MINUTES OF COUNCIL
A regular session of Troy City Council was held Monday, October 20, 2014, at 7:00p.m. in Council Chambers.
Members Present: Clark, Heath, Kendall, Oda, Phillips, Schweser, Snee and Tremblay.
Upon motion of Mr. Clark, seconded by Mr. Kendall, Mr. Twiss was excused from this meeting by unanimous roll
call vote. Note -Mr. Twiss was present at 7:18pm, prior to a vote being taken on any legislation.

INVOCATION: An invocation was given by Council Member Kendall. The Pledge of Allegiance followed the
invocation.
PUBLIC HEARING: At 7:02 p.m., Mrs. Baker declared open a public hearing on 0-31-2014, the rezoning of IL
2176 (1200 S. Crawford St.) from M-2, Light Industrial District, R-5, Single-Family Residential District. There were
no comments in this regard and at 7:03p.m., Mrs. Baker declared this public hearing closed.
MINUTES: The Clerk gave a summary of the minutes of the October 6, 2014, meeting of Troy City Council.
There were no corrections or additions to these minutes. A motion was made by Mr. Clark, seconded by Mr.
Kendall, to approve these minutes. Motion passed by unanimous roll call vote.
COMMITTEE REPORTS:
Safety & Health Committee: Mrs. Oda, Chairman, reported that Committee recommends legislation be
prepared to approve the 2015 funding to the Miami County Public Health District for public health services for
Troy citizens in the amount of $330,656.24. Committee noted the funding is reduced 4.51% from the 2014
funding.
Streets & Sidewalks Committee: Mr. Phillips, Chairman, reported as follows:
1) Committee recommends the legislation provided by ODOT be approved for consent of the Ohio
Department of Transportation (ODOT) paving part of SR 718, from Washington Road to 1-75 (a portion
of which is in the City limits) in 2016, and the work will be done at no cost to the City. Based on the
ODOT format, Committee supports emergency legislation.
2) Committee recommends that legislation be prepared authorizing the Director of Public Service to file an
application with the Ohio Public Works Commission (OPWC) for funding towards the cost of McKaig
Road Improvements Phase Ill. The project area is from the railroad crossing at Monroe Street to the
alley west of Lake Street. The OPWC grant would not exceed $525,000. Because of the October 31
application deadline, Committee supports emergency legislation.

Utilities Committee: Mr. Tremblay, Chairman, reported that Committee recommends legislation be prepared
authorizing the Board of Park Commissioners to execute an electric right of way and easement to the Dayton
Power and Light Company (DP&L) associated with the completion of the installation of the lighthouse structure
at Treasure Island Park, which structure is The Troy Foundation's Bicentennial Legacy Gift to the community.
So that the right of way and easement can be executed as soon as possible, committee supports emergency
legislation.

Discussion: Mr. Clark stated he appreciates the gift of The Troy Foundation. He noted that the
lighthouse structure will cost less than the Foundation's funding and asked what will be done with the difference.
Mr. Titterington commented that the funding balance of The Troy Foundation grant will be spent on the base for
the lighthouse and on landscaping.
CITIZEN COMMENTS:
-Lester Conard, 1210 S. Clay Street, stated his concern is with the cost of various elements of the Marina
building project, stated he has not seen any of the drawings or plans for the final project but thinks it could be
done for less. He also stated that he believes the building can only be used a few months a year.

-Mayor Dick Church of Miamisburg stated that while attending a riverfront meeting in Piqua last week, he heard
that some comments attributed to him may have been used against Troy's Riverfront Development Project. He
wanted to make it clear that Miamisburg is proceeding with Riverfront Development, has already spent $3
million on Riverfront Park and had 68 events at their park this summer. Mayor Church stated that the bonding
capacity of Miamisburg will not permit Miamisburg to bond the entire development amount at this time, but
riverfront development remains a priority for Miamisburg.
--Cindy Schaefer, 26 % N. Short Street, commented that she hopes those opposing the Marina Building
continue to do so, with a 25-year payback she feels the building can only be used the equivalent of 12 years of
that period. She also said the new entrance to Community Park makes it look like it is for commercial trucks
and not the intimate area it has been.

ORDINANCE CHANGING THE ZONING OF INLOT 2176 (PARCEL NO. D08-022170) IN THE CITY OF TROY,
OHIO FROM M-2, LIGHT INDUSTRIAL DISTRICT TO R-5, SINGLE-FAMILY RESIDENTIAL DISTRICT
This Ordinance was given first title reading on October 6, 2014.

COMMENTS OF THE MAYOR: Mayor Beamish noted that the annual Halloween Parade will be held October
25, Make a Difference Day will also be on October 25, and Trick or Treat will be October 30, 6-8 pm,
COMMENTS OF COUNCIL:
-Mrs. Snee asked when the water line work on Frank Street is to be finished. She was advised that staff will
check with the contractor and let her know.
-Mr. Phillips asked if being able to apply brine to all roadways in an 8-hour day will have a futher impact on
handling of snow or ice. Mr. Titterington commented that last year the City had one brine vehicle and now has
three, there will more brining to do more pretreatment when possible and that may reduce the amount of salt
needed under certain circumstances, and with the high cost of salt coupled with the limited supply, the City will
use brining as much as possible.
COMMENTS OF THE PRESIDENT OF COUNCIL: Mrs. Baker asked if a report will be forthcoming to Council
since the sign has been removed that indicated the traffic light at Cedar StreeVMain Street was under study for
removal. Mr. Titterington stated that will be provided as well as information on other signals that were studied.
AUDIENCE COMMENTS:
Lester Conard, 1210 S. Clay Street, thanked the City for the removal of a limb from a tree, which he mentioned
at the prior meeting, and he looks forward to the entire tree being removed.

