Books by Ivan Arjona-Pelado

Papers by Ivan Arjona-Pelado
Abstract:
The article analyses the historical and legal establishment of the Church of Scientology in Spain since the arrival of its founder L. Ron Hubbard in the 1950s. It examines milestones such as the opening of the first church in 1980, the registration as a religious entity in 2007 after a legal battle, and the recent recognition of its foundation by the UN. It also criticises the persistence of legislative discrimination against religious minorities in areas such as taxation and marriage, which contradict constitutional principles. Despite these challenges, the history of Scientology in Spain exemplifies its progressive social acceptance and rootedness, legitimising its religious status and human rights work.
• Freedom of religion (art. 2, 18, 26)
• Right to privacy (art. 17)
• Non-discrimination and prohibition of advocacy of national, racial
or religious hatred (arts. 2, 3, 20 and 26).
Human rights are inalienable, belonging to every human being. However,
German authorities, violating the ICCPR, have and are promoting and condoning the practice of sect filters (or protective declarations as they call them) being directed against Scientologists as individual human beings, and not against the legal entities of the Church of Scientology in Germany.
Abstract: The author analyzes the recent Judgment of the Administrative Court of Appeal of the State of Bavaria, of June 16th, 2021, which declares contrary to the right of religious freedom and the principle of equality and non-discrimination before the Law, the denial of an administrative grant, to a member of the Church of Scientology, simply because of his membership. This is an important step towards the recognition of the Church of Scientology in Germany and the full recognition of the freedom of conscience and the principle of non-discrimination on religious grounds.
