PREAMBLE

We, the members of Junior Criminologist Association of PhilCST (JCAP), imploring the aid of

Almighty God in order to build JCAP Organization which shall embody our ideas, promote high moral

values and Esprit De’ Corps, secure ourselves under the rules and regulations of Philippine College of

Science and Technology (PhilCST) and regime of truth, honor, integrity and justice for the nation, do

ordain and promulgate this Constitution.

JCAP’S CREED

‘Oh God, my Leader my King, while I am doing my duties and responsibilities make me loyal to

my organization and to my Alma Mater.

Give courage to do what is heard, courage to say no to sin, and courage to hold off the quitters

in me and recognize that brings happiness and let me appreciate that in purity all good things grow.

Give me strength of spirit to do my duty as I see it and never take the easy way out. May no sin

diminish my loyalty to you my school.

JCAP’S PLEDGE

I will serve God, my country and my fellow student.

I will uphold respect and protect my organization.

I will do my obligation, duties and responsibilities for my organization.

ARTICLE I
NAME AND OBJECTIVES

SECTION I NAME OF THE ORGANIZATION

The organization shall be known as Junior Criminologist Association of PhilCST (JCAP).

SECTION II ORGANIZATION’S OBJECTIVES

2.a That all criminology students should be models to all PhilCST Students in terms of:

2.a.1. Wearing of Proper Uniform.

2.b.2 Wearing of Identification Cards.

2.c.3 Proper Decorum inside and outside the school campus for them to be

epitome of self-discipline and being an upright citizen.

2.b. Criminology students should develop in themsel accurate and sufficient, knowledge,

skills, attitudes and values to become an efficient individual in their chosen profession.

2.c. To serve as an avenue for harmonious relationship between the instructors and

students to school administrator.

ARTICLE II
DEFINITION OF TERMS

SECTION 1 DEFINITION OF TERMS. As used in this JCAP Constitution and By Laws, the following

words shall mean and be construed as indicated herein:

Committee on Termination-Committee that is responsible in terminating an erring JCAP

officer/s. The composition of the committee shall be Dean of College of the Criminal

Justice Education as the Chairman, JCAP Adviser as the Vice-Chairman, Program Head

and the President of the organization.

COMELEC- It consists of the College Dean of the CCJE, all the faculty members in the

department of CCJE and selected fourth year criminology students upon

recommendation by the JCAP Adviser.

Conduct-The way that a person behaves in a particular place.

Criminology Student- A student of PhilCST and taking BS Criminology

Discretion-The quality of having or showing good judgment

JCAP Officer-A Criminology student who has an important position in the JCAP

organization voted by the criminology students.

Responsibility- A duty or task that members and officers are required or expected to do.

Termination- The act of terminating or removing a JCAP Officer from a position.

Outside - It refers to the distance starting from the main gate of PhilCST up to 100-meter

radius around the perimeter of the school.

Valid reason- Any reasons/happenings that hinder an officer to perform his task, duties

and responsibilities in the organization including health conditions, death of a family

member.

Violation-The act of doing something that is not allowed by the JCAP constitution and By

Laws.

ARTICLE III
MEMBERSHIP

SECTION I Membership shall be opened to all bona fide Criminology students of PhilCST.

SECTION II Members of the organization must courteously and effectively fulfill their duties and

responsibilities in pursuit of duly approved constitution and by-laws of the organization.

SECTION III A membership fee of one hundred fifty pesos (150.00) per year only shall be collected

from all members of the organization.

SECTION IV Every member shall enjoy all rights and privileges of membership including the right to

participate in election and hold office through the organization.

ARTICLE IV
CODE OF CONDUCT

SECTION I All officers and members of the organization should conduct themselves with respect

and loyalty to his superior. He should be always known to have courage and integrity of

character.

SECTION II JCAP members will observe the following conduct:

2.a. Commitment to the Organization

-Criminology students should maintain the principles of organization, hence,

shall at all times uphold the laws of organization and be loyal to the school.

2.b. Devotion of Duty

-Criminology officers and members shall perform their duties and dedication,

thoroughness, efficiency, enthusiasm and determination.

2.c. Discipline

-Criminology students and members should comply with the rules and

regulations of the organization and the school.

2.d. Loyalty

-Above all criminology students must be faithful in the observance of the laws of

Criminology and must manifest their loyalty to their superiors, peers and subordinates

as well.

2.e. Unity of Command

- The unity of vision and solidarity of mission and teamwork between the

officers and members of the organization shall at all times be upheld.