SUMMARY REPORT: (to be read at Council meeting)
On October 20 this committee met regarding establishing a flat administrative fee of $100 related to each
mowing when there has been a noxious weed violation. The current provision is an administrative fee of 20o/o.
This equals $5.60, which does not cover the expenses associated with processing a violation. A flat fee of
$100 represents the cost to the City for processing each mowing violation.
RECOMMENDATION: (to be read at Council meeting)
It is the recommendation of this Committee that legislation be prepared amending Section 521.11 (g) of the
Ordinances to establish a flat administrative fee of $100 related to each mowing when there is a violation of the
Noxious Weed provisions.

Finance Committee
On October 20, 2014, this committee met to consider recommending a flat administrative fee related to mowing
when there has been a noxious weed violation. This meeting was also attended by Mayor Beamish, Council
President Baker, Council Members Phillips and Oda, the Director of Law, the City Auditor, the Director of
Public Service and Safety, and members of the City staff.
The current provision is that an administrative fee of 20o/o is applied when processing the mowing bill related to
a violation of the noxious weed provisions. Based on a mowing charge of $28 per hour for the mowing, the
20/o administrative fee calculation is $5.60. We were advised that the 20/o fee does not cover the
administrative cost of processing a violation. Having mowing done by the City is actually considerably cheaper
than a property owner would pay to privately have a lawn care business do the mowing. Staff recommended
that Section 521.11(g) be amended to establish an administrative fee of $100 per mowing as such fee is
reflective of the costs incurred by the City. The administrative fee becomes part of the mowing expense that is
assessed to the property. We also reviewed a survey of the administrative fee applied by our neighboring
communities for this type of offense. A flat fee of $100 would be in the middle of those fees.
RECOMMENDATION:
It is the recommendation of this Committee that legislation be prepared amending Section 521.11 (g) of the
Ordinances to establish a flat administrative fee of $100 related to each mowing when there is a violation of the
Noxious Weed provisions.

and Safety to purchase fuel quantities on the open market when needed during 2015 as firm prices cannot be
obtained through the standard bid process. It is the recommendation of this Committee that legislation be prepared
authorizing the Director of Public Service and Safety to advertise for bids and enter into contracts for the 2015
supply for asphalt materials, fire hydrants, and water meters as outlined in the detailed report.

On October 20 this committee met to consider authorizing the contract for the fireworks for July 4 for
years 2015 and 2016. The cost would be $31,500 each year, which is the funding level since 2006. The
contract includes a provision to get out of the contract in the second year should funding be an issue. The
Troy Foundation has generously helped fund the fireworks in prior years and a grant application will be
submitted to the Foundation if the contract is authorized by Council. The City will also contact Concord
Township (a funding partner since 2005) and Staunton Township regarding financial participation.
RECOMMENDATION: (to be read at Council meeting)
It is the recommendation of this Committee that legislation be prepared authorizing the Director of Public
Service and Safety to enter into a contract with the Rozzi Company, Inc. at a cost not to exceed $31,500
each year for the July 4, 2015 and 2016 fireworks.

On October 20, 2014, this committee met to consider authorizing the contract for the July 4th fireworks for
2015 and 2016. This meeting was also attended by Mayor Beamish, Council President Baker, Council
Members Phillips and Oda, the Director of Law, the City Auditor, the Director of Public Service and Safety,
and members of the City staff.
The City of Troy has funded fireworks in the amount of $31,500 since 2006. The Rozzi Company, Inc. has
proposed a two-year contract to hold the cost at $31,500 each year, 2015 and 2016, while maintaining the
quality of the fireworks show. The contract includes a provision for the City to get out of the contract in
the second year should funding be an issue.
The Troy Foundation has been a funding partner with the City in providing the fireworks, and a grant
application will be submitted to the Foundation during 2015 and 2016 if Council authorizes the contract.
The City will also contact both Concord Township and Staunton Township for funding participation.
Concord Township has responded positively to past requests.
RECOMMENDATION:
It is the recommendation of this Committee that legislation be prepared authorizing the Director of Public
Service and Safety to enter into a contract with the Rozzi Company, Inc. at a cost not to exceed $31,500

SUBJECT: REZONING INLOT 2176 FROM M-2, LIGHT INDUSTRIAL DISTRICT, TO R-5, SINGLE-
FAMILY RESIDENTIAL DISTRICT
SUMMARY REPORT: (to be read at Council meeting)
This Committee met on October 27 to review a rezoning recommendation from the Troy Planning Commission
that lnlot 2176 be rezoned from M-2, Light Industrial District, to R-5, Single-Family Residential District. This is
the address of 1200 S. Crawford Street. This rezoning has been recommended by the Troy Planning
Commission. There were no comments made opposing the rezoning at the public hearing held October 20.
RECOMMENDATION: (to be read at Council meeting)
We support the findings of the Planning Commission regarding this rezoning and recommend that Ordinance No.
0-31-2014 be adopted to provide for the rezoning of lnlot 2176 from M-2 to R-5.

