Socio 102 Semifinal Examination

Gender Based Violence is a deeply pervasive problem found throughout


society in both private and public spaces (GVRC & GIC, 2012). GBV undermines the
health, dignity, security and autonomy of its victims (UNFPA). It is rooted in gender
inequality, the abuse of power and harmful norms. Thus, a serious violations of
human rights cause a life-threatening health and protection issue (UNHCR).

The following situations are examples of gender-based violence, read


comprehensively and answer the questions that follow:

Case 1
Leonor, a 17-year-old girl, is arrested on suspicion of being involved in terrorist
activities. In a police station, during her interrogation, a policeman beats and rapes her.
Police rules say that detainees must be treated humanely. When the case was
investigated, the policeman said that she agreed to have sex with him.

1. Do you think this kind of situation could happen?

I think this kind of situation is possible to happen knowing there’s two (2) types of
policemen, the righteous and those who are using their power to do such crime.

2. Was there any force used in this case? Expound your answer.

Yes. Leonor have been abused physically with actions such as rape and the beat up
that she got from the policemen during the interrogation.

3. Who is more powerful, Leonor or the policeman? Why?

In this kind of situation the policemen was more powerful than Leonor because they
can create an alibi against Leonor knowing that she was the one who was detained.
The policemen can clean up the mess they have done while Leonor cant possibly
defend herself from such abuse because of her case regarding the accusations she
have about the involvement of terrorist activities. It’s possible that no one would
believe her.

4. What kind of power does the policeman have? Support your answer. The power
that the policemen have is considered as physical power where the policemen
used their authority and strength as a man to rape and beat up Leonor.

5. What do you think will happen to Leonor?


If she will be given a strong attorney or if an attorney will be brave enough to fight
for her case, Leonor will be freed and have the justice that she deserve. If not, the
policemen would still be having their badge and could possibly do the same actions
to others and Leonor would be behind bars with a possibility of adding up another
case as to making false accusations.

Case 2
Faye and Gio love each other. They decided to marry and built a house away from their
families. Years and months passed, Gio changed. He used violence against Faye and
the beatings became increasingly serious.
January 01, New Year’s Day, Faye decided to leave Gio and sought a divorce. She
informed him of this and moved out of the shared home. Gio did not accept his wife’s
plea and threatened to kill her. Faye sought the assistance of ABC, a feminist civil
society organization.
January 05, Faye reported these threats to kill to the police. The police gave her a
protection order, which required Gio to stay away from her.
January 07, Gio followed Faye to her new home and threatened to kill her again. She
reported these threats to the police. The police informed the public prosecutor of
these threats and ask for Gio to be detained in breaching the protection order. The
public prosecutor refused to do this, as he considered that this would be
disproportionate.
January 10, Gio threatened to kill Faye again, she called the police again, the police
spoke to Gio on the phone and told him to keep away from Faye. But they did not pass
this information on to the public prosecutor.
January 12, Gio threatened Faye again. ABC, the civil society organization that is
helping Faye, sent a written communication to the police and the public prosecutor
explaining that the threats are continuing. They received no response.
January 15, Faye started the process for a divorce, at the same time, she obtained
another protection order.
January 20, Gio followed Faye to her workplace, and killed her. Subsequently he is
prosecuted and convicted for murder, and imprisoned for 20 years.

1. Who is responsible for the death of Faye? Expound.


First of, Gio was responsible of Fayes death followed by the policemen and the
prosecutor for neglecting the report of the ABC civil society organization about the
continuous threats that Faye received from Gio.

2. Is it enough that Gio was convicted of murder? Expound.


Yes because he was the one to pin about the motives of killing Faye. Harassment
and more cases could possibly added that would result him life imprisonment.

3. Did the people in authority do enough in providing protection orders? Whose


fault was it that the orders were not enforced? Expound.
The people in the authority especially the policemen failed to provide the
protection order firstly because of the failure to report the incident where faye
received threaths from Gio and didn’t forward it to the prosecutor and then they
didn’t do anything whenever Faye told them about the continuous threats she
received from Gio.

Case 3 (Dinamling vs CA; GR 199522, June 22, 2015)

Ricky Dinamling, a policeman, was in a five-year relationship with AAA. They had two
common children, aged four and two. One night, he went to AAA’s boarding house
with a friend after a drinking session. As AAA put the children to bed, he started to evict
her for the reason that she was using the place as a “whore house” wherein she
“brought her partners”. She did not want to leave, but he threw a baby’s feeding bottle
outside. She went to BBB’s house and requested to fetch her children. However,
Dinamling already left the boarding house with the older child and only the baby was
left.

In the past, he would hit AAA’s head, pull her hair, and kick her. When AAA went to the
police, she was merely told that it was a family problem that could be talked over.

Six days after the incident, AAA was at CCC’s house when Dinamling arrived. He
shouted and counted down for AAA to come out. When she came out, Dinamling
punched her at the left ear, which subsequently bled. When AAA asked him why he
kept on following her when she already had left him. Dinamling shouted her family
name and told her she was “good-for-nothing”. AAA left for the barangay captain’s
house, but Dinamling caught up with her and kicked her until she fell to the ground.
On the road, Dinamling pulled down AAA’s pants and panty and shouted at her while
people looked on. Dinamling then, threw the pants and panty back at AAA and
shouted her family name. Dinamling, then intoxicated, left on a motorcycle. AAA stayed
at her friend’s home until she felt some back pain in the morning. She found out she
was bleeding and about to miscarry so she was immediately brought to the hospital.
There, she was told that she was 19 weeks pregnant and had an incomplete abortion.
She was hospitalized for four days. Dinamling visited her but showed no remorse over
his acts. Dinamling was charged with violations of R.A. 9262.
