CRIMINAL COMPLAINT

The undersigned Investigator of the Quezon

Municipal Police Station, located at Barangay Berong,
Quezon, Palawan, under oath, accuses Jose Ngilay, a
resident of Barangay San Isidro, Quezon, Palawan, of the
crime of "Homicide," defined and penalized under the
Revised Penal Code, Article 249, committed as follows:

That on the 31st day of August 2021, at about

10:42 PM, inside the J One Bar, located in Barangay
Berong, Quezon, Palawan, and within the jurisdiction of this
Honorable Court, the above-named respondent, with intent
to kill, did then and there unlawfully attack and cause the
death of Roberto Dimaguiba by inflicting fatal injuries,

thereby resulting in the victim being found lying on the floor
of the restroom covered with blood.

The circumstances of the incident are as follows:

1. The accused, Jose Ngilay, was involved in an

altercation initiated by Roberto Dimaguiba, who was
reportedly rude and arrogant.
2. Witness Reshia Mae Namia observed that on the
aforementioned date, while the victim and his
companions were drinking, a confrontation ensued that
led to a violent encounter.
3. Shortly after the incident, the victim was discovered by
witness Zai Manalo, who called for help upon seeing
the victim’s lifeless body.

AFFIDAVIT OF VICTIM

I, Reshia Mae Namia, of legal age, single, and residing at

Barangay Berong, Quezon, Palawan, after having been duly
sworn in accordance with law, depose and state:

1. I am currently employed as a bouncer at J One Bar,

located in Barangay Berong, Quezon, Palawan;

2. That on August 31, 2021, at around 10:42 PM, I was on

duty at J One Bar;

3. During this time, I witnessed an altercation between

the victim, Roberto Dimaguiba, and the accused, Jose
Ngilay;

4. The altercation began when Roberto Dimaguiba, who

was visibly intoxicated, started to act rude and
aggressive towards Jose Ngilay and his companions;

5. A confrontation ensued between the two, which

escalated into a violent encounter;

6. I attempted to intervene, but the situation quickly

escalated, and shortly after, I lost sight of both
individuals;

 7. Moments later, I was informed by another customer,
Zai Manalo, that Roberto Dimaguiba was found
unconscious and severely injured inside the restroom;

8. Upon arriving at the scene, I saw Roberto Dimaguiba

lying on the floor, covered in blood;

9. The authorities were immediately notified, and the

victim was later pronounced dead;

I am willing to cooperate fully with the investigation and

any legal proceedings.

AFFIDAVIT OF WITNESS

I, Reshia Mae Namia, 21, single, and a resident of

Berong, Quezon, Palawan, after having sworn in accordance
with the law, do hereby depose and state THAT:

1. I have worked as a bouncer at the J One Bar for four

(4) years, since 2020;

2. I do not know personally the deceased, but I always

see him because he is a regular customer at the J One
Bar;

3. There were many reports and complaints about the

deceased’s arrogance and rudeness;

 4. On August 31, 2021, Zai Manalo, Ray Ansiong, and
Roberto Dimaguiba were drinking at the same table
when Jose Ngilay was passing through when Roberto
touched his behind that made him lose his balance and
spilled some of the contents of the bottles of beer onto
Roberto, I saw it because I was monitoring the
customers inside the bar, Ray on the other hand yelled,
‘Bastos ka ha!’ that caught the attention of the other
customers. Before it turned into a commotion, I
decided to go to them. However, Ray left and ignored
what was happening and I saw him proceed to his
table. Upon seeing this, I decided not to continue my
plan and went to the Bar’s door entrance to exchange
duty with my co-bouncer;
5. At 10: 54, I saw Ray outside the bar, talking on the
phone. He stays there for about six (6) minutes and a
White Toyota Vios fetch him;

6. At 10:42 pm, Zai yelled for help upon seeing Roberto’s

body lying on the floor covered with blood inside the
restroom and I was one of the bar staff who helped
him.

I executed this affidavit to attest truthfulness of the

foregoing facts and to support the filing of Criminal Case of
Homicide against Jose Ngilay, the suspect.

JOINT AFFIDAVIT OF ARREST

We, PCMS Reynaldo L. Gomez and PSSg Enrico J. Ramos, of

legal age, both assigned to the Quezon Municipal Police
Station, after having been duly sworn in accordance with
law, depose and state:

1. On August 31, 2021, at approximately 10:42 PM, we

received a report of a violent altercation at J One Bar,
located in Barangay Berong, Quezon, Palawan;

 2. Upon arriving at the scene, we found the victim,
Roberto Dimaguiba, lying unconscious inside the
restroom, severely injured and covered in blood;

3. Witnesses at the scene, including Reshia Mae Namia, a

bouncer employed at J One Bar, and Zai Manalo, a
customer, provided us with statements indicating that
a confrontation occurred between the victim, Roberto
Dimaguiba, and the suspect, Jose Ngilay;

4. The altercation reportedly escalated into a violent

encounter, which led to the severe injuries of Roberto
Dimaguiba, who was later pronounced dead by
responding medical personnel;

5. Based on the witness statements and the evidence at

the scene, we immediately initiated a search for Jose
Ngilay, the primary suspect;

6. On September 1, 2021, at around 3:00 AM, we

apprehended Jose Ngilay at his residence in Barangay
Berong, Quezon, Palawan.

We affirm that the information herein is true and accurate

to the best of our knowledge.

AFFIDAVIT OF THE INVESTIGATOR

I, Police Officer Juan Dela Cruz, of legal age, married, and

residing at Barangay Alfonso XIII, Quezon, Palawan, after
having been duly sworn in accordance with law, depose and
state:

1. I am a Police Investigator currently assigned to the

Quezon Municipal Police Station, Quezon, Palawan;

2. 2.On August 31, 2021, at approximately 10:45 PM, I

received a report regarding an altercation and possible
homicide at J One Bar, located in Barangay Berong,
Quezon, Palawan;

3. Upon receiving the report, I immediately proceeded to

the crime scene along with other officers from Quezon
Municipal Police Station;

4. Upon arrival, I observed the victim, Roberto

Dimaguiba, lying unconscious and severely injured
inside the restroom of J One Bar. The victim was later
pronounced dead at the scene;

5. I conducted a thorough investigation, which included

securing the crime scene, collecting physical evidence,
and obtaining witness testimonies;

 6. The evidence and witness statements collected were
compiled and submitted to the Quezon Municipal
Police Station for the continuation of the investigation
and filing of appropriate charges against the accused;

7. I am willing to cooperate fully in the prosecution of the

case and to testify in court if necessary.