Law & Ordinance Committee
This Committee met on October 27, 2014 to review the recommendation from the Troy Planning Commission
that lnlot 2176 (PARCEL DOB-022170), which is the address of 1200 S. Crawford Street, be rezoned from M-2,
Light Industrial District, to R-5, Single-Family Residential District. The meeting was also attended by Mayor
Beamish, Council President Baker, the City Auditor, the Director of Public Service and Safety, and members
of the City staff.
The owner of the property is Charles Griesemer; the applicant is Jerry Miller. The proposed zoning is
consistent with the surrounding zoning. Council held a public hearing on this rezoning at the October 20
meeting and no comments were made opposing the rezoning.
We support the findings of the Planning Commission that In lot 2176 should be rezoned from M-2 to R-5 based on
the following findings:
o The area has the same zoning to the west, north, and east as the proposed zoning classification.
o The parcel meets the size requirements for an R-5 zoned property and fits the use well.
o The proposed rezoning is consistent with the intent and purposes of the Zoning Code.
o The rezoning would eliminate a non-conforming use.
RECOMMENDATION:
It is the recommendation of this Committee that Ordinance No. 0-31 -2014 be adopted to provide for the
rezoning of lnlot 2176 from M-2 to R-5.

SUBJECT: ADJUSTMENT TO PART-TIME/SEASONAL WAGE SCALE TO MEET MINIMUM WAGE LAW

Committee members Twiss and Clark met on October 28 regarding adjusting the starting wage rates
for part-time and seasonal workers by $0.15 per hour to be consistent with the new Ohio minimum
wage law of $8.1 0 per hour, effective January 1, 2015.
RECOMMENDATION: (to be read at Council meeting)
It is the recommendation of this Committee that legislation be prepared amending the rate for
seasonal employees, temporary laborers and temporary clerks to reflect a starting hourly wage for
all new hires of $8.10 as of January 1, 2015, to comply with the Ohio minimum wage as required.

Personnel Committee
Committee members Twiss and Clark met on October 28, 2014 to review a proposed adjustment to
the entry level hourly wage paid to part-time and seasonal workers to comply with the Ohio
minimum wage as of January 1, 2015. This meeting was also attended by members of the City staff.
As of January 1, 2015, the State of Ohio minimum wage will increase by $0.15 per hour from_$7.95 per
hour to $8.1 0 per hour. The Federal law rate is $7.25 per hour; however, the City is mandated to
meet the state rate. To comply with the Ohio minimum wage, the City's entry level step for part-
time and seasonal workers will need to be adjusted to $8.1 0 per hour. Adjustments are not being
made to any other part-time wages. The overall cost to the City for this adjustment will be less than

This Committee met on October 29, 2014, to consider a request that two parcels of land be declared as
surplus and no longer needed for a public purpose, and that the parcels be sold. This meeting was also
attended by the City Auditor, the Director of Public Service and Safety, and members of the City staff.
The following parcels are requested to be declared as surplus:
A 0.52 acre parcel (Parcel 008-250083) on Staunton Road, known as Allen Park access. The
Board of Park Commissioners recommended the parcel be declared as surplus. We note that
this parcel was declared surplus by prior legislation, but was incorrectly identified as surplus
Wastewater Treatment Plant (WWTP) land.
An approximately 9.368 acre parcel (Parcel 045-250045) on SR 202. This is the surplus WWTP
parcel. This land is not needed for a public purpose. By selling the land the City will not need to
maintain or expend funds to further secure the land.
RECOMMENDATION:
It is the recommendation of this Committee that legislation be prepared declaring Parcel 008-250083 on
Staunton Road and Parcel D45-250045 on SR 202 as surplus and not needed for a public purpose.

This Committee met on October 27, 2014, to consider the final legislation provided by the Ohio Department
of Transportation (ODOT) regarding ODOT's schedule to pave portions of SR 55 and SR 41 during State
FY 2015. The meeting was also attended by Mayor Beamish, Council President Baker, the City Auditor,
the Director of Public Service and Safety, and members of the City staff.
Council previously approved revised consent legislation for ODOT to pave the following areas in 2015, with
the City to pay 20/o of the project cost:
Portion of SR 55 from Franklin Street to Staunton Road, including the Public Square.
A section of SR 41 from the Public Square to Cherry Street.
An approximate one mile section of SR 55 from Nashville Road to the beginning of the four lane
road.
ODOT will be bidding this paving prior to year end, with the work to be done in the spring of 2015. The
City is responsible for 20o/o of the project cost, currently estimated at $125,216. That amount is higher than
indicated when the consent legislation was approved; however, the current estimated share is based on a
newer pre-bid estimate received by ODOT. ODOT requires that the final legislation and the estimated
local cost be received by November 19, which is prior to the bid date. We were advised that the City would
be responsible for 20o/o of any additional costs should the bids be higher. If the final project cost is less
than the estimate, the City receives a refund based on that lower cost.
RECOMMENDATION:

