system most have mix with customary law, religious law, common Law etc, all of them are not legalize
polyandry marriage but in Islamic law in Zanzibar man are allowed to marry more than one woman this
called polygamous marriage. In marriage Act s152(1). A married woman who is party to a ceremony
whereby she supports to marry another man commits an offence 1. It means in our legal system the
polyandry marriage is not allowed by authority if women conducted this is committed an offence. A part
from our society the different parties in the world there is some society which practice this as a culture
but not recognised with their law the following are the good example that are
Cultural reason.
In Hindu society, the polyandry ( Draupadi in the Mahabharat) . In this Draupadi was married to five
brothers, know as the pandavas. This polyandry marriage was arranged due to various circumstances,
including a vow taken by the mother of the pandavas. While this is example is from mythology rather
than historical records.
Also in certain Himalayan region. In some remote Himalayan region, such as part of Nepal and Tibet,
polyandry has been practiced as a customary tradition for centuries. In these communities, brothers
often marry the same woman helping to preserve family land and resources. These arrangements are
governed by customary law and cultural norms rather than by formal legal system. Also example in
Tibetan polyandry was practiced as a way to prevent land fragmentation. Brothers would marry the
same woman ensuring that family land remained intact. This practice was also influenced by economic
factors and the scarcity of arable land in the region. There many societies in the world but in East Africa
culture, particularly among pastorist community there are instances of polyandry arrangement although
they are less common compared to others form of marriage. One example is found among of the Nyinba
people of Nepal, who are sometimes considered brothers to marry the same woman, a practice believe
to help maintain family unity and manage resources more efficiently in harsh environments. Also in
Maasai society there is culture where some man it appear their spear in door of other married man and
sex with their wife after this person to to go may in in searching pasture of their cattle this related as
polyandry because that women have been married.
But all of this take as a culture of some societies and not recognised by the law of particular place mostly
is conducted or practice because or due to economic scarcity and also to solve land fragmentation in
areas where is small land also in order to make family intact or compact. In legal system is offence due
to our customary law also to biological women is very difficult to handle more than one men in a
marriage.
