That the Ld. CMM court failed to appreciate the order/Judgment
of the Supreme Court titled as “MUKESH KISHANPURIA Vs.
STATE”, where it has been categorically stated that “We have
made it clear on a number of occasions that the power to grant
regular bail includes the power to grant interim bail pending final
disposal of the regular bail application.”

3. That thereafter, on 07.03.2024 the interim bail of the petitioner

has been dismissed by Ld. Session Court, North, Rohini Courts.
(Copy of the reply of Io and dismissal order dated 07.03.2024
passed by Ld. Session Court, North, Rohini Courts is annexed
herewith as Annexure-P3(Colly).

4. That the petitioner is a father of two sons, one of them is a

differently abled child and another one is aged 3.5 years old. He
also has a 17-year-old daughter. Copies of the Date of Birth
certificate of the son and the Aadhar card of his daughter is
annexed herewith as Annexure-P4 (Colly)

5. That the education of the petitioner’s son and daughter is

seriously prejudiced because of the custody of their
father/petitioner.

6. That the petitioner is the sole bread earner of his family and
apart from the petitioner there is no one else in the family who
may arrange funds for the education of his child and daughter.