ARTICLE V
QUALIFICATIONS AND ELECTION OF JCAP OFFICERS

SECTION 1 GENERAL QUALIFICATIONS OF A JCAP OFFICER. No person shall be a JCAP officer unless

he or she possesses the following qualifications:

1.a. He/she must be a bona fide criminology student enrolled at PhilCST;

1.a.1 He/she must comply all the requirements including the current

registration form and ID.

1.b. He/she must have a leadership experience from any legitimate organization; and

1.b.1 A leadership experience includes certificates and awards received on

trainings and seminars in his/her past school years.

1.c He/she must possess a good moral character.

1.c.1 Good moral should be taken from the guidance office.

SECTION II SPECIFIC QUALIFICATIONS OF A JCAP OFFICER

2.a. The President. He/she must be an incoming 3 rd year Criminology student.

2.b. The Senior Vice-President. He/she must be an incoming 4 th year criminology

student.

2.c. The Junior Vice-President. He/she must be an incoming 3 rd year criminology student.

2.d. The Secretary, Sub-Secretary, Treasurer, Sub-Treasurer, Auditor, PIO, Business

Managers, and Marshalls. He/she shall be coming from any year level.

2.e. The Representative. He/she shall be coming from his/her respective year level.

SECTION III ELECTION PROCESS

3.a. Candidates must fill up the application form. Attach with the application form are

the following documents.

3.a.1. Valid registration form, as a proof that the candidate is as bona fide

Criminology student of PhilCST.

3.b. The JCAP Adviser shall be in-charge in screening qualified candidates subject to the

approval of the Dean of the College of Criminal Justice Education.

3.c. The election shall be done by balloting. Proxy voting shall not be allowed.

3.d. The ballots shall be countered in the presence of the COMELEC, JCAP Adviser and
candidates. The COMELEC and JCAP Adviser shall be responsible in the
transparency and sanctity of the votes.

3.e. JCAP Officer’s term is co-terminus within the school year.

3.f. Vacated position shall be filled by the second highest ranking up to the least ranking
until the last position is vacated.

ARTICLE VI
JCAP OFFICERS, LEGISLATIVE DUTIES AND RESPONSIBILITIES

SECTION I The JCAP officers shall be:

a. President

b. Vice-President

c. Secretary

d. Sub-Secretary

e. Treasurer

f. Sub-Treasurer

g. Auditor

h. PIO

i. Business Managers

j. Marshals

k. Representatives

SECTION II DUTIES and responsibilities of the JCAP officer

2.a. The President shall be the chief executive of the organization. He/ she shall preside

at all meeting, coordinates and perform such other function or maybe necessary.

2.b. The Vice- Presidents shall assist the President in the performance of is duties. He

shall act in the absence or incapacity of the President.

2.c. The Secretary shall keep the record of the organization, prepare the minutes of the

meeting, and shall be responsible for the different appointment.

2.d. The Sub-secretary will assist the secretary in preparing records and works of the

organization.

2.e. The Treasurer should be the custodian of the funds and property and will prepare

the statement of accounts of the organization.

2.f. The Sub-treasurer will assist the treasurer in preparing statement of account and the

collection of funds of the organization.

2.g. The Auditor shall see to it that all funds disbursed by the organization are in order,

and certified by the Treasurer, Sub-Treasurer, the President and JCAP Adviser, and will prepare

statement of accounts signed by the abovementioned.

2.h. The PIO shall assist the Secretary and the representatives in disseminating

information and may perform such other office functions assigned to her/him.

2.i. The Business Manager shall assist the President manage the organization’s business

meeting and activities, and in purchasing needs and products needed by the organization.

2.j. The Marshals shall see to it that all the laws and ordinances of the organization and

the school be faithfully and properly executed.

2.k. The Representatives are responsible in informing their classmates in their respective

year level relative to any activity or activities whatsoever.

SECTION III Insignia of the JCAP officer

3.a. The JCAP officers must wear the JCAP identity pin together with their type A (GOA),
type B, and type C as indicated in Article VII, Section 1.

3.2. The JCAP organizational shirt should be worn as their type C as indicated in Article
VII, Section 1 Paragraph C.

3.3. The identity pin must be surrendered at the end of the semester or when the
position of the officer was vacated for being terminated, dropped, or any cases which will tend
to be inimical to the interest of the organization or the institution.

ARTICLE VII
ORDINANCES AND CONDITIONS IN WEARING UNIFORMS
AND MAINTAINING DIGNIFIFIED APPEARANCE

SECTION I Wearing Proper Uniform. Criminology students should maintain a dignified appearance

by wearing complete uniform.

1.a. Type A shall be worn Monday and Thursday. Type A shall include GOA

(Upper and Lower), plain white round T-shirt as inside wear, Institutional bag and belt,

shoulder loop must match the corresponding year level, black charol shoes, black socks

without prints, patches, and ID.

