Zgodnie z art. 77 ust. 1 Konstytucji RP każdy ma prawo do wy-nagrodzenia szkody, która została mu wyrządzona przez niezgodne z prawem działanie organu władzy publicznej. Artykuł 417 § 1 k.c. precyzuje, że za szkodę wyrządzoną przez niezgodne z prawem działanie lub zaniechanie przy wykonywaniu władzy publicznej odpowiedzialność ponosi Skarb Państwa lub jednostka samorządu terytorialnego, lub inna osoba prawna wykonująca tę władzę z mocy prawa. Analiza powołanych przepisów wskazuje, że ustawodawca dość lakonicznie określił katalog podmiotów uprawnionych do tego odszkodowania, dlatego niezbędne jest podjęcie szczegółowych zabiegów inter-pretacyjnych w tym zakresie.

The presented example clearly indicates the degree to which social sciences are interconnected. The change in social attitudes indirectly affects the general philosophy, which in turn reflects in legal philosophy. The change of a paradigm in legal philosophy, for example a switch from legal natural paradigm to positivist paradigm steadily reveals itself in the paradigm of dogmatic sciences, e.g. in the used methods of interpretation (and their respective value) and the division of more detailed sciences. Social sciences paradigms influence one another and are closely interconnected.

The article uses the concept of meme (from Greek word mimesis^, coined by Richard Dawkins, as a tool to look at the history of political Aristotelianism. It argues that recurrent interest in Aristotle's ideas can be viewed as a manifestation of deeper cultural traits that have been running throughout the veins of European societies for centuries, framing our minds and influencing our practice. Such Aristotelian memes can be observed particularly in Polish political tradition. Thus, this tradition serves here as an example of the historical implementation of some Aristole's memes, among which the definition of man as zoon politikon, the concept ofpolitea and the role of virtue are of special interest.
