    No. RTE-2018/C.R.135/S.D.-1.-ln exercise of the powers conferred by sub-sections (/) and (4 ot
    section 38 of the Right of Children to Free and Compulsory Education Act, 2009 (35 of 2009), and of all
    other powers enabling it in that behalf, the Government of Maharashtra herby makes the following rules
    further to amend the Maharashtra Right of Children to Free and Compulsory Education (Manner of admission
    of Minimum 25% children in Class-l or Pre-school at the entry level for the children belonging to
    disadvantaged group and weaker section) Rules, 2013 as follows, namely :-
    1. These rules may be called the Maharashtra Right of Children to Free and Compulsory Education
    (Manner of admission of Minimum 25"/o children in Class-l or Pre-school at the entry level for the children
    belonging to disadvantaged group andweaker section) Amendment Rules, 2018.
    2. ln Rule 2 of the Maharashtra Right of Children to Free and Compulsory Education (Manner of
    admission of Minimum 25% children in Class-l or Pre-school at the entry level for the children belonging to
    disadvantaged group and weaker section) Rules, 2013,-
    (1)foiclause(b),thefollowingclauseshallbesubstituted,namely:-
    "(b) "child belonging to disadvantaged group" means a child belonging to,-
    (0 Schedule Castes,
    (il Schedule Tribes,
    (iil De-notified Tribes (A),
    (iv) Nomadic Tribes (B),
    (v) Nomadic Tribes(C),
    (vD Nomadic Tribes (D),
    (vii) Other Backward Classes (OBC),
    (viii) Special Backward Classes (SBC),
    (ix) Child with disability,
    (x) Child living with HIV or affected by HlV.
    Explanation;-For the purpose of sub-clause (x), the expression "child with disability" means
    the child as defined in sub-clause r and s of section 2 of the Rights of Persons with Disabilities Act,
    2016 (49 of 2016) ".
    (21tor clause (c), the following clause shall be substituted, namely :-
    "(c) "child belonging to weaker section" means the child of such parent or guardian,
    whose annual income is below one lakh rupees ".