1.b. Type B shall be worn every Tuesday and Friday. Type B shall include GOA

pants (Lower), gray polo shirt, black charol shoes, black socks without prints, ID,

institutional bag and belt. Plain white T-shirt will be allowed for freshmen and

transferees for a period of time only.

1.c. Type C shall be worn every Wednesday and Saturday. Type C shall include

“maong” pants (any color) only excluding tattered and jogger pants, plain white T-shirt

(round neck) for 1st year to 3rd year levels, Institutional belt, civilian bag and ID. Also

included under Type C uniform are the approved organization polo shirts of the different

accredited organization of college.

1.c.1. Type C uniform for 4 th year students who do not have On-the-Job

training program in their subject course must wear formal attire/corporate attire.

 Male – long sleeves (tucked in) and

necktie/barong/tuxedo/suit, slacks (GOA lower is not

accepted), black socks, belt (institutional belt is not

accepted), black shoes (charol shoes are not accepted)

 Female – dress/formal blouse (tucked in) and skirt, with

or without blazer, sandals/heels/doll shoes.

1.c.2. Type C uniform

1.d. Students must wear uniform whenever they enter the school whether or

not they have official business in the school aside from their regular classes.

1.e. Wearing of civilian clothes will only be allowed if there is an order coming

from the administration or the college.

SECTION II Haircut/ hair scallop. Male Criminology students must adhere to the prescribed haircut

which is 3x4x1 while female Criminology students must scallop their hair at 9 o’clock in

the morning. All OJT female students should have their barber’s cut as a prescribed

haircut.

SECTION III Inspection process

3.a. Inspection of uniform and haircut shall be at the first and third week of the month

to be presided by the JCAP officers.

3.b. Spot inspection will also be conducted if the need arises as per approval of the JCAP

Adviser.

3.c. JCAP Officers are allowed to inspect at the main gate.

ARTICLE VIII
OTHER VIOLATIONS

SECTION I Using of cellular phones and other electronic gadgets during class hours by texting,

calling and playing mobile games.

SECTION II Possession of obscene materials including electronic and printed materials.

SECTION III Staying inside or outside gambling dens, billiard halls, video-oke bars during or after

class hours and computer shops if the student has classes.

SECTION IV Coming to class under the influence of liquor.

SECTION V Not wearing of ID’s or using ID cards other than their own.

SECTION VI Involvement in conflicts, trouble and similar activities with other students or outsiders.

SETION VII Staying along stairways during class hours.

SECTION VIII Colored hair, uncut fingernails, nails with nail polish, unshaved mustache and beard.

SECTION IX Using of other bags other than institutional bag in Type A and Type B uniforms.

SECTION X Wearing of too much or huge accessories.

10.a. Wearing of two or more rings.

10.b. Wearing of earrings in male and two or more pairs of earrings in female including

dangling.

10.c. Wearing of necklace.

Note: Necklace such as rosary, traveler’s charm or any other similar

apparels related to spiritual belief are allowed as long as it is limited and

kept hidden under shirt.

10.d. Wearing of wristwatch and bracelet at the same time.

SECTION XI Smoking ban be implemented to all students

SECTION XII The College of Criminal Justice Education will adopt a TRAFFIC SAFETY POLICY with the

following guidelines:

1. All PhilCST CRIMINAL JUSTICE EDUCATION students riding or driving any private

motor vehicle is covered under this policy.

2. Criminology Student driving their own motor vehicle must register their OR/CR,

updated driver’s license and a required helmet at the Deans Office.

3. Criminology Students driving a borrowed motor vehicle must register their

driver’s license and a required a required helmet at the Dean’s Office.

4. Criminology Students riding motorcycle is also required to have their helmet.

5. Registration of the said requirements will be monitored by Prof. John Vencent

Cazar.

6. Criminology Students who failed to register will not be given a final clearance

signed by the dean.

ARTICLE IX
PENALTIES IMPOSABLE FOR VIOLATING ARTICLE VII AND VIII

SECTION I Any criminology students who shall violate ARTICLES VII and VIII hereof shall be

punished with fine appropriate physical exercise that depends on the seriousness of the

offense.

1.a. for 1st year criminology students

1.a1. 1st offense-verbal warning

1.a.2. 2nd offense- fine of P10.00 and physical exercise

1.a.3. 3rd offense- fine of P10.00 and physical exercise and plus academic

enhancement activity.

1.a.4. 4th offense- fine of P10.00 and physical exercise academic enhancement

and activity.