FINAL RESOLUTION AUTHORIZING THE OHIO DEPARTMENT
OF TRANSPORTATION PROJECT FOR THE RESURFACING ON
SR 55 (FROM NASHVILLE ROAD TO THE BEGINNING OF FOUR
LANES! ON SR 55 (FROM FRANKLIN STREET TO STAUNTON
ROAD!. AND ON SR 41 <AROUND THE PUBLIC SQUARE AND
TO CHERRY STREET). AND DECLARING AN EMERGENCY
The following Final Resolution enacted by the City of Troy, Ohio, hereinafter referred to as the
Legislative Authority/Local Public Agency or "LPA", in the matter of the stated described project.
WHEREAS, on 21st day of July, 2014, the LPA enacted legislation proposing cooperation with
the Director of Transportation for the described project:
The project (PID NO. 91802) consists of pavement planing and resurfacing with
asphalt concrete. Project includes the mainline lanes around Monument Square (Public
Square), lying within the City of Troy; and
WHEREAS, the LPA shall cooperate with the Director of Transportation in the above described
project as follows:
The City agrees to assume and bear one hundred percent (100%) of the entire
cost of the improvement, less the amount of State funds set aside by the Director of
Transportation for the financing of this improvement from funds allocated by the Federal
Highway Administration, U.S. Department of Transportation.
Also, The City agrees to assume and bear the entire cost and expense of
the installation and/or repair of curb ramps which are necessary to ensure
compliance with the Americans with Disabilities Act.
The share of the cost of the LPA is now estimated in the amount of One Hundred Twenty-Five
Thousand, Two Hundred Sixteen and 00/100 Dollars ($125,216.00), but said estimated amount is to
be adjusted in order that the LPA's ultimate share of said improvement shall correspond with said
percentages of actual costs when said actual costs are determined; and
WHEREAS, the Director of Transportation has approved said legislation proposing cooperation
and has caused to be made plans and specifications and an estimate of cost and expense for improving
the above described highway and has transmitted copies of the same to this legislative authority; and
WHEREAS, the LPA desires the Director of Transportation to proceed with the aforesaid
highway improvement.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Troy, Ohio, as follows:
SECTION 1: That the estimated sum, of One Hundred Twenty-Five Thousand, Two Hundred
Sixteen and 00/100 Dollars is hereby appropriated for the improvement described above and the fiscal
officer is hereby authorized and directed to issue an order on the treasurer for said sum upon the requisition
of the Director of Transportation to pay the cost and expense of said improvement. We hereby agree to
assume in the first instance, the share of the cost and expense over and above the amount to be paid from
Federal funds.
SECTION II: That the LPA hereby requests the Director of Transportation to proceed with the
aforesaid hghway illprovement.
SECTION Ill: That the LPA enter into a contract with the State, and that Director of Public
Service and Safety be, and is hereby authorized to execute said contract. providing for the payment of
the LPA the sum of money set forth herein above for improving the described project.
SECTION IV: That the LPA transmit to the Director of Transportation a fully executed copy of this
Resolution.
SECTION V: That this Resolution is an emergency measure necessary for the immediate
preservation of the public peace, health and safety of the City of Troy, Ohio, and for the further reasons to
expedite the highway project and to promote highway safety, and so that the LPA share can be paid to the
Ohio Department of Transportation no later than November 19, 2014; NOW WHEREFORE this Resolution
shall be effective immediately upon its adoption and approval by the Mayor.

{PARCEL DOS-022170), WHICH IS THE ADDRESS OF 1200 S. CRAWFORD STREET, FROM THE ZONING OF
M-2, LIGHT INDUSTRIAL DISTRICT, TO THE ZONING OF R-5, SINGLE-FAMILY RESIDENTIAL DISTRICT.
On September 10, 2014, the Troy Planning Commission considered the rezoning of lnlot 2176 (PARCEL D08-
022170), which is the address of 1200 S. Crawford Street, Troy, Ohio, from the zoning of M-2, Light Industrial
District, to the zoning of R-5, Single-Family Residential District. The owner of the property is Charles Griesemer;
the applicant is Jerry Miller.
The Commission had received a report of City staff, which was reviewed as part of the meeting discussion. That
report indicates that the owner plans to continue to use the property as a single-family residence. Under the
current M-2 zoning, if something happened to the property that destroyed more than 50% of the property, it could
not be rebuilt for residential use. A copy of the packet provided to the Commission is attached.
The Planning Commission determined not to hold a public hearing on this rezoning application.
By unanimous vote, the Troy Planning Commission recommends to Troy City Council that the requested rezoning
be approved for lnlot 2176 (PARCEL D08-022170), which is the address of 1200 S. Crawford Street, Troy, Ohio,
from the zoning of M-2, Light Industrial District, to the zoning of R-5, Single-Family Residential District, based on
the following findings of staff:
o The area has the same zoning to the west, north, and east as the proposed zoning classification.
o The parcel meets the bulk requirements for an R-5 zoned property and fits the use well.
o The proposed rezoning is consistent with the intent and purposes of the City of Troy Zoning Code.
o The rezoning would eliminate a non-conforming use.

