WHEREAS, an increa.se in thenumber and seriousness of violent and property crimes
committed by minors within theCity has created an emergency and an immediate dangerto the
preservation of public safety, health, and welfare in thc City ofChicago; and
WHEREAS, the large number of minors who are pennitted to remain in public places
and establishments at night in the absence of adult supervision has, in part, caused this increase
in crime; and
WHEREAS, regulating the hours during which minors may remain in public places and
in certain establishments without adult supervision, and imposition of certain duties and
responsibilities upon the parents or other adult persons who have custody of or responsibility for
minors, can reduce the amount of crime; now, therefore.

SECTION 1. DEFINITIONS.
Tlie terms "establishment," "guardian," "parent," "public place," and "remain" have the same
meaning as that ascribed to them by Section 8-16-020(a) ofthe Municipal Code of Chicago
("Code").

The tenn "minor" means any person under 18 years of age.

The term "Superintendent" means the City of Chicago Superintendent of Police.

The term "ticketed or sponsored event" means a civic, cliaritable, community-sponsored or


neighborhood-sponsored, entertainment, sporting, or other event: (i) organized, promoted and
carried out in full compliance with theCity of Chicago's laws, rules and permit requirements by
a not-for-profit or for-profit entity in good standing with the City, and (ii) that recjuires a ticket or
wristband for admission.
SECTION 2. INCREASED ENFORCEMENT.
The Superintendent is ordered and directed to immediately increase enforcement of Section 8-
16-020 of the Code ("Curfew Hours for Minors").
Thc Superintendent shall direct officers to use de-escalafion and dispersal tools regularly
employed to educate minors aboul curfew rules and to seek voluntary compliance.
Only when those efforts fail and a minor evidences a refusal to comply with the curfew, then thc
Superintendent is authorized and directed to take any minor in violation of Section 8-16-020 or
this Order into custody until such time as the minor's parent, legal guardian, or other adult having
legal care or custody of the minor is located and notified ofthe violation and takes custody of the
minor from the police.

SECTION 3. EXPANDED CURFEW.


Curfew hours for minors underthe age of 12 shall remain as stated in Section 8-16-020(a)(l) of
the Code.

Any minor who is 12 years of age or older is prohibited from remaining in any public place or on
the premises ofany establishment within thc City between the hours of 10:00 P.M and 6:00 A.M.
on all seven days of the week.

SECTION 4. EXCEPTIONS.
Prosecutions pursuant to Section 8-16-020 ofthe Code or this Order are all subject to the
defenses of Section 8-16-020(c), and the Ibllowing additional defense:
l l shall be a defense to any curfew violation if a minor was participating in, or returning
home immediately after, a ticketed or sponsored event and has documentary evidence of their
attendance at such event, e.g., a ticket stub or wristband with the event name preprinted on it.

SECTION 5. ASSISTANCE BY OTHER CITY DEPARTMENTS.


The Superintendent is authorized and directed to request appropriate assistance from other City
departments in effectuating this Order, and upon such request from the Superintendent, each
such Department shall render such appropriate assistance.
SECTION 6. EFFECTIVE DATE.
This order shall take effect upon its execution and filing with the City Clerk.
