● PRINCIPIO DE LEGALIDAD

CPP, art. 202º: “Cuando resulte indispensable restringir un derecho fundamental

para lograr los fines de esclarecimiento del proceso, debe procederse conforme
a lo dispuesto por la Ley y ejecutarse con las debidas garantías para el
afectado”.

La aplicación de la legalidad es
absolutamente predicable en el
proceso penal, sin ella dentro del
proceso se produciría una serie de
arbitrariedades.
• PRINCIPIO DE PROPORCIONALIDAD

ejecución de la medida. La Sala Penal Superior
absuelve el grado previa audiencia. (204°. 1).
La resolución de la audiencia es inimpugnable
en la cual debe participar el Fiscal y el
afectado.
 • CONFIRMACIÓN JUDICIAL
En el artículo 203 inc. 3 del C.P.P aparece el concepto de
“confirmación judicial”, que entra a tallar cuando la policía en
casos de urgencia o peligro por la demora y con estrictos fines
de averiguación restrinja derechos fundamentales de las
personas, el fiscal solicitará inmediatamente la
confirmación judicial a fin de que el juez de la investigación
preparatoria confirme o desapruebe la medida ejecutada por la
policía o ministerio público; por ello, es él quien tendrá el
cuidado de examinar rigurosamente que no se haya vulnerado
ningún aspecto garantista del debido proceso ni el núcleo
esencial de los derechos fundamentales de los presuntos
culpables, puesto que por la urgencia tuvo que ejecutarse sin
orden judicial.
