Subject: Hindrance due to Novel Coronavirus Disease (COVID – 19) outbreak as a pandemic.

Dear Sir,

The Engineer has received above letters from the Contractor notifying Force Majeure under Clause 19, Sub-
clause 8.4: Extension of Time for Completion and Sub-clause 20.1: Contractor’s Claims of GCC / PCC on account
of the pandemic caused by Novel Coronavirus Disease (COVID-19) in India and abroad and the preventive
measures announced by Honourable Prime Minister of India, and resorted to by the Government of India,
Government of Maharashtra and MCGM.

The Engineer has perused all the above letters and has taken note of the Contractor’s inability to proceed with
construction works in view of the spread of COVID-19 and the imposition of Lockdown by Government of
Maharashtra and the closure of all modes of public transport in order to prevent the same.

The Engineer assures the Contractor that both the Employer and the Engineer are fully aware of the adverse
outcome of the unprecedented pandemic and are closely monitoring the situation.

The Engineer also assures that the Contractor will be accorded due consideration of their entitlements in
pursuance of the Contract conditions related to the unforeseen events and circumstances beyond the control of
the Parties to the Contract.

Meanwhile, pursuant to Sub-clause 19.3 of GCC, the Contractor is requested to make all reasonable endeavours
to minimise any delay in the performance of the Contract in order to assess the situation and consequential
impact resulting from Force Majeure and keep the Engineer apprised of the same.

The Engineer reminds the Contractor that it is his obligation and primary responsibility to take care of own staff
& workers including abiding by all rules and regulations of the State.