1.a.5. 5th offense-call the parents

1.a.6. 6th room maintenance as subjected by the Officer in charge

1.a.7. 7th refer for the dean for recommendation (suspension, exclusion or

expulsion)

1.b. for 2nd year-4th year criminology students

1.b.1. 2nd offense- fine of P10.00 and physical exercise

1.b.2. 3rd offense- fine of P10.00 and physical exercise plusacademic

enhancement activity

1.b.2. 4th offense- fine of P10.00 and physical exercise plus academic

enhancement activity

1.b.4. 5th offense-call the parents

1.b.5. 6throom maintenance as subjected by the Officer in charge

1.b.6. 7th refer for the dean for recommendation (suspension, exclusion or

expulsion).

SECTION II Any students, who will violate the conditions above, shall cause the confiscation of

his/her identification card and be subjected to disciplinary action. In the absence of id,

registration form or shoes shall be confiscated. Confiscated ID, registration form or/ and

shoes must be claimed within the day it was captured. Neglect of claiming ID’s will

multiply the punishment and penalty to the date it was confiscated.

SECTION III That offenses accumulated within a school year only be subjected to the

aforementioned penalties.

SECTION IV Types of Offenses

4.a. Light Offense: SECTION I, VII, VIII, IX and X of ARTICLE VIII. Also includes proper

haircut and scallop.

4.b. Serious Offense: SECTION II, III, IV, V, and VI of ARTICLE VIII. Also includes proper

wearing of uniforms, proper haircut and hair scallop.

ARTICLE X
OFFFICERS OFFENSES

SECTION I All officers who shall not fully execute and effectively exercise their duties and

responsibilities shall be subjected to disciplinary action.

SECTION II COMMITTEE ON TERMINATION. The Committee on Termination is hereby created for

the purpose of terminating a JCAP officer.

2.a. Grounds of Termination. The committee may terminate a JCAP Officer upon the

satisfaction up to the following:

2.a.1. Wearing improper uniform of at least 3 times when he/she has class

within that day.

2.a.2. Absence or escape of duty without valid reason or without permission

during duty hours for at least 3 times.

2.a.3. Negligence and incompetence in the performance of duties;

2.a.4. If he/she was actually caught returning identification cards to concerned

individuals without being punished.

2.a.5. Misconduct during meetings and activities; and

2.a.6. If he/she not attending meetings without valid reason for at least 3 times.

2.b. Process of Termination. Upon receiving complaint against an erring JCAP officer, the

Committee shall hear and decide all cases of violations committed by an officer. The

judgment shall be limited to termination of an officer.

SECTION III Officers failure to receive their scheduled duty will be penalized with a fine amounting

to 10.00 per hour with or without valid reason. Officers must render 10 hours duty per

week.

SECTION IV Officers who are caught violating college rules and regulations will have their ID’s

confiscated and imposed penalty twice as that prescribed to the offenses mentioned in

Article IX. His/her fifth offense will be suspension, expulsion or exclusion which depends

on the seriousness of his/her offense.

ARTICLE XI
MEETING OF THE ORGANIZATION

SECTION I Regular meeting of the JCAP officer organization shall be every 1 st week of the month to

be presided by the president and by the adviser.

SECTION II Special meeting shall be called by the President or at the instance of at least one-third

(1/3) of the total number of all members of the organization.

SECTION III Officer who are absent during meeting with or without valid reason will be penalized

with an amount of 100php.

ARTICLE XII
GENERAL PROVISION

SECTION I Foundation. All Criminology members in the performance of their duties shall fully abide

by this code.

SECTION II Commitment. In order to ensure commitment by the member of the Organization, the

following shall be observed:

2.a. All Criminology members shall take upon themselves that the intents and sprit of

this Code are honored and upheld at all times.

2.b. Directors, Heads and other officer shall set an example and be responsible in the

observance of their Code.

2.c. All officers and members shall take an oath that they shall commit themselves to

this Code. The oath of commitment shall be done upon assumption of officer or during

their induction.

ARTICLE XIII
AMENDMENT

SECTION I This Constitution may be altered, revised or modified in whole or part by a voted of one-

third (1/3) of all members in a meeting particularly called for the purpose and after prior

notice given to members of at least two weeks before the meeting.

SECTION II Effectively. This Constitutional and By Laws shall take effect upon approval of the Dean

of Student Affairs through the recommendation of the Criminology Dean and the

organization adviser. Moreover, general meeting for dissemination of the provision of

the Constitution and By-Laws shall be undertaken immediately.

ARTIVLE XIV
FUNDS

SECTION I Primary source of funds shall be the membership fee of each students amounting to

150PHP each. Secondary source shall be the collected fines the violations and income

generating activities.

SECTION II The funds of the organization shall be spent for all activities and projects. All remaining

fund, in case, will be forwarded to the Dean of the College of Criminal Justice Education

in every end of the semester with corresponding statement of account for the specified

term.
