Ambala, is going to organize its 7th MM National Moot Court Competition, 2024. Hoping for its
glorious success, the Department is all set to host it in the month of 25th to 27th April 2024. We
take this opportunity to host this event as it provides an environment where aspiring lawyers can
enhance their legal proficiencies and mooting skills with a unique concept With great
enthusiasm, we welcome your esteemed institution to participate in this academic extravaganza,
showcasing the finest legal minds across the nation.
The competition strives to give a platform to the budding lawyers of our Country to imbibe
analytical skills in real time situations. Its aim is to engage with students and allow them to have
the first-hand experience of the complexities of the law.

RULEBOOK
I. INTRODUCTORY-
1. Short Title: These Rules shall be called the7th MM National Moot Court Competition, 2024
2. Definitions: Unless otherwise stated following shall be construed here in under as:
i. Administrator” shall mean the MM(DU) Moot Court Committee
ii. “Competition” means 7th MM National Moot Court Competition, 2024.
iii. “Net Court Room Margin” means the aggregate of margin of victory or defeat of a team
in the Preliminary Rounds.
iv. “Participating Team” means the team which has registered itself for the competition as
per the rules for registration.
v. “Participating Institution” shall be presumed to be the parent institution of the
participating teams.
vi. “Rules” means the 7th MM National Moot Court Competition, 2024.
vii. “Organizers” means the Department of Law, MAHARISHI MARKANDESWAR (DEEMED TO
BE UNIVERSITY), MULLANA.
1. Date: The Competition shall be organized on 25th, 26th & 27th April, 2024.
2. Dress Code: The participants shall adhere to following dress code when present in any court
room during the Competition.
i. Ladies: White salwar and kurta or white shirt and black trousers along with black coat
and black shoes.
ii. Gentlemen: White shirt, black trousers and black tie along with black coat and black
shoes.
Note: The participating teams shall also adhere to the above mentioned dress code while
attending the inaugural and valedictory ceremonies of the Competition.

1. Allotment of Team Code: Every team which has successfully registered under the Rules shall
be allotted a unique code after the closure of the Registration for the Competition. Once the
unique code has been allotted, every team must use the team code for any communication
with the Organizers during the course of the Competition.
2. Change in Team Composition: Any change in team composition must be intimated to the
Organizers at the earliest. Any change must be accompanied with a registration form and an
authority letter duly signed by the head of the institution. No change in team composition is
allowed after registration by post.
1. Draw of Lots: The match up of teams will be determined on the basis of draw of lots.
A. Preliminary Rounds: Each team shall represent only one side as decided during draw of
lots.
1. Scoring in the Preliminary Rounds:
The aggregate score of a team shall be computed as the total of
i. Score of Speaker 1
ii. Score of Speaker 2
iii. Score of the memorial.
2. Arrangement of Ranking: The teams in the Preliminary Rounds shall be ranked on the
basis of below mentioned criteria–
a. The teams shall be first differentiated on their win-loss record after the Preliminary
Rounds Net Court Margin;
b. If there is a tie, the team with the higher aggregate score will be allotted the higher
rank;
c. If the tie subsists, the team with the higher speaker score will be allotted the higher
rank;
d. If the tie still subsists, the team with the highest individual speaker score out of
speakers of tied teams will be allotted the higher rank;

e. If the ties till subsists, the team with the higher memorial score will be allotted higher
rank;
3. Results: The results of the Preliminary Rounds shall be declared soon after the conclusion
of the Preliminary Rounds. The top eight teams will qualify for the Advanced Rounds.
B. Quarter-Finals:
a. The top eight teams from the Preliminary Rounds will qualify for the quarter-finals.
b. The side for the quarter-finals shall be decided by way of draw of lots.
c. The quarter-finals shall be a knock-out round.
d. The win-loss shall be decided on the basis of the aggregate speaker score.
No memorial score will be added in the Quarter-final. The win-loss shall be determined on the
basis of score so computed. The team with higher aggregate score shall proceed to the Semi-
final round.
C. Semi-Finals:
a. Four teams from the Quarter final shall qualify for the Semi-Finals.
b. The side of the team shall be decided by way of the draw of lots.
c. The semi-final shall be a knock-out round.
d. The win –loss shall be decided on the basis of the aggregate speaker score.
No memorial score will be added in the semi-final. The win-loss shall be determined on the basis
of score so computed. The team with higher aggregate score shall proceed to the final round.
D. Finals:
In the final round, the win-loss shall be decided on the basis of the aggregate speaker score.
No memorial score will be added in the finals. The win-loss shall be determined on the basis
of scores computed.
Deciding of Winner in Case of Tie in Advanced Rounds: In the event of tie in advanced
rounds, then–
a. The team with the highest individual speaker score out of speakers of tied teams will be
allotted the higher rank;
b. If the tie still subsists, the winner of the round shall be decided by adding the score of
memorials to the aggregate speaker scores.