BACKGROUND:
Jerry Miller, agent for Charles Griesemer, owner of 1200 South Crawford Street, has
applied for Planning Commission to consider allowing the rezoning of 1200 South
Crawford Street. Currently the property is zoned M-2, Light Industrial District, and the
applicant requests that the zoning of the parcel be rezoned to R-5, Single Family
Residential.
The property consists of .15 acres located on the NE corner of South Crawford Street and
Racer Street. The surrounding zoning districts include R-5, Single-Family Residential to
the north, west and east, and M-2, Light Industrial District to the south. A map depicting
the surrounding zoning districts has been attached to this report
DISCUSSION:
The Zoning Code describes the R-5 district as "designed to accommodate single-family
dwellings on lots with areas of at least six thousand (6,000) square feet per dwelling unit.
This parcel meets the required bulk requirements of the R-5 zone.
The Comprehensive Plan's Future Land Use (Figure 14-2) shows the surrounding area to
be predominately residential use with light industrial to the south.
In reviewing a rezoning proposal, Section 1139.07 outlines the criteria on which to
base decisions:
(A) Whether the change in classification would be consistent with the intent and purpose
of this Zoning Code.
The proposed rezoning is consistent with the Zoning Code, specifically with sections
1131.02(e), and (r). These sections dictate the intent and purpose of the Zoning Code.
Theses sections are listed below:
);;> 1131. 02( e) "To separate incompatible land uses and to cluster compatible and
mutually supportive land uses".
);;> 1131.02(r) "To direct particular land uses to the parcels of land best suited for
them ... "
The rezoning is consistent with the above listed intentions of the Zoning Code. The
residential use of the property fits well with the current uses that exist in the area.
(B) Whether the proposed amendment is made necessary because of changed or
changing conditions in the area affected, and, if so, the nature of such changed or
changing conditions.
The application was not submitted based upon any changing conditions in the area.
(C) Whether the uses that would be permitted on the property if it were reclassified would
be compatible with the uses permitted on other property in the immediate vicinity.
The use would be permitted on the existing parcels of land located to the west, north, and
east of the proposed rezoning area.
(D) Whether adequate utility, sewer, and water facilities, and all other needed public
services exist or can be provided to serve the uses that would be permitted on a property
if it were reclassified.
All utilities are provided.
(E) The amount of vacant land that currently has the same zoning classification as is
proposed for the subject property, particularly in the vicinity of the subject property, and
any special circumstances, in any, that make a substantial part of such vacant land
unavailable for development.
There is no vacant land in the vicinity of this proposed rezoning.
(F) Whether the proposed amendment would correct an error in the application of this
Zoning Code as applied to the subject property.
Not applicable in this request.
PUBLIC HEARING:
Due to the straight forward nature of the rezoning request and the fact that City Council is
required to hold a public hearing if the request proceeds on, staff does not feel that a
public hearing before the Planning Commission is warranted.
RECOMMENDATION:
Staff is recommending that the Planning Commission recommend approval of the
rezoning from M-2, Light Industrial District to R-5, Single Family Residential District,
based on the following:
o The area has the same zoning to the west, north, and east as the proposed zoning
classification; and
o The parcel meets the bulle requirements for an R-5 zoned property and fits the use
well; and
o The proposed rezoning is consistent with the intent and purposes of the City of

OF M-2. LIGHT INDUSTRIAL DISTRICT. TO THE ZONING OF R-5. SINGLE-FAMILY RESIDENTIAL DISTRICT:
OWNER OF THE PROPERTY IS CHARLES GRIESEMER: THE APPLICANT IS JERRY MILLER. Mr. Miller was
present. Staff commented that Jerry Miller, agent for Charles Griesemer, owner of 1200 South Crawford Street (Parcel
D08-022170}, has applied for the rezoning; property consists of .15 acres located on the NE corner of South Crawford
Street and Racer Street; surrounding zoning districts include R-5, Single-Family Residential to the north, west and east,
and M-2, Light Industrial District to the south; the Zoning Code describes the R-5 district as "designed to accommodate
single-family dwellings on lots with areas of at least six thousand (6,000) square feet per dwelling unit"; this parcel meets
the required bulk requirements of the R-5 zone; the Comprehensive Plan's Future Land Use (Figure 14-2) shows the
surrounding area to be predominately residential use with light industrial to the south. The staff report further noted:
"In reviewing a rezoning proposal, Section 1139.07 outlines the criteria on which to base decisions:
(A) Whether the change in classification would be consistent with the intent and purpose of this Zoning Code.
The proposed rezoning is consistent with the Zoning Code, specifically with sections 1131.02(e), and (r). These sections dictate the intent and
purpose of the Zoning Code. Theses sections are listed below:
1131 .02(e) "To separate incompatible land uses and to cluster compatible and mutually supportive land uses".
1131 .02(r) 'To direct particular land uses to the parcels of land best suited for them ... "
The rezoning is consistent with the above listed intentions of the Zoning Code. The residential use of the property fits well with the current
uses that exist in the area.
(B) Whether the proposed amendment is made necessary because of changed or changing conditions in the area affected, and, if so, the
nature of such changed or changing conditions.
The application was not submitted based upon any changing conditions in the area.
(C) Whether the uses that would be permitted on the property if it were reclassified would be compatible with the uses permitted on other
property in the immediate vicinity.
The use would be permitted on the existing parcels of land located to the west, north, and east of the proposed rezoning area.
(D) Whether adequate utility, sewer, and water facilities, and all other needed public seNices exist or can be provided to serve the uses that
would be permitted on a property if it were reclassified.
All utilities are provided.
(E) The amount of vacant land that currently has the same zoning classification as is proposed for the subject property, particularly in the
vicinity of the subject property, and any special circumstances, in any, that make a substantial part of such vacant land unavailable for
development.
There is no vacant land in the vicinity of this proposed rezoning.
(F) Whether the proposed amendment would correct an error in the application of this Zoning Code as applied to the subject property. Not
applicable in this request."
Staff recommended approval based on
o The area has the same zoning to the west, north, and east as the proposed zoning classification; and
o The parcel meets the bulk requirements for an R-5 zoned property and fits the use well; and
o The proposed rezoning is consistent with the intent and purposes of the City of Troy Zoning Code.; and
o The rezoning would eliminate a non-conforming use.
Mr. Kappers asked if it is known why the request has been made. Mr. Davis commented that the City had earlier
contacted this owner about rezoning to a residential category, but the owner had decided to wait a while.
PUBLIC HEARING. A motion was made by Mr. Force, seconded by Mr. Titterington, that the Commission not
hold a public hearing on this request, noting that Council would hold a hearing. MOTION PASSED, UNANIMOUS VOTE
REZONING. A motion was made by Mr. Titterington, seconded by Mr. Force, to recommend to Troy City

