Sir/Madam,
Under instructions from our client M/s. Hinduja Leyland Finance Ltd., a Non-Banking Finance Company registered under the
Companies Act, 1956, having its Corporate Office at No. 27-A, Developed Industrial Estate, Guindy, Chennai – 600032 (hereinafter
referred to as “My client / HLF”), we hereby issue this following notice to you.
1. My client states that you, the Noticee/s had availed loan (details of which are mentioned hereunder) from them, for
purchasing a Vehicle / Asset (hereinafter referred to as the “Asset”) by executing the Loan Agreement referred above. The
Asset was hypothecated in favor of HLF and my client has first charge over the said Asset and you undertook to abide by the
terms and conditions of the Loan Agreement including the payment of the instalments as per repayment schedule, which is
the essence of the contract. Any failure to pay on time will amount to breach of the contract warranting HLF to initiate
appropriate legal actions, as per the terms of the Loan Agreement.
2. That you are irregular and erratic in repayment of the installments and some of the Cheques/NACH/ECS/Standing Instruction
mandates issued by you towards the payment of instalments had been returned/dishonored. Despite having knowledge of the
same and in-spite of repeated reminders by HLF executives over phone and through personal visits, you have willfully and
wantonly neglected to pay the installments and thereby committed breach of the contract. On account of the same, my client
has suffered huge loss as detailed hereunder, which you, the Noticee/s is/are liable to pay.
3. Being a member of Credit Information Bureau (India) Limited (CIBIL), HLF is required to submit information of all its
transactions. HLF requests you to make payment of the overdue instalments, forthwith to ensure that your future endeavors to
obtain credit or loan facility from any other bank/financial institution is not prejudiced. Without prejudice to the legal rights
and contentions of HLF, if you are willing to make the aforesaid payment within the stipulated time or have any queries
regarding overdue amount, you are requested to contact our representative including the nearest Branch office for the same.

constrained to take appropriate legal proceedings including, but not limited to proceedings under Sec.17/Section 9 of the Arbitration
and Conciliation Act, 1996 (Amended act 2015) for the legal repossession and sale of the vehicle. as per the terms and condition of the
agreement for recovery of the said dues., holding you, the Noticee/s liable for all costs and consequences arising thereto.
