 Whistle-Blowing (Definition):

 Whistle –blowing means calling attention to wrongdoing


that is occurring within an organization to the public or
to those in positions of authority.

 One who disclose information about misconduct in their


workplace that they feel violates the law .

 One who speaks out, expose corruption or dangers to the


public or environment.

 Whistle blowers can be employees , suppliers,


contractors, clients or any individual.
 TYPES OF WHISTLE-BLOWING:

 Internal Whistle- blowing  External Whistle- blowing

•When an individual reports misconduct •When an individual reports misconduct


or revelations within the organization. or revelations outside the organization ,
such as law enforcement or the media.
 Who Is A Whistle-Blower? :

 A whistle blower is a person working within an organization

who reports that organization’s misconduct.

 The person can be a current or past employee.

 The misconduct can be a past act, can be ongoing, or can be

in the planning stages.


 The Loyal Agent Argument:
There are three obligations an employee has under fiduciary law:

 the duty of loyalty

 the duty of confidentiality and

 the duty of obedience

 The primary responsibility of an agent or employee is to operate in the best interests of


the principle, and they also have a duty to follow instructions, keep information
private, and show loyalty.

Blowing the whistle, according to this argument, is against the Second Restatement of
Agency that the whistle-blower violates the law of keeping confidentiality and therefore
becomes disloyal to his employer.

 Therefore, a member of an organization has no justification for blowing the whistle.


 Conditions for Justified Whistle-blowing:
 It is less appropriate to sound the alarm the less serious the
harm is.

 The whistleblowers ought to be well informed of the details


and aware of their importance.

 The internal options need to have been used up.

 They should carefully consider each move and foresee all


potential outcomes.

 Correcting a mistake must be the "motivation," not getting


even or trying to get ahead for oneself.

 Chances of success.
 When Whistle-Blowing Is Morally Unjustified?

 Breach of trust

 Internal channels not used

 Insufficient evidence

 Little chance of success


 Are Whistle-blowers Disloyal Agents?
 The case for loyal agents is not as compelling as it first looks.

 Being bound by a duty of allegiance has its boundaries.

 Employees are not required to follow instructions to the letter under


 the law of agency.

 Under the law of agency, employees are not compelled to adhere to


 instructions to the letter.
 Unfortunate Reality!

Whistle- blowing can lead to negative consequences


for those who practice it.

• Many lose their jobs


• Some find it hard to find employment after
• Some lose friendship and contact with family members
• Diminishes trust in the workplace
• Can negatively affect one’s career
• Risk to personal safety
 Whistle Blower Policy:
“The Whistleblower Protection Act of 2011 enables anybody to disclose
public interest related information and provides statutory safeguards from The