No Difference between Soft Copy and Hard Copy of Memorial: The hard copy of memorial must
be exact replica of the soft copy submitted to the Organizers. Any difference in the same will
result in disqualification from the Competition.
4) Team Code: The team code must be ascribed on the top right corner of the cover page.
The code must be preceded by the side for which the memorial is prepared. The teams
must use “A” for Appellant, P for “Petitioner” and R for “Respondent.”For example: in case
the Team Code is 10 the team must write “A-10” in case of memorial for Appellant and
“R-10” in case of memorial for Respondent.

Penalty: A penalty of 1 mark per violation per side shall be levied in case of non- adherence with
the aforementioned guidelines for formatting.
7) Compendium
i. All relevant case laws, statutory material, and other evidence based on which the
participants will present and substantiate their arguments may be submitted in the
form of a 'Compendium'.
ii. 1 (one) hard copy of the 'Compendium' shall be submitted along with the hard
copies of the memorials on 25th April, 2024 during the time of registration at the
venue.
[Note: Submission of 'Compendium' is at the discretion of the teams, the same is not
mandatory to be submitted by all the participating teams.]
iii. Participants shall ensure that anonymity is not violated while passing on any material

iii. Participants shall ensure that anonymity is not violated while passing on any material
to the Bench. If any mark , name, seal, symbol or logo of their
institution/college/university is present, participants must ensure that the same is
rendered unrecognizable.
8) Exchange of Memorials
i. The Exchange of Memorial for the Preliminary Round will be on 25th April, 2024. The
memorial exchange for the advanced rounds of the Competition shall take place
prior to the commencement of the advanced rounds (Quarter-Finals, Semi Finals, and
Finals) wherein hardcopies of the respective memorials shall be provided.
ii. Teams are prohibited from making any remarks on the opponent's Memorial, i.e. the
exchanged memorial. Teams are also prohibited from making any copies of the
opponent's Memorial, electronically or otherwise.

5. Reference to Memorial 20
X. PENALTIES-
1. Scouting: No member of any participating team shall view any other oral rounds while
the team is still in the competition. If such an incident comes to the notice of the
organizers then the scouting team shall be subject to disqualification. Teams may file a
written complaint of scouting to the Organizers. The decision of the Organizers shall be
finaland binding.
2. Non – Disclosure of Identity: Teams shall not disclose their identity, i.e. the name of their
institution, city, etc. or any other information which has the effect of disclosing their
identity and affiliation with a particular university or institution. Such disclosure shall
result in disqualification subject to the discretion of the Organizers.
3. Copyright: The copyright with regard to the memorials submitted for the participation in
the Competition is assigned by participants and shall also vest completely and fully with
the Organizers. The participants shall certify the originality of the memorials and the
materials used and shall be responsible for any claim or dispute arising out of further use
and exhibition of these materials.
The Organizers shall have the right to publicly display, distribute it electronically or otherwise
and they shall not be responsible for any liability to any person for any loss caused by errors or
omissions in this collection of information, or for accuracy, completeness or adequacy of the
information contained in these materials.

XI. CLARIFICATIONS-
1. Participating teams may seek clarifications via mail on the Official Email with subject
title: 7th MM National Moot Court Competition, 2024 - Clarification.
2. The last date to seek clarifications to the Moot Proposition is 12th April, 2024.
1. Best Team: The Team winning the final round of the Competition shall be given a trophy and
a cash prize of INR 20,000 (Indian Rupees Twenty Thousand Only).
2. Runners Up: the runners up team in the final round of the Competition shall be given a
trophy and a cash prize of INR 15,000 (Indian Rupees Fifteen Thousand Only).
3. Best Mooter: The Mooter having the highest score in the competition shall be given the cash
prize of INR 3,000 (Indian Rupees Three Thousand Only).
4. Best Memorial: The team having the highest average memorial score from both sides shall
be given the cash prize of INR 3,000 (Indian Rupees Three Thousand Only).
5. Best Researcher: There shall be researcher test and the best performer shall be given the
cash prize of INR 3,000(Indian Rupees Three Thousand Only).
6. Certificates of merit shall be given to all the teams qualifying or quarter finals and beyond.
Accommodation and food shall be provided by the Organizers to the team members in the
University. The Accommodation will be provided on shared basis in the hostels at university
campus. There will be separate hostel facilities for Girls and Boys.
XIV. MISCELLANEOUS
Power to Amend or Alter Rules: The rules mentioned herein are not exhaustive. The
Organizers reserve the right to alter, amend or add to the rules mentioned herein at any
point of time. All decisions made by Organizers in case of any disputes, doubts or related
issues shall be final and binding. Imposition of all penalties including disqualification rests
solely with the organizers in case of failure to comply with the rules mentioned herein.

