the resurfacing of part of E. SR 41 and a part of W. SR 41 within the City limits at no cost to the City,
to be bid by the State in FY 2017. Emergency legislation requested .

9-10-2016:
Authorize the Director of Public Service and Safety to enter into an agreement with Troy
Main Street for the 2016 Taste of Troy event.
Authorize a notwithstanding ordinance for this event.
Due to the date of the event, consideration of emergency legislation is requested .

RECOMMENDATION:
That Council approves the preliminary consent legislation provided by the Ohio Department of
Transportation (ODOT) related to the paving of SR 41. This project includes paving that will abut the City
on both E SR 41 and W SR 41. This project is currently scheduled during State FY 2017 (7-1-2016/6-302017).
BACKGROUND:
We have received the consent legislation for the paving project described herein. It is noted that only a
small part of the project is within the City. This work will be at no cost to the City of Troy; however,
consent (preliminary) legislation is required by ODOT.
Staff has recommended that the City authorize the consent legislation.

That Council authorizes an agreement with Troy Main Street for the Taste of Troy event on September 10, 2016, which
will include the use of public property for the sale/consumption of alcoholic beverages.
BACKGROUND:
Troy Main Street's (TMS) annual Taste of Troy event is scheduled for September 10, 2016. TMS has requested that
the portion of the event regarding samplings from local restaurants continue to be from 11:00 am- 4:00 pm, and that
the beer garden be permitted to operate from 11 :00 am - 8:00 pm to coincide with the popular "2nd Story Secrets" tour,
which will be from 4:00 pm- 8:00 pm. Another slight change from last year would be that the enclosed and secure
beer garden for the sale of beer and wine would be on Prouty Plaza, north of the Showmobile, rather than the parking
area of the NW Quadrant. There would be a dining tent on West Main Street (between Cherry Street and the Square) .
Food vendors would be located on West Main Street and within the NW and SW Quadrants. Smaller tables/chairs
would be located within the enclosed area, near the Showmobile, and in the NW Quadrant. Thus, West Main Street
just east of the crosswalk at the Square to Cherry Street would be closed as it was in 2015. A copy of the map of the
area is attached.
This request has been reviewed with Mayor Beamish, as well as the City staff that would have some involvement in
coordinating the event.
In regard to this requested Taste of Troy:
TMS would be required to apply for an F2 perm it, and meet all requirement of such permit.
TMS would need to carry liquor liability coverage.
Persons under the age of 21 would not be permitted within the beer garden.
The duties of TMS for this Taste of Troy would be the same as for this event in recent years.
TMS will reimburse the City for expenses related to Taste of Troy, in the amount of $500.
REQUESTED ACTION :
It would be appreciated if you would assign to a Committee of Council:
1. Authorizing the Director of Public Service and Safety to enter into an agreement with Troy Main Street for the
2016 Taste of Troy event.
2. Authorize a notwithstanding ordinance for this event.
The consideration of emergency legislation is requested due to this event taking place shortly and so that Troy Main
Street would know the decision of Council so that marketing the event can proceed.

That Council considers legislation authorizing SmithFiy Designs to assume Community Development
Block Grant Revolving Loan Fund loan # 1423002, which was originally approved to Charles Sturwold by
Council's adoption of Resolution R-16-2014 on March 17, 2014. The assuming of this loan by SmithFiy
Designs has been recommended for approval by the City's Loan Review Committee, subject to the
original conditions of the loan and that the parking lot be paved as required by the Zoning Code.
BACKGROUND:
This loan was made to Charles Sturwold for the purchase and repair of the building located at 210 East
Water Street. The approved loan amount was $130,000 and has been reduced to $121,660.37 (as of
Aug. 2) through regular monthly payments.
