Seed Law and Seed Policy

Seed Act 2045
• Preamble: it is expedient to maintain the convenience and economic
interest of the general public by providing the Seeds of quality-
standards in a well planned manner upon producing, processing and
testing the Seeds of high quality-standards to have the production of
different crops increased.
Definition (Sec 2.)
• “Seeds” means a matured ovule having embryonic plant, food substance
and protective cover or seeds or germ which can be used in sowing or
planting to produce crops by reproducing in a sexual or asexual mode.
• “Crops" means crops such as fruits, cereals, vegetables, cash crops and
grass crops.
• “Variety” means a plant grouping within a single botanical taxon of the
lowest known rank, which can be defined by the expression of the
characteristics resulting from a given genotype of that plant grouping,
distinguished from any other plant grouping by expression of at least one
of the said characteristics and considered as a unit with regard to its
suitability for being propagated, which remains unchanged after such
propagation."
Constitution of National Seeds Board (sec 3)
• There shall be constituted a National Seeds Board to formulate and
implement policies relating to the Seeds and to give necessary advice
to Government of Nepal on the matters pertaining to the Seeds.
Functions, Duties and Powers of the Board
(sec5)
• To provide advice to Government of Nepal to formulate the national
policy relating to the Seeds.
• To maintain co-ordination between the provincial and local level
government and private and government sectors in the activity of the
production and distribution of the Seeds.
• To encourage the private sector to make investment in the Seeds
industry.
• To regulate or control the quality-standards of the Seeds to be
produced within Nepal or imported outside the country.
• To approve, release and register the Seeds of new variety as
prescribed.
• To test the specialty, uniformity and permanency of the Seeds of new Variety
and grant the right of ownership to the Breeder as prescribed.
• To determine the quality-standards of the Seeds.
• To approve the quality-standards of the Seeds determined by native or foreign
bodies as per necessity.
• To give advice to Government of Nepal on service charges relating to Seeds,
• To give advice to Government of Nepal on the notification of the type and
variety of crops.
• To cancel the license who has conducted laboratory without renewal.
• To take examination of Seeds Inspector, Seeds Sample Collector or Seeds
Analyst for license to work.
Establishment & Functions of Seeds Quality
Control Centre (Sec 7, 8)
• Government of Nepal may, by publishing a Notification in the Nepal
Gazette, establish a Seeds Quality Control Centre in order to control,
examine and authenticate the quality of Seeds."
Objectives of Seed Policy 2058
• Availing required quantity of good quality seeds of various crops in
efficient manner.
• Promoting export by producing good quality seeds.
• Making seed business effective considering the existing world trade.
• Conserving and maintaining the genetic characteristics of indigenous
specialty seeds of Nepal and coordinating concerned organizations to
protect the rights over them.
National Seed Vision 2013-2025
• Objectives:
• 1. To enhance farmers' access to sufficient quantity of quality seed and
other planting materials.
• 2. To increase seed replacement rate through increased production and
supply of quality seeds.
• 3. To promote local seed security through conservation and sustainable
use of agro biodiversity.
• 4. To create an enabling environment for developing, producing and
marketing quality seeds of improved varieties of agricultural crops
• Strategies:
• 1. Promote use of quality seeds by expanding farmers’ choice including use
of local genetic resources.
• 2. Support public, community and private enterprises in seed production,
seed multiplication, processing and conditioning through efficient seed
quality services.
• 3. Strengthen varietal development, release, and maintenance breeding using
diverse gene-pool both from local and exotic sources.
• 4. Enhance marketing skills of seed entrepreneurs and invest in seed related
infrastructure.
• 5. Create enabling environment for developing efficient and effective public,
community and private seed related organizations with business culture.