MOOT PROBLEM
Remaniya is a Union of States showcasing pluralistic, multilingual and multi-ethnic society. The
country is a federation governed under the Constitution of Remaniya – the country's supreme
legal document. According to Preamble of the Constitution, it is a Sovereign Socialist Secular
Democratic Republic with a parliamentary system of government.
Thereby the Constitution provides for a Parliamentary form of government which is federal in
structure with certain unitary features. Fundamental rights are the basic human rights enshrined
in the Constitution of Remaniya which are guaranteed to all citizens. They are applied without
discrimination on the basis of race, religion, gender, etc. Significantly, fundamental rights are
enforceable by the courts, subject to certain conditions. Section 124 A of Remaniya Penal Code,
1860 deals with offence of sedition, however this statue was enacted during the period when it
was dominated and reigned by a foreign imperialist. At that time, the Imperialists only had the
primary goal to infringe the rights of Remaniya's inhabitants. It has been advocated in number of
cases that Section 124A of RPC, 1860 violates Article 19(1)(a) of the Remaniya's Constitution,
which guarantees an individual the right to freedom of speech and expression.
In the year of 2018, one Social Activist, Mr Oliver in the State i.e., Vorish, expressed his concern by
writing on social media platform i.e., Chatbook regarding the incident of non-tribal children who
were assaulted by 18 unidentified persons with wooden logs and lethal weapons. Through his
writing, he asked Mr. Dilip Raje (CM of Vorish), “where was the police and what the government is
doing for hospitalized victims, such muggers have illicit relation with government which makes
government fail to resolve tribal and non-tribal dispute”. He expressed theVorish government's
empathy towards non-tribal people and thereby commented that Vorish has long been a failed
State. The complaint was filed alleging incitement of communal hostility and which might lead to
a communal clash. The Appellant in return had filed a petition in the High Court of Vorish for
quashing the FIR. The High Court, however, by its judgment dismissed the said petition.
In another incident in June, 2018, one Mr. Ramesh Sharma in his Funtube programme titled as
'The Ramesh Sharma Show', allegedly claimed that Mr. Gopal Ananad (Prime Minister of
Remaniya) has utilized fatalities and terror incidents to obtain votes during pandemic crisis in the
Country. He stated in his video that the government did not have adequate testing facilities and
that much delay has been made by the government for shipment of ventilators and sanitizers to
overcome the pandemic. Hence, an FIR was filed against him stating that he was generating
terror among the population by making such false allegations and that his programme has stir
up public dissatisfaction by spreading rumours, resulting in panic and anxiety in the general
public. The petition was filed in High Court for quashing of FIR but the same was dismissed.

Similarly, a former student activist Sohail Ibrahim, was also booked for sedition in 2018 for his
alleged inflammatory speeches during protests against the controversial Citizenship
Amendment Act (CAA) passed by Remaniya's Parliament. The speech of Sohail invited
widespread controversy, with some viewing it as an attempt to silence anti-government voices,
while others argued that Sohail speeches went beyond the limit of free speech. He was charged
with sedition under Remaniya Penal Code, 1860. Subsequently petition was filed in Supreme
Court challenging the law.
Mr. Naseem Rehman (a renowned politician in Border State i.e., Brass in Remaniya) has remarked
in an interview with a TV Channel that whatever the people of Brass are doing, is all because of
abrogation of special status of Brass State (revocation of Article 370 of the Constitution of
Remaniya) by Parliament which they never acknowledge. He was charged for provoking
sentiments of public by stating that we will take back our Article 370 in the State with help of
Fenzan (Neighbouring Country). Further stated that people do not feel or want to be Remanian
and would rather be dominated by the Fenzan. On this ground of spreading seditious matter,
case was filed against him.
In April 2020, one journalist and anchor of local news channel, Ahmed Ali uploaded a video on
social media platform containing the criticism against the CM of Renzing by calling him as
puppet of the Dharmatava (religious faith of majority of population) and criticized the state
government and law makers for spreading anti schedule tribe sentiments. During that time
another journalist from Riverland named Priya Jha also stated that CM has relationship with the
ruling political party in centre i.e., General Democratic Alliance (GDA). Ms. Jha also posted
political cartoons on social media i.e., Chatbook by showing the fake encounters by the police
between 2001 – 2004. FIR was filed against these journalists separately charged with offence of
sedition. A PIL was also filed by the Remaniya's Editors Guild raising the question of
constitutionality of sedition before the Supreme Court of Remaniya.
The Supreme Court of Remaniya, while admitting the PIL also clubbed the above mentioned all
petitions and posted the matter for hearing.
The following issues (non-exhaustive) arise for consideration by the Supreme Court:
1. Whether Remaniya's Editors Guild has locus standi to file a PIL challenging the
constitutionality of section 124A of RPC, 1860?
2. Whether Section 124A of RPC, 1860 is violative of Fundamental Right to freedom of Speech
and Expression guaranteed under the Constitution?
