RULE BOOK MEDIATION

Law as a profession deals with human conflicts so, the theoretical
knowledge of law cannot be divorced from practical application
thereof. In fact, to know the alternative dispute resolution
procedures it is imperative to be informed of adjudication method.
To acquaint students with practical aspects of law, the legal aid cell &
alternative dispute resolution association of UPES, SOL presents its
national mediation competition and to make them understand ways
to bring conflicting parties at a comfortable level on a mediation and
mediation table and to protect their mutual interests.
Competition brief
Legal Aid Cell & ADR Association is organizing a two day mediation
competition. This competition will provide the participants with an
opportunity to test their core mediation skills and experience model
community mediation sessions through rounds of competitive
simulations. This competition will be inviting participation from law
students across the country to pitch their skills to tackle tactfully-
drafted competition problems. The competition aims to highlight the
role of the mediator and the disputing party's in a mediation session.

1. OBJECTIVE
The objective of the mediation competition is to provide a means
for law students to practice and improve their Mediation skills.

2. DATE AND VENUE


The Mediation competition shall be held on March 7th-8th March
2019 at UPES, school of law, Dehradun. The Competition shall consist
of a Preliminary round & Quarter-Final round on day 1,and Semi-finals
& Finals shall take place on the subsequent day.

3. LANGUAGE OF VERBAL COMMUNICATION
The language of the competition is English. Communication in any
other international, national or regional languages during the
competition rounds is not allowed.

4. TEAM COMPOSITION
Each Team shall comprise of three members. One member shall be
acting as a mediator and the other two shall be acting as client-
counsel pair. Teams cannot be changed or altered after registration.
Any change or alteration in the registered team is subject to the sole
discretion of the organizing committee. Team codes shall be allotted
to the respective team by the organizing committee which shall be
used to identify the team throughout the competition.

5. CRITERIA
Preliminary round shall consist of 30 mediation teams on first-cum-
basis. Top 12 Mediating teams, with highest scores out of the both
Preliminary round 1& Preliminary round 2 shall advance to Quarter-
Finals based. Further, top 8 teams shall advance to Semi-Finals on
basis of the highest scoring teams. Top 4 Mediating teams, with
highest scores out of the Semi-Finals round shall advance to Finals.

6. MEDIATION FORMAT
The competition will have 2 Preliminary Rounds on Day 1, along with
Quarter-Finals. Day 2 will have Semi-Finals & Final Round.
-Each round will consist of a 30-minute mediation session barring the
Semi-finals and the finals. -The broad format of a mediation round is as

Each team shall comprise of three students out of which one shall act
as a Mediator and the other two team members will be acting as the
client-counsel pair (referred to as the “Mediating pair”).
One member of the team will be designated as Mediator, whose role
shall remain unchanged throughout the Competition. The other two
members of the team will form the Mediating pair, representing a
Client and his/her Counsel. The respective roles are not
Interchangeable within a round. The two mediators in one
competition session (from different teams) for all purposes will be
referred to as Mediator 1 (M1) and Mediator 2 (M2) as designated in
the match-ups. The mediator and the two mediating teams are given
general information pertaining to the problem, which is a set of
common facts. Each mediating team is given a set of confidential
information, which includes their own client's version of the events
that transpired.Confidential Information shall be released to the
respective teams 20 minutes before the commencement of the
session. This Information should not be disclosed to any other
participant at any time during the Competition. A possible outcome
that their client wants from the mediation process may also be
included. During each round, the mediator which acts as the
facilitator of the event mediates either a transaction or the resolution
of a dispute with the mediating teams. Each mediating team needs to
assist in the mediation process to achieve the best outcome for their
client. This will involve understanding the other team's requirements,
helping them achieve it, while assessing the concessions the team can
offer and achieving their own needs. Each team needs to negotiate to

7. TOPIC Vidhiotsav
The competition shall be based on the themes from various laws
pertaining to Civil Law, Commercial law and any current legal issue or
any other legal topic.
The problems for the competition shall be released approximately 1
Week before the event.

8. DRESS CODE
For all the rounds strictly, Business formals dress code is to be
followed.

9. TIME LIMIT & STRUCTURE


Each participating team will participate in a 30 Minutes Session which
will consist of a general caucus as well as private caucus on the
discretion of the mediator. The last 5 Minutes of the Round will be
given to the judges for Q&A and for the feedback. Preliminary Round
shall be in session for a maximum of 30 minutes. Quarter-Finals shall
be in session for a maximum of 45 minutes. Semi-Finals shall be in
session for a maximum of 60 minutes. Finals shall be in session for a
maximum of 75 minutes.

10. PERMITTED MATERIAL DURING THE


MEDIATION SESSION
For the Mediation Session, each competing team can bring its own
prepared notes. Each team can also bring and use a calculator and a
watch (stop watch, timer, etc. is allowed). Use of other electronic
devices such as mobiles phones, tablets, laptops, etc. is strictly not
allowed. Non-compliance with this rule by any person associated
with the team may lead to disqualification of the team concerned.

If it is an organizing committee member or an assessor involved, it
would lead to the withdrawal of such a person from the organizing
team or the assessor's panel.

11. POWER TO REMOVE DIFFICULTIES


The Organizing Committee may take such other measures as are
required for the orderly conduct of the competition.
The Organizing Committee's interpretation as to the implementation
of the Rules is final and conclusive. In case of any grievance, the same
shall refer to ADR and governed by the ADR rules of resolve.

12. REGISTRATION

request for registration after the stipulated date shall be entertained.

All requisites and details will be shared with the teams after the
completion of registration process.

13. PAYMENT DETAILS


Rs. 6000/ per team (Inclusive of Registration Fees & Accommodation)
NOTE: Colleges falling under the boundaries of Dehradun may choose
to pay an amount of Rs. 2500/ per team as registration amount in cash
(if not availing Accommodation facility).
Ÿ Lunch will be provided to all the students during the event.
Ÿ The Accommodation will include 2 days Stay, Breakfast and Dinner.
The Accommodation shall be provided to the teams from 6th
March, 2019, Evening to 8th March 2019, Morning 11:00am. Room
will be on Triple Sharing Basis.

Ÿ The teams will be registered on 'first come first served' basis. The
registration is restricted to 30 teams only for the UPES National
Mediation Competition, 2019.
