1.0 Soalan/ Question
Puan Halimah mempunyai 8 orang kakitangan di TASKA beliau

sekarang. Kakitangan Puan Halimah termasuklah penyelia,
pendidik/pengasuh, tukang masak dan pekerja am. Waktu
perkhidmatan TASKA Puan Halimah adalah dari 7.0 pagi -6.0
petang. Sediakan satu jadual bertugas kakitangan TASKA Puan
Halimah yang mengandungi i) waktu masuk bertugas, ii) waktu
rehat dan iii) waktu tamat bertugas
Puan Halimah presently has 8 staff at her TASKA. Her staff

include a supervisor, educator/babysitter, cook and a general
worker. The service hours of Puan Halimah’s TASKA is from 7 am
to 6 pm. Prepare a duty schedule of Puan Halimah’s TASKA,
highlighting i) time to go on duty, ii) rest time and iii) time to go
off-duty for the staff.
2.0 Introduction
The opening hours of the TASKA stretches from 7 am to 6 pm to

cater for parents working in various sectors, as well as their
travelling time to and from the workplace. This adds up to 11
hours a day, for five days a week, and possibly half day on
Saturdays.

On the other hand, the Malaysian Employment Act defines the

workweek as 48 hours, with a maximum of eight hours per day
and six working days a week.
If the employee’s salary does not exceed RM2,000/- a month, or

falls within the first schedule of Employment Act 1955, then we
refer to the Employment act 1955. This is normally the case for
most of the staff at the TASKA. If, however, the salary exceeds
RM2000/- per month, then the hours of work and overtime will
be referred to the terms agreed under the employment contract.
In addition, based on section 60A(1) 0f the Employment Act

1955, and the August 1998 amendment, an employee shall not
be required to work
• More than 5 consecutive hours without at least 30 min

rest/ leisure period
• More than 9 hrs in 1 day
• In excess of a spread over a period of 10 hrs in a day
• More than 48 hrs in a week
3.0 Discussion
The group members agreed that hours of work and overtime

work directly affects productivity and profitability of the TASKA.
While on one hand the TASKA has to comply with the Malaysian

Employment Act (MEA), the TASKA management has to be

creative to come up with solutions. Various solution were
discussed, including
i) working in shifts – eg having 2 shifts

ii) staff has staggered hours
iii) staff be given additional rest days during the week, so
that the working hours do not exceed 48 hrs/ week
iv) shared responsibility or widening the scope of work
where for example the cook also helps in other areas, eg
cleaning up
v) employ more staff so that each staff works for the
stipulated hours only
vi) staff work longer hours and be paid overtime.
4.0 Suggested Solution
In the running of the Taska, several tasks and activities are being
carried out daily. An example of the duty schedule for the staff
involved is shown as Table 1 and an illustration of the work to be
carried out is as shown in Table 2.
The educators/babysitters need to base on Children Daily

activity, physical activity, corner activity, reading and lesson
learning.

For meal times, the educators/ babysitters will take turn to eat
or supervise the children having meals
Example:
⮚ 12.00 pm. – 1.00 pm. Team A to have lunch.
⮚ 1.00 pm. – 2.00 pm. Team B teachers to have lunch.
Thus, the working time for educators/ babysitters are from 7.00
am. to 6.00 pm. (11 hours per day). Working days are 5 days a
week. In addition to Saturdays and Sundays, they enjoy 2 days of
rest each per month, according to the rest schedule set up by
principal (Table 3). Total working hours would be (11 hrs X 20
days ) a month, or 55 hrs a week (exceeding 48 hrs! Why don’t
we let Team A focus in the morning, team B only comes in at
9, am,– 6.30 and team A 6.30- 4 pm).

On the other hand, the general worker and cook need to work
from Monday to Friday (5 days), for 9 hours a day, inclusive of
rest time (Table 4)

6 Conclusion
The above example is just one of the many ways that the TASKA
can schedule the working hours of its staff, in accordance with
the Malaysian Employment Act. The employer needs to calculate
the costs incurred, and weigh out the best profitability and
productivity with the resources available. Some employers
might find it more economical to require staff to work overtime
rather than hire more employees