WHEREAS, Council finds it both necessary and appropriate to amend that part of
Chapter 521 of the Codified Ordinances of the City of Troy, Ohio relating to the amount of
the administrative costs incurred by the city when it is necessary for Council (through its
clerk) to cause the cutting and destruction of noxious weeds under Section 521 .11 of the
Codified Ordinances and
WHEREAS, Council finds that when the owner, lessee, agent, or tenant having
charge of the lands mentioned in subsection 521.11(c) of the Codified Ordinances of the
City of Troy, Ohio fails to cut and destroy such noxious weeds and fails to comply with
the notice required by such section, that in addition to the cost of employing outside
labor, the city actually incurs $100 in administrative costs each time Council (though it's
clerk) has to cause such cutting and destruction of noxious weeds and
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Troy, Ohio as
follows:
SECTION 1: That existing Subsection 521 .1 1 (g) of the Codified Ordinances of
the City of Troy, Ohio, attached hereto as Exhibit A, is hereby repealed.
SECTION II: That Subsection 521.11 (g) of the Codified Ordinances of the City of
Troy, Ohio, as set forth below, is hereby enacted:
"521.11 (g) If the owner, lessee, agent, or tenant having charge of the lands
mentioned in subsection (c) hereof fails to comply with the notice required by
such section, council (through its clerk) shall cause such noxious weeds to be
cut and destroyed and may employ the necessary labor to perform the task. All
expenses incurred shall be paid out of the money in the treasury of the
municipality not otherwise appropriated. Such costs shall be at the owner's
expense, and that cost, together with an administrative fee of $100 shall be
assessed against the lot or land."

WHEREAS, various departments and boards within the City of Troy have identified
various parcels of real property that are no longer needed for municipal purposes, and
WHEREAS, state law requires that such land be sold after advertisement and to
the highest bidder,
NOW, THEREFORE, BE IT ORDAI NED by the Council of the City of Troy, Ohio as
follows:
SECTION 1: That the Director of Public Service and Safety of the City of Troy,
Ohio is authorized to advertise for bids and enter into any required contract for the sale of
the real property listed on Exhibit "A" attached hereto and made a part hereof, which
properties are found to be no longer needed for any municipal purpose, in accordance with
state law and the specifications now on file.
SECTION II: That the Director of Public Service and Safety is hereby authorized
to execute any documents necessary for the sale and transfer of the properties listed on
Exhibit "A", including a deed.
SECTION Ill: That the Director of Law is hereby authorized to prepare any deeds
and documents to complete the sale and transfer of the properties listed on Exhibit "A".
SECTION IV: That this Ordinance shall be effective at the earliest date allowed
bylaw.

We are providing the following for your information:
The bid opening for the Fleet Maintenance Program was held on Wednesday,
October 29 with 4 bids received for the initial three year contract. All appear
to be under the $400,000 per calendar year authorized by Council. Staff is
reviewing the various elements of the bids.
Major Project Update:
o Sidewalk Program 8 - construction continues.
o Kent Lane - Finfrock Construction continues work on this water line
upgrade and is finishing up the final portions.
o North Market Street/Piqua-Troy /Troy-Urbana Intersection Realignment
- construction continues. The road remains closed.
o Barnhart Road, Arthur Road, Oak Street, Scott Street & Frank Street
Waterlines - work continues in the area of Oak/Scott/Frank Streets.
Contractor will start on Barnhart next from the south end (near
Speedway).
o Adams Street Phase 2 - work continues.
The second round of the 2014 leaf pick-up begins on November 3. A copy of
the News Release containing the schedule is attached. In addition to the leaf
collection schedule posted on the City's website, there is a map that shows
the zones noted in the schedule.
Weather permitting, the placement of the Christmas Tree will be held on
November 7. In preparation for this, the fountain has been turned off and
removed for this year. This year's tree is donated by Ms. Melissa Dick of
1325 Sussex Road. Once again, Piqua Steel will be providing staff and
equipment to assist City staff with this project. We are very grateful to the
management and staff of Piqua Steel in providing this service. All the
decorations are to be in place for the Illumination Parade and tree lighting on
Friday evening, November 28.

The Veterans Day Committee has announced that the annual ceremonies will
take place at 11:00 a.m. on Monday, November 11. These ceremonies will
take place at the Veterans Memorial at Riverside Cemetery.
City Offices will be closed on Thursday and Friday, November 27 and 28, for
the Thanksgiving holiday. In keeping with the new schedule, residential
trash and recycling will be picked up on November 27 and 28. There will be
no delay in these collections.
The Dye Mill Road Facility will close for the season at the end of the day
November 29. Until that time, the Dye Mill Road Facility will continue to be
open from 11:00 a.m. - 7:00 p.m. Mondays and Fridays, 3:00 p.m. - 7:00
p.m. on Tuesdays and Thursdays, and Saturday 9:00 a.m. - 3:00 p.m.
Steven Suerdick Sr. will retire on November 30 after 15 years of Service. Mr.
Suerdick is the Senior Water Distribution Serviceman. Mr. Suerdick began
his career with the City of Troy on February 20, 2001.

