076947, issued by Revenue Officer, West Division,
BDA Bangalore. Thus the Vendor is enjoying the schedule ‘D’ property
peacefully without any litigation’s etc., by paying the taxes, etc., to the
concerned authority.

And whereas the Vendor for want of funds to meet his legal necessities
agreed to sell APARTMENT bearing No. B5-1205, situated on the 12th (Twelve)
Floor of Block B-5, consisting of a super built up area of 132.90 (One Hundred
and Thirty Two Point Nine Zero) square meters, which is inclusive of
proportionate share in the common areas, staircase, lifts, passages, etc., along with
ONE RESERVED CAR PARK BEARING NO.B5-158 IN THE STILT of the
multistoried building constructed on the schedule 'B & C' property , in favour of the
purchaser, for a adequate sale consideration sum of Rs.76,00,000/- (Rupees
Seventy Six Lakhs only) free from all kinds of encumbrances & litigation and
the purchaser having agreed to purchase the same has paid the sale consideration
by the following manner to the vendor before the following witnesses.

1. Rs.8,00,000-00 (Eight Lakhs Only) by way of D.D bearing No.333301,

2. Rs.67,24,000/- (Rupees Sixty Seven Lakhs Twenty Four Thousand
Only) being the Loan Amount Sanctioned by Canara Bank Bangalore, to
the Purchaser and paid by their Demand Draft bearing No.470695,
Dated:19-10-2024, Drawn on Canara Bank, Jayanagar Shopping Complex
Branch, Bangalore, in favour of the Vendor at the request and
authorization of the Purchaser and paid on this day to the Vendor at the
time of Registration of this Absolute Sale Deed.

3. Rs.76,000/- (Rupees Seventy Six Thousand only) paid towards TDS of


the schedule property by the Purchaser on behalf of the Vendor, dated:
20-10-2024, vide BSR Code: 0200005, Challan No.00322.

NOW THIS DEED OF ABSOLUTE SALE WITNESSETH AS
FOLLOWS:-
1. The Vendor does hereby assure and covenant with the purchaser that the
purchaser may at any time and it all times hereafter peace fully own,
possess and enjoy the schedule 'B & C' Property and the yield there of,
without any let, objection, obstruction, hindrance or disturbances
whatsoever from or by the vendor or any person claiming through his or
through him the vendor and that the purchaser shall be empowered to
possess and enjoy the schedule 'B & C' Property.
2. The vendor particularly does hereby covenant and agree with the
Purchaser to save harmless and indemnify the purchaser against all losses
or damages which the purchaser might sustain or incur in respect of any
encumbrances made by the vendor.
3. The vendor hereby assures the purchaser, that all taxes/cesses have been
paid by the vendor to the concerned authorities in respect of the schedule
'B & C' property up-to-date and registration of this sale deed.

4. The vendor does hereby covenant with the purchaser that he has not done
or knowingly suffered or been a party to any act where by the schedule 'B
& C' Property hereby conveyed is or maybe encumbered in title, estate or
otherwise however or whereby he is prevented from conveying the
Schedule 'B & C' Property or any part there of in the manner herein before
appearing.
5. The Vendor further covenants and declares that the schedule 'B & C'
property is free from all encumbrances, charges, claims, litigation’s and
demands and that vendor has not done anything whereby the schedule 'B
& C' property may be subjected to any court, attachment or any lien of any
court or person whatsoever and that there are no minor’s claim or claims
of any other person of persons whatsoever.
6. The purchaser shall from this day pay all taxex / cesses/ charges including
the payment of property tax in respect of the schedule 'B & C' property to
the Jurisdictional Group Panchayat/Bangalore Development Authority/
City municipal Council and obtain the transfer or katha of the schedule
C' property in his name at his cost and expenses with the jurisdictional
Group Panchayat/Bangalore Development Authority/City Municipal
Council.

7. The Vendor does hereby covenant that he will at all time in future execute
every lawful deeds, assurances or things as shall or reasonably required
for further and more perfectly assuring the schedule 'B & C' property to
the purchaser. The purchaser has agreed to the condition hereunder
mentioned schedule A, 'B & C'.
8. The vendor shall deliver actual, physical, vacant possession of the
Scheduled property in favour of the purchaser at the time of registration of
the sale deed.
9. That the Vendor has ‘NO OBJECTION’, for the competent authority, to
transfer the Katha etc., of the Schedule 'B & C' Property in favour of the
Purchaser at Purchaser’s cost and expenses.
10.That the vendor further assures that there are no claims of whatsoever
nature on the Schedule 'B & C' Property.
Whereas the Vendor is the absolute owner of the bearing APARTMENT
bearing No. B5-1205, situated on the 12th (Twelve) Floor of Block B-5, consisting
of a super built up area of 132.90 (one hundred and thirty two point nine zero)
square meters, which is inclusive of proportionate share in the common areas,
staircase, lifts, passages, etc., along with ONE RESERVED CAR PARK BEARING
NO.B5-158 IN THE BASEMENT, more fully described in the Schedule
hereunder and herein after referred to as the SCHEDULE “B” PROPERTY
and having purchased the same under the Sub-Registrar.

conglomerate BLOCKS B1, B2, B3, B4 and B5 by BDA Flat Division, and

SCHEDULE "B" PROPERTY


An undivided share, right, title and interest of 43.25 (forty three point
two five) square meters allocated to each apartment in the land comprised in the
schedule 'A' property.
