    AFFIDAVIT OF WITNESS

    I, Nickanor S. Balagan, 44 years of age, married, resident of Purok 6 Brgy.


    Centro 1, Mallig Isabela, after having sworn in accordance with law, do hereby depose
    and state THAT:

    01. I was present and personally saw that accused, Ruperto Aller Jr. , Alyas
    Totoy and the police officer PO1 Chester Viloria (disguise as a poseur buyer), doing a
    drug transaction;

    02. I am an elected councilor in barangay centro 1 mallig isabela. larry abad is


    a young man who always hangs out at your place. He is also on the drugs watchlist of
    our barangay because someone told us in the last few months that there is an illegal
    drug sale going on in our barangay;

    03. I just went home from work on or about 9:45 pm, upon entering my house,
    I saw David having drinks with the two accused in front of his house and I just assumed
    that they were having a great time chatting and laughing. On or about 2:00 am I woke
    up to them shouting at each other, breaking bottles and having arguments.

    I executed this affidavit to attest the truthfulness of the foregoing facts and to
    support the filing of Criminal Cases against __ Ruperto Aller Jr. and Kenneth Busa __
    for violations of _______Murder________.

    AFFIDAVIT OF VIDEOGRAPHER

    I, Nikolayds J. Nadal, married of legal age, Filipino and a bonafide member of the
    Philippine Drug Enforcement Agency (PDEA) and presently assigned at PDEA
    Zambales Provincial Office with an office address at Sta. Rita High School, Barangay
    Sta. Rita, Olongapo City after having been duly sworn to in accordance with law, do
    hereby depose and say the following, to wit:

    01. That I am a member of the composing operatives of PDEA Zambales


    Provincial Office led by Agent Mar Roxas under the direct supervision of Director Joyce
    Virhen, OIC Provincial Director, PDEA Zambales Provincial Office, conducted crime
    scene investigation at Palenzuela St. Baloy Long Beach Brgy. Barreto, Olongapo city
    on the stabbing incident of David Michael Light.

    02. That I used Nikon digital camera.

    03. That I took picture and videos of markings at the crime scene and physical
    inventory of the possible murder weapon and signing of the Certificate of Inventory I the
    presence of witness elected official representative Bong Gogogo and media
    representative Mr. Hendry Gabi, said witnesses also signed the Certificate of Inventory.

    04. That I am executing this affidavit to attest to the veracity and truthfulness
    of the foregoing and whatever legal purpose this may serve.
