Upon consideration of the STIPULATION BETWEEN DEBTORS AND VERONICA BANDA, CHRISTOPHER LEROY FLETCHER, AND ENTERPRISE RENT-A-CAR COMPANY OF LOS ANGELES PROVIDING FOR LIMITED MODIFICATION OF THE AUTOMATIC STAY TO PERMIT STATE COURT SUIT TO THE EXTENT OF INSURANCE (the Stipulation)1 entered into by and among the Debtors, Fletcher, Enterprise, and Plaintiff, and for good cause shown, IT IS HEREBY ORDERED AS FOLLOWS: 1. 2. The Stipulation is hereby approved in its entirety; Upon entry of this order, the automatic stay imposed under section 362 of the

Bankruptcy Code shall be modified to the limited extent necessary to enable (a) the State Court Action to proceed to final judgment or settlement; and (b) the parties to attempt to recover any liquidated final judgment or settlement with respect to the State Court Action from the available liability coverage under the Travelers Policy; 3. The Plaintiff is hereby deemed to have waived the right to recover any punitive

damages from the Debtors in the State Court Action; 4. The Plaintiff, Fletcher, and Enterprise are hereby deemed to have waived any

right to file a proof of claim or claims in the Debtors bankruptcy cases or to receive any distributions or payments from the Debtors or their bankruptcy estates, and the Plaintiffs recovery on any alleged claims against the Debtors shall be limited to available insurance proceeds; 5. Nothing in the Stipulation shall be deemed or construed to impact, impair, affect,

determine, release, waive, modify, limit or expand the terms and conditions of the Travelers Policy or any rights, remedies, defenses to coverage and other defenses of any insurer pursuant to the Travelers Policy. 6. Nothing in the Stipulation shal l be deemed an admission to liability by the

Debtors or the insurance carrier with respect to the State Court Action.

All capitalized terms herein have the same meanings as in the Stipulation.