Street- Including Solid Waste- Jerry Mullins, Foreman
Collected and transported 233 tons of residential trash since the last report of
266 tons.
Delivered recycling bins as requested.
Asphalted 6 areas marked for repair, 2 main break, and 5 water services.
Staff has used over 7 41 tons of asphalt to repair street openings since the plant
opened.
Dura-patched 47 spots marked for repair.
Cleaned the downtown for weekend events.
Mowed and weed-whipped ditches and rights-of-way.
Repaired and replaced signs throughout the City.
Assisted with the placement of detour signs for the CSX road closure and the
Troy-Urbana, Troy-Piqua Improvement project.
Collected yard waste bags and bundled brush.
Round two of the curbside leaf collection program begins on November 3. As
always we will follow the schedule as weather permits. The leaf schedule will be
posted in the Troy Daily News and on the city's website. Brush should not be
mingled in with leaf piles. If residents place brush out during leaf season it will
still need to be bundled or placed in yard waste bags in order for it to be
collected. We have received one of our new leaf vacuum machines and will be
incorporating it into our leaf collection process.

Completed Ohio Utilities Protection Service requests as needed.
Hung the fall banners on the poles in the downtown area.
Repaired/replaced PED buttons at the following intersections: East Main and
Walnut Streets, West Main and Plum Streets, West Main and Cedar Streets, West
Main Street and Dorset Road, West Main and Adams Streets, and on the Public
Square.
Repaired flashing school sign at Heywood School.
Repaired lights at City Hall and Fire Station # 1.
Set up the temporary electric for the recent cooking show at Hobart Arena.
Installed LEDs at the gazebo on the levee and on the outside of the air stripper
building.
Finished performing the 3-year traffic signal preventive maintenance program.
Started preparing the decorations for the Illumination Parade and tree lighting.
Water Distribution/Sewer Maintenance- Tom Parsons, Foreman
Marked numerous Ohio Utilities Protection Service tickets.
Investigated numerous high consumption alerts.
Completed a number of work orders for Billing and Collection.
Shut-off non-payment customers and reconnected as payments were made.
Winterized the fountain on the square and 200+ irrigation accounts.
Shut water off on Arcadia for irrigation installation.
Kent Lane Waterline Extension- made a 4" tap and twelve 1" taps, and pressure
tested the line.
Frank, Oak, & Scott Street Waterline Project - performed pressure test on the
Scott Street water line and it passed; pressure tested the Frank Street water line
has not passed testing yet.
West Race Waterline Project- made two 6" taps and one 4" tap, and collected
bacteria samples.
Troy-Urbana/North Market Waterline Project- made four blow-off taps, flushed
the lines on North Market and took bacteria samples.
Repaired catch basins on Experiment Farm Road and at the corner of South
Walnut and East West Street.
Jetted and TV'd the sewer lines on East Water Street.
Vacuumed grease for the Wastewater Treatment Plant.
Water Treatment Plant - Tim Ray
Well technicians from our vendor have completed the cleaning of production well
#13. The well pump and motor are being evaluated for needed repairs, and will
be reinserted into this well with new cost-savings flexible drop pipe in the next
few weeks.
WTP maintenance staff repaired the electric actuator for Train 1 sludge flushing
system.
The annual clarifier basin train rotation was completed on October 27 with
minimal process control or water quality issues. Maintenance staff will prepare
the Train 2 basins for the anniversary inspection of the coating application for
warranty issues.
Preventive maintenance work on the dome of the 4 MG finished water reservoir is
complete. All cracks were ground, grouted, and sealed. All repaired surfaces
have been repainted.
WTP maintenance staff will grout and secure the pump discharge head base
plates at the VOC effluent pump house, and a retaining wall and concrete base
for the blower unit has been poured by contractor.
Vendor electrician has installed service disconnects on Train 2 turbine drive
motors to achieve compliance with National Electrical Code requirements.
WTP and Engineering staff interviewed three engineering firms in preparation for
recommending the engineering design contract for the new 0.75 MG elevated
water storage tank for the northwest part of the system (EHS boosted area).
The 30" expansion plug for Train 1 effluent piping has been sent for repairs.
The City of Dayton contractor is on site to remove approximately 1,600 dry tons
of lime softening residuals from the West Lagoon over the next 3-4 weeks.
WTP maximum inventory of chlorine gas, used for treated water disinfection, will
be reduced to 2,400 lbs. by end of year. This is a risk reduction decision based
upon current and projected water plant production.
Wastewater Treatment Plant - Tim Snider
Staff continued working on the annual onsite inspections for industries included
in the Municipal Industrial Pretreatment Program (MIPP) program.
Finished cleaning grease and debris from behind the Equalization Basin (EQ)
influent gates. Also cleaned grease and debris from C&D building.
Hauled grease and debris from barricades at the back of the plant site.
Contractor installed soft start on blower # 1 in the blower building.
Staff replaced faulty seal on primary clarifier #2 collector and on FST #2 drive
unit.
Submitted annual Report of Cronic Biomonitoring to OEPA.
Staff replaced faulty bulb seal on the EQ basin influent aluminum slide gate.
Staff pumped ground water from electrical vaults on the plant site.
Staff changed oil in the drive units of screw pumps #5 and #7 and degreased,
cleaned and painted drives, motors and motor bases.
Implemented use of preventive maintenance work orders generated from the
software maintenance program.
Run hour timers are now operable on all equipment, including lift stations and
data is being stored to the program.
Maintenance staff continues to complete required preventive maintenance work
orders.

