    Petitioner claims that Benipayo failed to secure the approval of the COMELEC en banc to effect transfers or
    reassignments of COMELEC personnel during the election period. Moreover, petitioner insists that the COMELEC
    en banc must concur to every transfer or reassignment of COMELEC personnel during the election period.
    Contrary to petitioners allegation, the COMELEC did in fact issue COMELEC Resolution No. 3300 dated
    November 6, 2000, exempting the COMELEC from Section 261 (h) of the Omnibus Election Code. X x x