Project Status
ACTIVE PROJECTS
Adams Street Phase 2
This phase of the project is between the Adams Street Bridge and Staunton Road. Project
has been awarded to L.J. DeWeese. Construction is underway.
Cherry Street Parking Lot
Renovation is complete. The parking kiosk has been ordered and will be arriving in 6 - 8
weeks.
ODOT has funded a portion of this project. Design updates will be made by Poggemeyer
Downtown Streetscape Phase 3B
Design Group. Initial survey work is complete. ODOT has completed the environmental
documentation. Design has been submitted to ODOT for their approval prior to proceeding
to complete construction.
Staff has been working with an oustide contractor to make the Engineering Electronic Files
Engineering Electronic File Reorganization
organized in such a way that all staff can have access to most documents. This will improve
effeciency with document filing and is expected to reduce the volume of space necessary to
keep the electronic files.
Staff has reviewed proposals submitted from six firms and interviewed four of the firms. The
Hobart Arena Renovation
selection committee has selected a preferred firm and we are currently working to prepare a
contract. Once negotioations are complete we will have a contract to present to City Council
for their approval.
City Council authorized bidding at $75,000. The lighthouse has been ordered and we are
Lighthouse at Treasure Island awaiting the delivery schedule. We are working on getting the base started in the next few
weeks.
This phase includes work from Monroe to the RR tracks. Staff has reviewed proposal
McKaig Road Phase 2
submittals from six firms and interviewed two firms. The selection committee has selectd a
preferred firm and we are currently working to prepare a contract. Once negotioations are
complete we will have a contract to present to City Council for their approval.
Marina Boathouse Renovation
A Reappropriation Ordinance was approved that included funding for the design of the
improvements. City Council has authorized bidding and bids will be opened November 19.

Project Status
The City has received a grant from The Troy Foundation to pay for design of a Mountain
Mountain Bike Trail
Bike Trail on land owned by the City. A purchase order was issued to the International
Mountain Biking Association (IMBA) to design the project. The consultant has been to Troy
to review possible sites. Information from the consultant is pending.
Staff is working with ODOT regarding the paving along SR 41 on the west side of town as
well as the traffic circle. Council approved preliminary consent legislation. Work will take
ODOT Paving place in SFY 2015. Council will consider the final legislation at the November 3 meeting of
Council. The legislation includes payment of the City's estimated cost share in the amount of
$125,216.
Staff will be submitting pre-applications for the three year pipeline of projects that we
propose to be funded with this program. The projects are: McKaig Road Phase 3, and N.
OPWC Market Phase 2, and McKaig Road Phase 4. The pre-application for McKaig Road Phase Ill !
has obtained enough points to be considered for funding. Council authorization was
obtained so that the final application can be submitted.
Piqua-Troy/Troy-Urbana Intersection
Bids were opened and the project awarded to Double Jay Construction. Construction on the
project is underway.
Water Regionalization
Council has authorized a contract with RA Consultants. Staff has submitted all requested
information for evaluation. Workshop #2 was held and the project will continue.
A RFP has been issued for the design of a new Extra High Service Water Tower. Proposals
Water Tower are being reviewed by City Staff. City Council will be asked to authorize a contract for design
once staff has recommended a firm.
Council authorized the bidding of $2.8 M of sewer work. Bids were opened July 9 with bid

totals under the authorization. Work has been awarded to Layne lnliners and Miller Pipeline.
Layne lnliners will begin work in early November. We will be notifing property owners as
necessary for this project.
Sidewalk Program 8
Council authorized bidding for the Phase 8 sidewalks where the property owner did not take
out a permit to do the work. Project was awarded to I. F. Weber. Work is underway.

Project Status
Staff has started working with Miami Valley Lighting (MVL) and MVCC to determine the best
way to convert the City's Mercury Vapor (MV) street lights to High Pressure Sodium (HPS)
Street Light Conversion
street lights as required by law. The City will be working with MVCC and MVL to install trial
LED street lights in several locations in the City as a demonstration. We anticipate that LED
lights will be installed on Plum Street, Short Street, Adams Street, and along Shaftsbury
Road at Adams Street in early November.
Prelimininary design is complete and Council has been presented the work. Purchase
Treasure Island Park Design Orders have been issued to prepare the final design to prepare for bidding. Progress
meeting has been held to review the architectural features to be included in the park.
Water Project #2a - Kent Lane Work is underway.
Contract has been awarded to Sturm Construction. Work on Scott, Frank, and Oak Streets
Water Project #3 - Barnhart/718 is underway. Testing is underway on this segment of the project and once the testing is
completed, service lines can be installed followed by restoration.
Water Project #4 - Finsbury, Governors
Contract has been awarded to Finfrock Construction. Work at Race is being tested. Service
connections will be made once the testing is completed.
OTHER PROJECTS
Based on the application submitted February 19, Troy was again named as an Honorable
Bicycle Friendly Community Mention Community by the League of American Bicyclists. While we were hoping for better
recognition, this is a great accomplishment.
General Specifications and Information A draft of the revision has been submitted to the Service Director's Office.
GPS Data Collection This outdoor work continues as time and weather permit.
SUBDIVISION STATUS
Hawk's Nest Section 2 Waiting for final course of asphalt.
Pleasantview Estates Section 4 The plat has been approved. Construction has not yet begun.
Stonebridge Meadows
Section 1 is complete. Infrastructure in Sections 2 is complete except for the final asphalt.
Section 3 construction will follow in the spring.

2014. The first report shows all permits that were issued by the Planning
Division. The report contains the address and type of permit and separates
the information by each ward. There were 32 permits issued during this
time period.
The second report contains the address, type of concern, and a summary of
the current status of on-going issues. Both open and closed concerns are
listed and are separated by each ward.
As in the past, all costs associated with the removal of trash and elimination
of noxious weeds will be invoiced to the property owner. If the property
owner does not pay the invoice, the cost will be assessed to the property
taxes.
